About this file
This is an Exemption from Competition (EFC) request form submitted by the Idaho Department of Fish and Game (IDFG) to the Division of Purchasing (DOP) for fisheries database support and maintenance services. The agency requests a direct procurement exemption to contract with WSP USA, Inc. for ongoing database support services related to the Lake Pend Oreille Bonneville Power Administration (BPA) program and associated fisheries databases. The request was submitted on September 14, 2026, with an anticipated approval date of September 15, 2026. The contract is structured as an ongoing engagement rather than a one-time purchase, with an anticipated total cost of $25,000 and expected yearly maintenance costs ranging from $15,000 to $25,000 annually.
The IDFG justifies the exemption from competition based on the impracticality and disadvantage of competitive solicitation, citing the institutional knowledge and specialized expertise of Dustin Ford, a fisheries biologist and program manager at WSP who designed and built the agency's custom database over nearly 25 years of collaboration. Ford possesses technical expertise in database management and fisheries science, and maintains working relationships with key project partners including Avista, the Kootenai Tribe of Idaho, and the British Columbia Ministry of Water, Land and Resource Stewardship. The DOP Administrator intends to approve the exemption pending legal notice, and the exemption request has been posted for public review to allow other suppliers to provide relevant information supporting or contradicting the agency's claims regarding the impracticality of competition.

Type of Exemption*
A solicitation has been completed and my Agency wishes to award contracts to multiple vendors for the same or smilar property (Multiple Award Authorization)
My Agency wishes to administer or award a solicitation at a dollar amount above its normal Delegated Purchasing Authority (Limited/One-Time DPA)
The property required is available on one or more open contracts, but my Agency wishes to purchase from a different vendor. (Note: if total value is over $10,000, Agency must also check the box for exemption from competition if requesting to pruchase from a specific vendor). (Utilization of Open Contract).
A solicitation is being developed (by my Agency under its DPA or in conjunction with DOP) and my Agency wishes to limit responses to a specific manufacturer/brand name (I.e. no substitutions). (Note: this option assumes that multiple vendors can offer the identified brand name; otherwise, select the option for exemption from competition to request a Sole Source Authorization (Brand Name Only)
A solicitation has been completed and there is a need to negotiate with one or more vendors. (Authorization to Negotiate)
My Agency is seeking to purchase directly from an identified vendor without completing a solicitation OR wishes to perform a level of competition that is less formal than would typically be required. (Various exemptions-additional questions to follow) mailto:eric.wagner@idfg.idaho.gov

Exemption from Competition
IDAPA 38.05.01.042.05 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to:
special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Background* Describe the circumstances
Dustin Ford is a fisheries biologist and Program Manager with WSP and has worked with IDFG on various fisheries projects for nearly 25 years.
He's been supporting the Lake Pend Oreille BPA program for the past 2 years on building and maintaining our field database.
This field has a 500 character limit
Justification* Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
Dustin designed and built our database, so he knows the system inside and out. That institutional knowledge would be difficult and time-consuming for someone else to replace. He has extensive experience building similar fisheries databases, including the Kootenai River White Sturgeon and Burbot databases used by IDFG and our partners. Dustin understands both the technical side of the database and the fisheries work it supports, which makes it much easier to develop practical solutions and implement changes quickly. He also works with several of our project partners including Avista, the Kootenai Tribe of Idaho, and the British Columbia Ministry of Water, Land and Resource Stewardship – which helps ensure data sharing and collaboration go smoothly across programs.
Description* Describe the extent to which competition is possible
Due to the long running history of working with Dustin Ford and his custom-built database, it would be unreasonable and disadvantageous to complete a competitive solicitation for the ongoing services required. The expected cost for yearly maintenance is $15-25k per year.
Agency Certification*
The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State.
