About this file
This is a draft construction contract between the City of New Smyrna Beach, Florida and an awarded contractor for the Finance Office Renovation project (ITB 07-26-FIN). The project encompasses a full renovation of the existing Finance Department located on the second floor of City Hall, designed by Hall & Ogle Architects, Inc. The scope includes nine private offices, two open office spaces with built-in millwork, and an open conference/flex space, along with new finishes such as flooring, drywall, and ceiling tiles, plus new and modified electrical and mechanical systems. The contractor must commence work within ten calendar days after receiving the Notice to Proceed and achieve substantial completion within sixty consecutive calendar days thereafter, with final completion required within an additional thirty consecutive calendar days. Work will be performed in phases to maintain continuity of operations in other City Hall departments, with the contractor responsible for coordinating with the assigned Project Manager to manage temporary access and minimize disruptions.
The contract price is to be determined and filled in upon execution, with payment made in accordance with the awarded bid proposal. All change orders, including additions and deductions, require written approval from the Owner, and any material deviations from the proposed design shall be borne by the contractor unless previously agreed to in writing. Liquidated damages are assessed at two hundred fifty dollars per consecutive calendar day for work not completed within the specified timeframe. The contractor must provide a Certificate of Insurance and Performance/Payment Bond within fourteen days of bid acceptance, and deliver a Warranty of Title upon project completion. The contract includes standard provisions regarding force majeure events, with the notable exception that pandemics and epidemics, including COVID-19 and related government orders, are expressly excluded from force majeure protection and do not excuse the contractor's performance obligations.
