About this file

This justification document outlines a planned sole source acquisition by the Department of the Navy Naval Facilities Engineering Command for Trimble R12i surveying equipment from Trimble Inc. Key details include:

The agency requires the Trimble R12i GPS receiver and rover model as a compatible upgrade to replace obsolete Trimble R8 antennas currently used for land surveying. Using the Trimble equipment maintains compatibility with the agency's existing integrated surveying system consisting of a Trimble robotic total station, two Trimble GPS antennas, Trimble data collectors, radio antennas, and software purchased in 2010. A full system replacement from another manufacturer would be overly costly, require new training and approvals, and not maximize the useful life of compatible equipment already in use for over 11 years. Therefore, limiting competition to Trimble is justified as the only brand that can meet requirements and avoid a costly work stoppage from incompatible equipment. The planned solicitation is for the Trimble R12i under solicitation number N4008023Q8500.

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN

ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

The Trimble R12i offers unmatched Global Navigation Satellite System (GNSS) performance, speed and accuracy to increase productivity and it is fully compatible to our current Trimble surveying unit. With improved performance in challenging GNSS conditions and robust Inertial Measurement Unit (IMU) based tilt compensation this will allow more work to be completed in less time and more accurately. NAVFACSYSCOM Washington Real Estate Business Line (REBL) Cadastral Department currently has the Trimble R8 model, which is over 11 years old and has been discontinued. This model is no longer serviced and supported by Trimble.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING:

A. ___ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. ___ OTHER REASONS.

B. _ X_ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. Trimble R12i , base and rover model is the only brand name source that is compatible with our current equipment (S6 Trimble Robotic Total Station, Trimble R8 GPS Antenna (quantity 2), Trimble TSC7 Data Collector, Trimble Radio Antennas, Trimble Business Center Software, and Trimble TSC3 Data Collector). The longevity of our equipment usage is estimated to be for eleven (11) more years. This estimation is due to taking care of the equipment, necessary software updates, regular service and maintenance. This estimation could change, if the manufacturer phases out our current equipment from their product line. On March 15, 2023, we were made aware that parts of Trimble R8 antenna that we were using to conduct land surveying had become obsolete.

Trimble had discontinued their warranty service and technical support on Trimble R8 antennas. Therefore, to continue land surveying work an upgrade to the R8 antenna and associated parts is required. Without an upgrade, work stoppage is eminent. To avoid work stoppage, NAVFACSYSCOM Washington can either purchase brand new GIS equipment from any manufacturer that can meet our specifications or replace/ upgrade the parts that have become obsolete from Trimble. The cost to purchase brand new surveying equipment would be burdensome, not cost efficient, and would not be compatible with current equipment the Navy REBL Enterprise is using. If the Government, were to purchase new equipment, at a minimum they would have to repurchase a new robotic total station, two GPS antennas, data collector, radio antennas, software, and a data collector. In 2010, when the Government first purchased the Integrated Surveying System by Trimble (S6 Trimble Robotic Total Station, Trimble R8 GPS Antenna (Qty 2), Trimble TSC7 Data Collector, Trimble Radio Antennas, Trimble Business Center Software, and Trimble TSC3 Data Collector), the cost was $ In today’s current atmosphere, this equipment would now severely be more expensive, would require new training, and may also require validation and approval from the DoD if a new vendor is chosen. Furthermore, if all new equipment were purchased this was would not be a good use of taxpayer funding, when the Government has current equipment that is meeting the mission requirements. The best choice for the mission and economic choice is to purchase the Trimble R12i. The cost to replace/upgrade the obsolete Trimble parts is approximately . Therefore, at this time we would like to proceed with the latter. The replacement /upgrade can only be done with Trimble and not with any other manufacturer brands.

C. __UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.

Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

IV. CERTIFICATIONS/APPROVALS:

Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.

I certify that this Justification is accurate and complete to the best of my knowledge and belief.
