About this file

This is Addendum 1 to a Request for Offer (RFO) solicitation issued by the Texas Commission on Environmental Quality (TCEQ) for Central File Room (CFR) Operations and Records Management Support services. The addendum corrects the pre-proposal conference link, posts conference slides and attendee information, and incorporates the most recent State of Texas Subcontracting Plan effective May 2026. The solicitation seeks a qualified contractor to operate TCEQ's Central File Room and provide comprehensive records management support including administration, circulation, imaging, document review and redaction (DRR) processing, and special projects. The contractor must manage records across three buildings in Austin (Buildings A, C, and E) and process minimum annual volumes of 15,000 linear inches (approximately 1,500,000 pages) of imaging and 4,810,000 pages of document review and redaction. The mandatory pre-proposal conference was held on May 6, 2026, from 2:00 PM via Microsoft Teams. The deadline for written questions is May 11, 2026, at 2:00 PM Central Time, and proposals must be submitted by May 26, 2026, at 2:00 PM Central Time via TCEQ's FTPS server as a single searchable Adobe PDF file. The initial contract term is two years from September 1, 2026, through August 31, 2028, with three optional one-year renewal periods available.

Respondents must submit firm, fixed annual pricing on a per-page basis for core services (administration, circulation, standard and oversize imaging, and microform conversion) with special projects billed at hourly rates and fixed prices identified in the price form, and emergency after-hours work subject to a specified percentage increase. All responses require a completed State of Texas Subcontracting Plan demonstrating good faith effort to utilize certified Veteran Heroes United in Business (VetHUB) vendors, with TCEQ establishing a minimum 1.0% VetHUB utilization goal across all procurement categories. Evaluation criteria allocate 15 points to company overview and past performance, 25 points to personnel and staffing plan, 30 points to technical approach, and 30 points to price. Key staffing requirements include security clearances for all personnel, completion of cybersecurity training, and provision of comprehensive insurance including workers' compensation, commercial general liability of $2,000,000, technology professional liability, and cyber risk insurance of $1,000,000. The contractor must demonstrate business continuity planning with 72-hour disaster recovery capabilities. No incumbent contractor or funding source is identified in the addendum; however, TCEQ retains sole discretion to reject any or all responses and may pursue best and final offers or reduce scope if budget constraints require.

State of Texas Subcontracting Plan Revised Rule Effective 5/12/26

State of Texas Subcontracting Plan Revised Rule Effective 5/12/26

The Texas Comptroller of Public Accounts (CPA) has adopted amended Historically Underutilized Business (HUB) program rules at 34 Texas Administrative Code (TAC), Chapter 20, Sections 281- 298.

The new rules take effect May 12, 2026.

A responder may choose to self-perform, but if they are subcontracting, the rule change allows only one method for showing good faith effort. Accounting for the narrower focus of the HUB program to service-disabled veterans (VetHUBs), prime contractors who will subcontract any work must now notify two certified VetHUBs of each subcontracting opportunity. The seven business days notification and response period for potential subcontractors is unchanged.

Note: There is a new subcontracting plan form at the Comptroller’s website. For solicitations posted prior to May 12th but closing after May 12th, Responders may choose to submit either form. The new form is required for all agency solicitations posted after May 12th.

Please, read the Solicitation’s HUB Program requirements for Solicitation/Contract compliance.

State of Texas Subcontracting Plan When is a subcontracting plan required?

A subcontracting plan is required for state of Texas contracts when the contracting agency has determined that subcontracting opportunities are probable with prospective vendors certified by the Texas Comptroller through the Veteran Heroes United in Business (VetHUB) program, for a contract with an expected value of $100,000 or more. (Texas Government Code Chapter 2161, Subchapter F; 34 Texas Administrative Code Section 20.285.)

When a state agency requires a subcontracting plan as part of the contract solicitation, a bid, proposal, offer or other applicable expression of interest must contain a completed plan to be considered responsive.

Who completes a subcontracting plan?

Every responding vendor — whether a prime contractor or self-performing with no subcontractors — must submit a complete subcontracting plan.

A vendor who intends to use subcontractors must demonstrate their good faith effort to recruit certified VetHUBs, whether or not they ultimately award business to them. A state agency will not use the subcontractors’ VetHUB status to select the winning vendor. All subcontractors must be listed in the subcontracting plan.

A self-performing vendor who will not subcontract any of the work on the contract must indicate that it will complete the con-tract with its own resources and submit the completed subcontracting plan.

Does a subcontracting plan have to be followed?

The subcontracting plan forms part of the contract. Subcontractors may not be dropped or replaced without amending the subcontracting plan with approval by the agency. A self-performing contractor may not use subcontractors without amending the subcontracting plan.
