About this file

This document is a Justification for an Exception to Fair Opportunity for a Defense Logistics Agency (DLA) contract modification involving the STORES (Subsistence Total Order Receipt and Electronic System) sustainment task order. The modification extends support services for STORES Classic and STORES 2.0 through October 24, 2025, with Accenture and Diverse Business Systems (DBS) as the incumbent contractors. The total estimated dollar value of the requirement is $2,732,391.11.

The document details the DLA's efforts to modernize its subsistence ordering platform, transitioning from STORES Classic to STORES 2.0 on the DLA enterprise e-commerce platform (FedMall). The sole-source justification is based on the contractors' unique institutional knowledge, existing partnership, and critical support for the system's modernization. The modification aims to ensure continuity of support for the warfighter, maintain the development timeline, and leverage the existing vendors' expertise without risking performance disruption or increased costs associated with onboarding a new vendor.

CUI| Source Selection Sensitive Information – See FAR 2.101 & 3.104 development team could absorb them into their development team.

With the planned sunset of STORES Classic, work is already underway by the STORES 2.0 development team to provide next generation Class I subsistence support to the warfighter, and the project is progressing according to schedule.

The estimated dollar value to continue sustainment services for this STORES Sustainment task order is for Accenture and Diverse Business Systems, respectively. The total estimated dollar value of this requirement is $2,732,391.11

This Task Order was competitively awarded on 8 July 2022. The period of performance (PoP) of the Task Order runs through October 24, 2025. The period of performance for the next 6 months would be: October 25, 2025 to April 24, 2026.

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY (SEE FAR

16.505(b)(2)) AND THE SUPPORTING RATIONALE, INCLUDING A

DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE EXCEPTION CITED:

In accordance with FAR 16.505(b)(2)(i)(C), the proposed modification must be issued on a sole-source basis in the interest of economy and efficiency because the work to be performed is a logical follow-on to Task Order SP4709-17-D-0023/ SP4709-22-F-0068 and SP4709-17-D-

0023/SP4709-22-F-0069,

The proposed modification will be made under the terms of the existing Accenture and DBS Task Orders and JETS IDIQ contract SP4709-17-D-0023/SP4709-22-F-0069. As stated in Section 2, all eligible JETS IDIQ contract holders were provided a fair opportunity to be considered for the initial Task Order award.

The work to be performed under the proposed modification is a logical follow-on to the initial Task Order because it will be a continuation of the application sustainment, application enhancement, capabilities management, technology sustainment of all required environments, database administration for all required environments, policy and audit readiness, confirmation management, information assurance, enterprise architecture support, and reporting support already being performed for the STORES PMO. This modification will enable efficiency and consistency across both STORES Classic and STORES 2.0, which is a highly anticipated capability the MILDEPS are awaiting.

The DLA PEO directed the STORES and FedMall Program Offices to develop a modernized STORES solution, rationalized onto the DLA enterprise e-commerce platform (FedMall). This contract was awarded to and is being supported by Accenture and DBS, due to the partnership between the three vendors. The tasks within the PWS for this requirement are identical to the tasks being performed under Task Orders SP4709-17-D- 0023/SP4709-22-F-00 and SP4709-17-D-0023/SP4709-22-F-0069 and therefore, this requirement is a logical follow-on to the initial Task Orders.

Aside from the time required to train a new vendor, which would place DLA at risk of not delivering the requisite system performance to the warfighter for STORES Classic, choosing a new vendor would also put the schedule for STORES 2.0 in severe risk, increasing development costs for STORES 2.0, sustainment costs for STORES Classic, and missing the deadline DLA shared to OSD and the Military Departments. There are economies of scale benefits and efficiencies to the development timeline that DLA is uniquely poised to reap by having these contractors continue this work. No other vendor can come into this work at this juncture and harness the unique institutional knowledge that these vendors have; recreating this knowledge would take time and additional resources and not be in the best interests of the Government. Any other vendor would have to learn the STORES application, learn the problems, and reinvent solutions when these vendors already possess this knowledge.

5. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE:

The Contracting Officer will determine that the price is fair and reasonable prior to task order award. Price will be analyzed in accordance with FAR 15.404-1 procedures, and the Government will use various price analysis techniques, as needed, including but not limited to: (1) Comparison with competitive price lists in accordance with FAR 15.404-1(b)(2)(iv).

(2) Comparison of proposed price with the Independent Government Cost Estimate in accordance with FAR 15.404-1(b)(2)(v); and (3) Comparison of proposed prices obtained through market research for the same or similar items in order to obtain a fair and reasonable price in accordance with FAR 15.404-1(b)(2)(vi).

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

N/A

7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION TO

FAIR OPPORUNITY BEFORE AN SUBSEQUENT ACQUISITION FOR THE

SUPPLIES OR SERVICES IS MADE:

DLA will continue to exercise competition among the pool of service provider offerors capable of performing the work defined in the follow-on FedMall Development and Sustainment and STORES Sustainment task orders. DLA will continue its practice of ensuring that full and open competition is exercised to the maximum extent practicable.
