About this file
This is a Drug-Free Workplace Act Certification Form required by the South Carolina Department of Disabilities and Special Needs (SCDDSN) for the Therap FY23 contract opportunity. The certification applies to any domestic contract for procurement of goods, construction, or services valued at fifty thousand dollars or more from any South Carolina state agency. Bidders must select the appropriate certification statement based on whether they are submitting as a business entity or individual and provide an authorized signature and date.
For business entities, compliance requires publishing a workplace drug prohibition statement to employees, establishing a drug-free awareness program addressing the dangers of drug abuse and available counseling resources, distributing the prohibition statement to all employees performing contract work, requiring employees to notify the employer of any criminal drug convictions within five days, and notifying SCDDSN within ten days of receiving notice of employee convictions. Entities must impose sanctions or require participation in approved drug abuse rehabilitation programs for convicted employees within thirty days of notification. For individual contractors, the certification requires a sworn statement that they will not engage in the unlawful manufacture, distribution, dispensation, possession, or use of controlled substances during contract performance.
