Categorical Exclusion Form Natchez Trace Parkway
Project: PRA-NATR 1G10 Date: March 18, 2014
Project description, including location:
The Eastern Federal Lands Highway Division of the Federal Highway Administration (FHW A), in cooperation with the National Park Service (NPS), is proposing to rehabilitate the Parkway motor road from milepost 3 71 to milepost 3 78 in Wayne, Lawrence, and Lewis Counties, Tennessee. The work will include resurfacing the motor road and the associated parking areas, placement of shoulder material, spot patching and leveling, striping, and other miscellaneous work. Milling will be required at bridges, pulloffs, and parking areas to maintain a 6-inch curb reveal.
Describe the category used to exclude the action from further NEPA:
23 CFR § 771.117(d)(1) Modernization of a highway by resurfacing, restoration, rehabilitation, reconstruction, adding shoulders, or adding auxiliary lanes (e.g. , parking, weaving, turning, climbing).
Describe any public or agency involvement effort conducted:
A letter dated January 8, 2013 was sent to the U.S. Fish and Wildlife Service (FWS) requesting concurrence that the proposed project may affect, but is not likely to adversely affect any Federally-listed species. By letter dated February 10, 2014, the FWS concurred with the FHWA's detennination, stating that, "We are unaware of any federally listed or proposed species that would be adversely impacted by this project."
An Assessment of Actions Having an Effect on Cultural Resources was approved on March 12, 2014. The project will have no adverse effect on cultural resources.
The NPS categorically excluded the project from further NEPA analysis on March 12, 2014.
23 CFR 771.117 Categorical exclusions (CEs) are actions which meet the definition contained in 40 CFR 1508.4, and, based on past experience with similar actions, do not involve significant environmental impacts.

Dear Mr; Rose:
Thank you for your correspondence dated January 8, 2014, regarding the proposal to rehabilitate the Natchez Trace Parkway from Mile Post 371 to Mile Post 378 in Wayne, Lawrence, and Lewis counties, Tennessee. The project would involve resurfacing the roadway and parking areas, placement of shoulder material, spot patching and leveling, striping, and other related activities. The Federal Highway Administration (FHWA) requests our concurrence on their project determination of "not likely to adversely affect" (NLAA) for the federally listed spectaclecase (Cumber/andia monodonta), spotfm chub (Erimonax monachus), slackwater darter (Etheostoma boschungi), Tennessee yellow-eyed grass (Xyris tennesseensis), Price's potato-bean (Apios priceana), Indiana bat (Myotis soda/is), the proposed endangered northern long-eared bat (Myotis septentrionalis), and the delisted Eggert's sunflower (Helianthus eggertii). Personnel of the U.S. Fish and Wildlife Service have reviewed the subject proposal and offer the following comments.
Upon review ofthe information provided, we concur with the FHWA's determination ofNLAA for the aforementioned species. We are unaware of any federally listed or proposed species that would be adversely impacted by this project. Therefore, based on the best information available at this time, we believe that the requirements of section 7 of the Endangered Species Act of 1973, as amended, are fulfilled for all species that currently receive federal protection under the Act.
Obligations under section 7 of the Act must be reconsidered if ( 1) new information reveals impacts of the proposed action that may affect listed species or critical habitat in a manner not previously considered, (2) the proposed action is subsequently modified to include activities which were not considered during this consultation, or (3) new species are listed or critical habitat designated that might be affected by the proposed action.

First, always check D0-12, section 3.2, "Process to Follow" in determining whether the action Is categorically excluded from additional NEPA analyses. Other sections within 00-12, including sections 2.9 and 2.10; 3.5;
4.5(G)(4) and (G)(5), and 5.4(F), should also be consulted in determining the appropriate NEPA pathway.
Complete the following tasks: conduct a site visit or ensure that staff is familiar with the site's specifics; consult with affected agencies, and/or tribes; and interested public and complete this environmental screening form.
If your action is described in D0-12 section 3.3, "CEs for Which No Formal Documentation is Necessary," follow the instructions Indicated in that section.
If your action Is not described in D0-12, section 3.3, and IS described is section 3.4, AND you checked YES or identified "data needed to determine" impacts in any block in section D (Mandatory Criteria), this is an Indication that there Is potential for sign ificant impacts to the human environment, therefore, you must prepare an EA or EIS or supply missing information to determine context, duration, and intensity of impacts.
If your action is described in section 3.4 and NO is checked for all boxes in section 0 (Mandatory Criteria), AND there are either no effects or all of the potential effects identified in section C (Resource Effects to Consider) are no more than minor intensity, usually there Is no potential for significant impacts and an EA or EIS Is not required .
