About this file

This document is an addendum to Solicitation 405-24R0018015 issued by the Texas Department of Public Safety (DPS) for the testing of Red Dot Rifle Optics with mounting systems for a picatinny rail system. The addendum provides answers to submitted questions, including details on acceptable alternate ammunition, approval of 1x magnified prismatic optics, and allowance for proposing multiple optic models. DPS will conduct a two-phase testing process, with optics mounted on DPS rifles during all phases. Bidders will not be required to provide references, and the DPS Terms and Conditions related to testing and acceptance do not apply to this solicitation.

The solicitation specifies that bidders must use the provided Vendor Exceptions Form to request any modifications to the DPS Standard Terms and Conditions. Bidders are not required to provide a Texas Payee Identification Number or Texas Franchise Tax File Number. DPS will mount the optics per manufacturer specifications and allow clear lens covers, but will not permit kill flash or similar anti-reflective devices. The drop test will be conducted from a height of 60 inches, and bidders may provide alternate ammunition for testing from the specified Winchester .223 Remington.

Questions and Answers Solicitation 405-24R0018015

1. I started checking on availability of the USA223R1 load specified for the rifle optics testing and immediately found it wasn’t generally available from any regular sources. Can you please advise on how rigid this requirement will be and if it is, please advise where those of us submitting test samples can buy this ammo?

Answer- The below are approved as an alternate to the Winchester .233 USA223R1

• Frontier .223 Remington 55gr FMJ

• Hornady TAP .223 Remington 55gr FMJ

2. Would you consider a 1x magnified prismatic optic with an etched reticle?

Answer: Yes

3. Can we submit more than one optic in response to this bid? If yes, would that require a complete set of additional bid response documents?

Answer: No, two separate responses are not necessary. Please clearly state what the submission is for and the differences between each one in regard to our specifications.

4. Section D.6.2.D requires bidders provide at least three references for contracts of similar size and scope. What does DPS expect to be the size and scope of this contract (in terms of number of optics, length of contract, and budget)?

Answer: References are not applicable for this solicitation. This solicitation is not for the purchase of firearms and DPS does not have an estimate currently.

5. Section 5.5, Testing; Acceptance; Return; Revocation – What are the acceptance criteria that would be applied in this section? Are they the same as the testing standards outlined in the bid solicitation?

Answer: Section 5.5 DPS Terms & Conditions do not apply to this solicitation as this Invitation for Bids is to test devices only. The testing standards outlined on the Bid Solicitation are the standards that will be used to evaluate all submitted items.

6. Will DPS consider proposed modifications to the Standard Terms and Conditions or would that result in disqualification from the bid process?

Answer: If Bidder has exception requests to the DPS Standard Terms and Conditions, it must use Vendor Exceptions Form. Added to the solicitation as Exhibit F.5.

7. We do not have a (Texas) Payee Identification Number. What would you like us to input into this block for our bid response?

Answer: Non-Applicable

8. We do not have a Texas Franchise Tax File No. What would you like us to input into this block for our bid response?

Answer: Non-Applicable

9. Will the optics remain mounted to the same (DPS) rifles for both Phase I and Phase II of testing?

Answer: The optics will be mounted on DPS Rifle during all phase’s of testing.

10. Does DPS have a desired mount height (centerline of optic)?

Answer: Manufacture recommendation for best performance.

11. Does DPS prefer a quick-detach mount or not?

Answer: Quick-detach is not preferred but it will not eliminate the optic.

12. Does DPS have specific requirements that define what is, or is not, and “throw lever”?

Answer: We are not defining a throw lever due to the variety or manufacture/market description. A device that aids in the adjustment of magnification.

13. “All submissions will be inspected for conformity with specifications/salient characteristics by the Texas Department of Public Safety Firearms Training Unit and armorers.”

Will the Department of Public Safety representatives allow SIG SAUER Electro-optic flip up lens covers be clear?

Answer: Yes, they are permitted.

Answer: Kill flash or similar anti reflective devices are not permitted.

14. “All tests will be conducted with Red Dot Rifle Optic mounted to a Daniel Defense DDM4V7 patrol rifle.”

Will all shooters be provided new Daniel Defense rifles when the testing begins?

Answer: During Phase I optics will be placed on Department rifles with a lower round count.

During Phase II the optic will be mounted on a newer Department rifle, with less than 500 rounds through the weapon.

Will the Department of Public Safety representatives allow SIG SAUER to bring SIG SAUER rifles to the testing with the requested SIG SAUER Electro-optics mounted and installed for testing?

Answer: No, optics will be tested on most common Department approved gun.

15. If SIG SAUER is not approved to bring SIG SAUER rifles with SIG SAUER Electro-optics installed: Will the Department of Public Safety representatives allow SIG SAUER shooters to mount the Electro-optics to the Daniel Defense rifles prior to the beginning of testing?

Answer: No, The Department representatives will mount the optics per manufacture specifications.

16. “The optic and rifle will be dropped onto a concrete surface from 60 inches.”

Will the Daniel Defense rifle be tested in the same configuration/platform during the drop test?

A 60” drop test is standard for a pistol drop test. Due to the force and weight of a rifle drop SIG

SAUER respectfully requests the drop test height be lowered to account for the weight of the rifle.

Answer: The average male eye is height is 64” while the average female eye height is 59”. The

60” height was based off these numbers.

17. “The Bidder will supply 5,000 rounds of ammunition for this test. The ammunition required will be .223 Rem, Winchester 55 grain full metal jacket (USA223R1).”

Will the Department of Public Safety representatives allow an alternative ammo for testing?

If so, what other ammunition brands are acceptable?
