Phase 2 – Request for Proposals
The short-listed D-B firms/teams will be sent an RFP, which will outline the remainder of the selection process requirements. The RFP will contain the requirements necessary for the short-listed D-B firms/teams to submit both a Technical Proposal and a Price Proposal.
To promote innovation by the Offerors and to maintain flexibility of design and construction, CFLHD will allow submission of Alternate Technical Concepts (ATCs) in Phase 2.
After receipt of the Phase 2 Technical Proposal and Price Proposal, an Evaluation Board will conduct a "best value" analysis. Attachment 5 contains the criteria to be used in the Phase 2 evaluation process. The Evaluation Board will submit their recommendation to the Source Selection Authority. Award of one firm fixed price contract is anticipated.
Each Offeror that submits a technically acceptable, but unsuccessful, Proposal will be entitled to receive payment for work products submitted with its Proposal. A proposal is deemed technically acceptable if it complies with all RFP requirements and contains no deficiencies as defined by FAR 15.001. The amount of the stipend payment will be $50,000 $80,000.00.
Amendment A001 5/5/2016
A-13 flexibility in the procurement process. ATCs are evaluated for approval or denial by CFLHD within the deadline set forth in the Procurement Schedule. In order to be approved, an ATC must be deemed, in CFLHD’s sole discretion, to provide a Project that is “equal or better” on an overall basis than the Project would be without the proposed ATC. Concepts that simply delete scope, lower performance requirements, lower standards, conflict with environmental commitments, or reduce contract requirements are not acceptable as ATCs. CFLHD reserves the right in its sole discretion to reject any ATC. No ATC shall be included in the proposal unless approved by CFLHD in writing prior to the proposal submission deadline.
Proposal Discussions (if deemed necessary) By issuing this RFP, it is the intent of the Government to award this contract without discussions.
Based upon Initial Technical Ratings and Initial Price Proposals, CFLHD will make a decision whether to enter into a contract award or begin discussions with all Offerors within the competitive range. In the event it is not feasible for CFLHD to make award on the basis of the Initial Price and Technical Proposals, discussions with Offerors will be conducted in accordance with FAR 15.306 (d).
Offerors would be provided a reasonable opportunity to submit any price, technical or other revisions to their Proposal that may result from discussions, if they occur. Discussions shall not be used to provide details of other proposals to the Offerors.
Final Proposal Submittal (if deemed necessary) If discussions are held, at the conclusion of discussions, each offeror will be allowed to submit a final proposal at a date to be specified during discussions. All other submittal requirements will be the same as the initial proposal requirements.
Award The Proposal offering the Best Value Project to the Government will be forwarded by the Evaluation Board to the Source Selection Authority (Contracting Officer) for consideration and action. All Offerors submitting Proposals will be notified in writing of the results of the evaluation process.
Offerors not selected for award may request a debriefing as described below.
Stipend Each Offeror that submits a technically acceptable, but unsuccessful, Proposal will be entitled to receive payment for work products submitted with its Proposal. A proposal is deemed technically acceptable if it complies with all RFP requirements and contains no deficiencies as defined by FAR 15.001. CFLHD will provide payment on the terms and conditions described herein. The amount of the stipend payment will be $50,000 $80,000.00.
If award of the design/build contract is made, payment of the stipend will be made within 30 days of receipt of a written invoice for the stipend amount from the unsuccessful Offeror. No stipend will be paid if (i) no technically acceptable Proposals are received, (ii) Proposals are received, but no award is made, or (iii) the procurement is cancelled prior to the Proposal Due Date.
Each Offeror that elects to receive the stipend grants to the Government, and others acting on its behalf, a paid-up, non-exclusive, irrevocable, worldwide license in its proposal to reproduce, prepare derivative works, distribute copies to the public, and perform publicly and display publicly by or on behalf of the Government.
