1.3 Nature and Sequence of Construction Activity

Describe the general scope of the work for the project, major phases of construction, etc:

The National Park Service (NPS), in cooperation with the Eastern Federal Lands Highway Division Office of the Federal Highway Administration (FHWA), proposes to repair three damage sites in the Ozark National Scenic Riverways. At the Alley Spring Campground Loop C site (Shannon County), the proposed work will formalize an approximately 180-foot long section of the campground loop road that was temporarily established to replace a section that was lost as a result of the flooding event. The existing loop is one-way, and the lane width is approximately 11-feet wide. At the Waymeyer River Access site (Carter County), the work will consist of relocation of the loop access road and staging lane further away from the bank of the river. A new approximately 24-foot wide section of the loop will be constructed in order to move the easternmost portion of the loop approximately 150 feet from the river. River access would continue to be provided. At the Baptist Access Road site (Dent County), the proposed work will remove the undermined concrete apron wall, stabilize the bank, and reconfigure the access road. The access road and parking areas will be reconfigured in order to move the roadway away from the river yet still maintain river access.

Sequence of Construction:

Phase I Establish Perimeter Controls Prior to any clearing, grubbing, or excavation, construct perimeter controls to ensure that disturbed sediment does not leave the project site. Perimeter controls include silt fence and other specified measures.

Phase II Intermediate Controls Install silt fence in areas as shown.

Apply temporary turf establishment in disturbed areas that will remain exposed for over 14 calendar days within 7 days. Apply permanent turf establishment to the finished slopes according to Section 625.

At the end of each day’s grading operations, shape earthwork to minimize and control erosion from storm runoff.

Provide silt fence around all stockpiled excavated roadway material. Apply temporary turf establishment to stockpiles remaining in place longer than 14 days within 7 days of stockpiling.

Phase III Final Construction / Stabilization After completion of roadway construction, do the following as directed by the CO:

Finish grading and apply permanent turf establishment to any remaining disturbed areas.

Where necessary, replace eroded topsoil and re-apply permanent turf establishment to disturbed areas where vegetation has not established.

Remove all devices used for dewatering.

Remove silt fence only after all upslope areas are stabilized and vegetation is well established.

Remove all other perimeter controls when directed by the CO.

What is the function of the construction activity?

Residential Commercial Industrial Road Construction Linear Utility Other (please specify):

1.4 Soils, Slopes, Vegetation, and Current Drainage Patterns

Soil type(s):

Baptist:

Clarksville very gravelly silt loam, 35 to 50 percent slopes, very stony Kaintuck-Relfe complex, 0 to 2 percent slopes, frequently flooded

Wideman sand, 0 to 3 percent slopes, frequently flooded

The repairs at Baptist would remove the existing concrete apron and outermost portion of the loop while reconstructing the loop road further landward. Slopes and drainage patterns would experience minor changes. Clearing would be required to construct the new loop road and parking configuration. Disturbed and obliterated areas would be re-vegetated.

Alley:

Relfe-Sandbur complex, 0 to 2 percent slopes, frequently flooded, , Hyd Soil Group A

The repairs at Alley will not require any grading; and therefore, there will be no changes to the slopes, drainage patterns or vegetation at the site.

Waymeyer:

Wideman fine sandy loam, 0 to 3 percent slopes, occasionally flooded, Hyd Soil Group A

The repairs at Waymeyer will create a new portion of the loop road further landward of the river.

Grading will be required; however, the new loop road would follow the existing contours to the extent possible. Drainage patterns would experience minor changes. Clearing would be required for the new road segment. Disturbed areas would be revegetated.

1.5 Construction Site Estimates

The following are estimates of the construction site.

Total project area: 1.83 acres Construction site area to be disturbed : 1.83 acres

Runoff coefficient before construction:

Baptist 0.95, Alley 0.35, Waymeyer 0.35 Runoff coefficient after construction Baptist 0.95, Alley 0.95, Waymeyer 0.35

1.6 Receiving Waters

Stormwater runoff will discharge from the project sites as sheetflow.

Description of receiving waters: Current and Jacks Fork Rivers The Current River in Ripley and Shannon Counties is listed as impaired for mercury in fish tissue. There is not TMDL. Jacks Fork River in Shannon County is listed as impaired as a result of fecal coliform. A TMDL was approved in 2004.

1.7 Site Features and Sensitive Areas to be Protected

The project is located within the Ozark National Scenic Riverways; a National Park. Care must be taken to minimize erosion and sedimentation throughout construction.

1.8 Potential Sources of Pollution

Potential sources of sediment to stormwater runoff:

Clearing and grubbing Excavation and grading Vehicle tracking Topsoil stripping and stockpiling To be updated by Contractor.

Potential pollutants and sources, other than sediment, to stormwater runoff:

Staging Areas: storage of construction equipment and materials Construction Activity: obliteration and removal of concrete and asphalt, trash, gasoline and diesel fuel from equipment use and refueling.

To be updated by Contractor.

1.9 Endangered Species Certification

APPENDIX L: Additional Information

From: Deel, Judith To: Landers, Lisa (FHWA) Subject: RE: FHWA Project MO NP OZAR 2013-1(1), SHPO Log 010-MLT-16, Date: Monday, December 07, 2015 3:55:45 PM

Lisa, thank you for the clarification.

The Missouri SHPO concurs that adequate survey had previously been conducted at the Waymeyer River access, and that as all project activities are within previously disturbed roadway at the Alley Spring Campground Loop, there will be “no historic properties affected” and we have no objections to the initiation of project related activities.

At Waymeyer, the study area was previously tested and no cultural material was present. A copy of the memorandum that summarized the testing was provided, and is attached.

At Alley Spring Campground, a Phase I was not done because all of the repair work would be completed within the previously disturbed roadway prism, since for this site we are just paving the existing section of the road that is gravel.

Hi Lisa, Thanks for calling me to discuss these project changes. Based on the description of changes that you've provided, we concur with your determination that the revised project activities may affect, but are not likely to adversely the Ozark Hellbender.

Sincerely, Trisha Crabill U.S. Fish and Wildlife Service Ecological Services 101 Park DeVille Drive, Suite A Columbia, MO 65203 Office: 573-234-2132 x 121 Fax: 573-234-2181

Hi Trisha, We are working to finalize the design for this project and our construction engineer had some concerns about the restrictions at the Baptist Access site. We are concerned about creating unsafe conditions if when removing the concrete apron we leave deep voids along the bank. We would like to propose changing restriction number 4, “No grading will occur below the ordinary high water mark at the Baptist Access Road site.” to the description below:

The existing concrete apron and adjacent roadway would be removed. No grading would occur below the water line present at the time of construction. Grading above the water line, but below the ordinary high water mark elevation would only occur to the extent necessary in order to provide a stable and safe slope. No fill material would be placed below the ordinary high water mark elevation. Grading above the ordinary high water mark elevation would provide a 1:3 slope, extending landward as necessary to create this slope.

These measures, in addition to the best management practices, would minimize sedimentation of the Current River and minimize the potential for adverse effects to the Ozark hellbender (Cryptobranchus alleganiensis bishopi). The proposed modification to the work along the River bank would not change our determination that the proposed action may affect, but is not likely to adversely affect the Ozark hellbender.

Hi Lisa, We received your request for review of the proposed FHWA project No. MO NP OZAR 2013-1(1) on November 12, 2015, as well as additional information you provided in a December 7, 2015 email. The project involves road relocation and repair work at Alley Spring, Waymeyer, and Baptist Access within the Ozark National Scenic Riverways in Shannon, Carter, and Dent counties, Missouri.

According to information you provided in your letter, no suitable habitat is present within the project areas for the eastern prairie fringed orchid (Platanthera leucophaea), running buffalo clover (Trifolium stoloniferum), western prairie fringed orchid (Platanthera praeclara), Virginia sneezeweed (Helenium virginicum), or Hines emerald dragonfly (Somatochlora hineana). Therefore, we do not anticipate effects to these species.

The gray bat (Myotis grisescens), Indiana bat (Myotis sodalis), and northern long-eared bat (Myotis septentrionalis) are all known to occur within the vicinity of the project areas and could be present. However, you stated in your letter that minimal tree will be required (i.e., approximately 10 trees) and that trees will be cleared between November 1 and March 31 in order to avoid impacts to bats. Based on the amount and timing of tree clearing, we concur with your determination that project activities may affect, but are not likely to adversely affect the gray bat, Indiana bat, and northern long-eared bat.

The Ozark Hellbender (Cryptobranchus alleganiensis bishopi) is not known to occur within the immediate vicinity of the project sites. However, the species is known to occur in the Current River and individuals downstream of the project sites could be impacted if excessive sedimentation occurs during project activities. In your letter you stated that the following measures would be implemented in order to avoid impacts to the Ozark Hellbender from sedimentation:

1) The proposed repairs for Alley Spring Campground Loop C have been modified so that no in-stream work will be done;

2) No in-stream work will be conducted at the Waymeyer River Access site;

3) At the Baptist Access Road site, in-stream work will be limited to the extent necessary in order to accomplish project goals;

4) No grading will occur below the ordinary high water mark at the Baptist Access Road site; and

5) No fill material will be placed below the ordinary high water mark at the Baptist Access Road site.

Because Ozark Hellbenders are not known to occur within or near the project area and because the measures identified above will prevent sedimentation at downstream Ozark Hellbender sites, we do not anticipate adverse effects to the species. Therefore, we concur with your determination that project activities may affect, but are not likely to adversely affect the Ozark Hellbender.

No other federally threatened, endangered, proposed, or candidate species or proposed or designated critical habitat are known to occur within the project area.

Thank you for your efforts to conserve threatened and endangered species and please feel free to contact me if you have any questions.

Sincerely, Trisha Crabill U.S. Fish and Wildlife Service Ecological Services 101 Park DeVille Drive, Suite A Columbia, MO 65203 Office: 573-234-2132 x 121 Fax: 573-234-2181
