6. As a result of this amendment Section L.4.C SECTION II - DATA OTHER THAN CERTIFIED COST OR

PRICING DATA, Direct Labor of the Solicitation is modified to include the following:

From:

Direct Labor

On Schedule 5, provide the proposed unloaded hourly labor rates for the labor categories defined in Attachment No. J.1 - LABOR CATEGORY DESCRIPTIONS AND QUALIFICATIONS. Show calculations used to compute the proposed direct labor rates. Provide the basis and rationale for the labor rates proposed; for example, company-wide bidding rates, current salary data for named individuals, survey data, or anticipated new-hires, etc. Show how company categories or surveys are mapped to the RFP categories. Explain your approach and show how the educational and experience requirements in the RFP relate to your company categories.

On Schedule 6, provide the name, the actual hourly rates (annual salary divided by 2,087) for the proposed Key Personnel and other individuals and the labor category rate from Schedule 5.

Current labor and salary data should be escalated to the performance period. Offerors should use

2.25 percent per year to escalate its current data. If an alternative escalation factor is used, provide documentation and rationale. In either event, show all calculations.

There will be a total of 8 resumes in response to the instructions at L.5.D., PART A STAFFING.

Complete the table below to identify the names and employers. Provide labor rate information on Schedule 6 to assist in evaluating cost realism. For each resume, provide the name, labor category, Solicitation No. DTRT5717R20017 Page 10 of 15 current labor rate, and the labor rate escalated to the cost proposal performance period in Schedule

6. If any individual’s labor rate is 5 percent more or less than the proposed labor rate for that category, show calculations and provide a narrative addressing cost-realism for the proposed labor cost.

If the individual is a contingent hire, a signed letter of intent that includes salary will be included. If any individual’s labor rate is 5 percent more or less than the proposed labor rate for that category, show calculations and provide a narrative addressing cost-realism for the proposed rate for that category.

7. As a result of this amendment Section L.4.A INTRODUCTION of the Solicitation is modified to include the following:

Instructions for Subcontractors

Cost Type/FFP Subcontracts

Subcontractors, regardless of the subcontract value, must follow the same proposal preparation instructions, complete the Cost and Business Proposal cover sheet, checklist, and cost schedules, and meet the same requirements for the Cost and Business Proposal as the Prime Contractor except for those sections that clearly have no applicability to a subcontractor. Cost-type subcontractors are NOT required to complete Section J, Contract Cost Proposal Schedules 6, 7, 8, and 9. Subcontracts shall be adequately documented to facilitate the Government’s complete and meaningful review.

If the subcontractor’s accounting system has not been reviewed by a Government audit agency and determined by the CO to be adequate for determining costs under a cost reimbursement-type contract, the cost-type subcontractor should describe its accounting system characteristics and state what actions it has taken to ensure the system will be recommended for approval by the CO when audited by a Government audit agency for Cost Type subcontractors only.

T&M Subcontractors

T&M subcontractors should not use the Cost and Business Proposal schedules. Consent for subcontracts of this type may be given based on either cost build-up or the commerciality of the billing rates. For consent based on cost build-up, details of each cost element must be provided (i.e., direct labor, overhead, General and Administrative (G&A)). Each cost element should be supported and explained. The application of a reasonable profit rate is expected. Include a signed statement that the offered rate is the “most favored customer rate” or explain why the most favored customer rate was not provided. T&M subcontractors may send the information directly to the Contracting Officer.

Questions and Answers

1. Sub factors 2 and 4 are basically asking for a staffing matrix of "management staff" and "staff members for whom resumes are being submitted" cross referenced with the SOW in Section C.

Many of the "management staff" are also resumed individuals in the proposal. Questions:

1) Is it Volpe's intention that we provide two separate staffing matrices or one matrix covering all key personnel?

2) If you do want two separate matrices, what do you define as "management staff"?

a. Only one staffing matrix covering key personnel is required.

2. 2. Section L.5.C indicates resumes must be verifiable. What constitutes a "verifiable" resume?

Please clarify.

a. A “verifiable” resume, is a resume that the Government check and be demonstrated to be true. This statement means that the resume will provide the Government with enough information to verify all skills, relevant accomplishments, and education background.

3. Item 6A Estimated Cost should include costs of Schedule 2 and Schedule 3, please confirm.

a. Item 6A is a total of both Schedule 2 and 3 Costs.

4. Per RFP, escalation calculations must be shown. Schedule 5 does not account for calculation of escalated labor. Is it permissible to add a column to show escalation calculations?

a. Yes, it is permissible to add a column to show escalation rates.

5. There are discrepancies between labor categories between Schedule 5 and Schedule 6. Please clarify the positions between the Schedule 5 and Schedule 6:

• Industrial Hygienist vs Certified Industrial Hygienist

• Site Supervisor vs Site Superintendent

• Health Physicist is on Schedule 6 but not on Schedule 5

a. Correct Labor categories are Certified Industrial Hygienist, and Site Supervisor. See revised schedules are in Amendment 000005. The Health Physicist will only remain on Schedule for labor cost realism.

6. Many check list items are incomplete such as item number 5, 13, 14, 15, 18, etc.

a. See amendment 000004 for updated checklist.

7. Direct Labor value says to apply value from “Schedule 6.” Should it be applied from the total of Schedule 5

a. This is correct please apply values from Schedule 5 not 6. See updated schedules in Amendment 00005.

8. Direct Labor is a 80%/20% split of the total labor on Schedule 5. Should subcontract labor be applied at the same splits?

a. Yes all labor shall be spilt 80% FFP and 20% CPFF.

9. Administrative staff hours must be estimated by each Offeror and subcontractor. Where shall those estimates be provided?

a. Please enter the estimated hours in the revised Schedule 5 included in Amendment

000005. The administrative support hours do not count towards the 7,420 technical level of effort hours

10. Contracts Administrator and other ‘admin’ roles are included on the labor table in Schedule 5.

Are there overlaps to this requirement for additional admin hours?

a. Additional administrative support that is not identified in the labor categories can be included in the row below the “Total Technical Hours Proposed”. This is for administrative support and the hours are estimated by the Offeror.

Solicitation No. DTRT5717R20017 Page 13 of 15

11. Subcontractors may be awarded a FFP subcontract regardless of whether their accounting system has been approved to incur costs under a cost-reimbursable contract. Can the requirement be revised to submit CPFF cost data for those entities that will be subcontracted as a cost-type contract?

a. Offeror’s only need to submit CPFF information for subcontractors that will be utilized as a cost type

12. What is required for a Contract Cost Control Plan?

a. A cost control plan is developed by the offeror. The Cost Control Plan must describe the system and method that will be used to track and control costs at the task order level, including costs incurred by subcontractors. The Offeror should explain how potential cost overruns would be identified and discuss accountability within its organization for tracking and controlling costs.

13. Request removal of requirement for “Identification of Subcontractor Effort” due to the fact that there is no project scope of work in which to calculate a subcontracted effort, like field work.

a. This is a clause will remain as it is required by the Federal Acquisition Regulation.

14. Please confirm resumes are not page counted but are limited to 3 pages

a. Resumes are not part of the page count but are limited to 3 pages.

15. Please confirm that an Executive Summary is not page counted.

a. Executive summary is not part of the page count.

16. Please confirm that the Table of Contents and Acronym List will not be page counted.

a. Table of contents will not be included in the page count.

17. Question 1: According to Preproposal Conference/Slide Show subcontractors will provide a

Schedule B and at the 80% - 20% split of the total SubK labor will be applied to Schedule 2 and Schedule 3. This will essentially mean an additional 7,420 hours of labor to be added into the cost models per subcontractor at a raw-cost basis. Is this the intent of the model?

a. No, the 7,420 hours will be compromised of both subcontractor and prime labor.

18. Question 2: Subcontractors are required to submit Schedule 5, which is the labor schedule of base rates calculated against 7,420 hours. There is not a model to build up the rate to a fully-burdened labor rate. Therefore, Schedule 9 will be a total of base rates over 7,420 hours. Is that the intent of the Government to add subcontractor costs at a total of base and not burdened rates?

a. Subcontractors rates included in Schedule 5 shall be fully burdened. See Amendment 00005 for additional information on what is required from subcontractors.

Subcontractors’ will submit a buildup of their rates either on the applicable schedules for CPFF and FFP subcontractors or with the use of their own documents for T&M.

19. In Section L.5.C, Section 3, the proposal states: “The Offeror shall provide summaries of the five most relevant contracts”. Please verify if for large ID/IQ contracts if the offeror should summarize the entire contract or an individual task order within the contract.

a. Please provide work performed at the task order level.

20. In the cost volume, there are references to Professionals and Junior Professionals in which we need to provide pricing. Can you provide additional information as to the qualifications of these two labor categories?

a. Junior professional have 2 years of experience Professionals have 5 years’ experience.

21. If our team members provide annual updates in SAM for Representations and Certifications, are the Reps and Certs still required for submittal in the proposal?

a. If Reps and Certs are up to date in SAM it is not required to be submitted separately.

Please make a note of this in the proposal so that the evaluation team is aware.

22. Can you provide an estimated combined contract value?

Solicitation No. DTRT5717R20017 Page 14 of 15

a. No, the estimated value is expressed in hours. Those hours represent one year of the requirement.

23. During the pre-bid webinar it was stated that a Small Business Subcontracting Plan was not required. Please confirm.

a. Yes, this is correct.

24. At the end of the Project Description Form, we are asked to provide the name, services provided and % of any major subcontractor. What constitutes a major subcontractor, is there a dollar threshold or percentage threshold above which we should include a subcontractor that worked on that project?

a. A major subcontractor is any subcontractor that performs 20% or more of the total effort.

25. Could a JV member send confidential financial information such as indirect rates and indirect rate calculation directly to the Contracting Officer, separately from the main proposal submittal? Are any particular requirements for this process that we need to adhere to?

a. Confidential financial information may be sent in the required format of the solicitation separately to the Contracting Officer. Please identify the proposal the RFP number and the proposal it is intended to be part of when submitting.

26. Under Section L.4.C, 4th paragraph, it states” On schedule 6, provide……(annual Salary divided by 2087)…” Can you please confirm the number 2,087? Generally, annual salaries are calculated using 2,080.

a. This has been revised to 2,080 hours in Amendment 00005 item 6.

27. On Page 93 of the RFP, under Other Direct Costs (ODCs), there are RFP-stipulated ODCs and

Offeror-estimated ODCs. Can you provide the basis or explanation of the RFP-Stipulated ODCs so Offeror does not duplicate ODCs?

a. ODCs for the purposes of this evaluation are provided by the Government. Please utilize the values for Travel and Misc provided. This will be more applicable at the task order level.

28. Under Section L.3.B, Section 3 Business Proposal shown on page 86, the section summary calls for a Small Business Subcontracting Plan and Conflict of Interest Statement but it is not further clarified the Section 3 shown on pages 108 through 109. Are these two items required as part of Section 3? If yes, please provide further clarification on the requirements.

a. Small Business Subcontracting plan is not required for this procurement.

29. Under Schedule 4 – Establishment of Maximum Factor and Calculation of proposed Amounts for

Fixed Fee and Profit (page 101), is RFP-Stipulated Miscellaneous Costs to be included under “Subcontracts, Equipment, and Travel Costs (1)” or “All Other Costs from Schedule 2/3 (2).”

a. These should be included under “Subcontracts, Equipment, and Travel Costs (1)”.

30. Under Schedule 4 – Establishment of Maximum Factor and Calculation of proposed Amounts for

Fixed Fee and Profit (page 101), footer Note (1) “Subcontracts, Equipment, and Travel Cost” should not include any Prime indirect burden. Can the offeror include that Prime Indirect Burden cost in the second row in “All Other Costs from Schedule 2/3 (2)” section.

a. “All Other Costs” should include all remaining costs from Schedule 2 and Schedule 3 except cost of money, if proposed.

31. Under Schedule 4 – Establishment of Maximum Factor and Calculation of proposed Amounts for Fixed Fee and Profit (page 101), the boxes require that the Offeror include “All Other Costs from Schedule 2/3 (2)” which would also include G&A indirect cost shown in Schedule 2/3. This company uses Total Cost method for calculating G&A. This conflicts with footer Note (1) “Subcontracts, Equipment, and Travel Cost” should not include any Prime indirect burden.

Prime Indirect Burden and G&A are the same thing for this company. In that example, how much G&A cost should the offeror include when filling in the Estimated Cost for All Other Costs from Schedule 2/3?

a. Those costs should be included in All Other Costs.

32. Under Section II – Data Other than Certified Cost or Pricing Data, subsection “Subcontracts,”

Solicitation No. DTRT5717R20017 Page 15 of 15

It is the responsibility of the Prime Contractor to review and evaluate the subcontract proposals and accompanying cost or pricing data and furnish the results of such review to the Government as part of the cost submission regardless of whether the details are provided to the Prime Offeror or separately to the Government. The Prime’s review should be as detailed as the information provided by the subcontractor directly to the Prime permits. It’s unclear if this only pertains if the subcontractor is proposing T&M rates or in a broader sense. Please clarify.

a. All subcontractors must be evaluated by the prime to ensure fair and reasonable pricing.

33. Please clarify what information Subcontractors should submit in a sealed envelope along with the prime Offeror’s proposal.

a. Proposal submission has changed to electronic in Amendment 000003. Subcontractors may submit rate build up information separately to the Contracting Officer.

34. Under Section II – Data Other than Certified Cost or Pricing Data, subsection Indirect Rates, “The Government expects that the preponderance of work will take place at the Offeror’s facility, but some task orders will be performed at a Government facility. The hours have been segregated into Contractor-Site and Government-Site,” however, none of the Schedules indicate which hours are Contractor-Site and which are Government-Site. Please clarify.

a. Assume all work is to be performed at the Contractor’s Site for this proposal.

35. Under L.5.C, Section 3-Past Performance, please clarify whether CPARS reports are to be used in lieu of Past Performance Questionnaires for federal contracts. For non-federal contracts, please clarify whether the Client Authorization Letters and Past Performance Questionnaires must be completed and included within our proposal submittal or sent directly Michael.griffin@dot.gov?

a. Please use CPARS when possible. When CPARS are not available please send the Past performance questionnaires directly to the Contracting Officer.

36. Due to the number of questions for which we seek clarification, we respectfully request an extension to the proposal due date to allow sufficient time to incorporate the government’s forthcoming answers into our proposal submittal.

a. Proposal submission date has been changed in Amendment 000005.
