52.212-1 INSTRUCTION TO OFFERORS

ILAB-OCFT Governmental Auditing and Attestation Services
A. General Information and Instructions:
1. FAR 52.216-1 - Type of Contract (Apr 1984) (As prescribed in FAR 16.105) The Government contemplates award of one Firm-Fixed Priced purchase order to result from this solicitation based on fixed labor categories/rates and 1500 not-to-exceed (NTE) labor hours each performance year.
2. This acquisition is being made pursuant to FAR Part 12, Commercial Item, and FAR 13, Simplified Acquisition Procedures.
3. The evaluation process will utilize best value source selection procedures in making the award, which made result in the decision to award based on other than lowest price.
4. The Government intends to award without discussions. However, the Government may hold discussions with offerors if deemed necessary to do.
5. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide supporting rationale.
6. The response shall consist of three (3) separate parts; Part I - Price Proposal, Part II - Technical Proposal, and Part III - Past Performance Information.
7. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price. If only one response is received, the Contracting Officer will utilize procedures in FAR 13.106-3 in establishing reasonableness of price, and may request information other than cost or pricing data if determined necessary to make this determination.
8. Submit the completed Labor Rate Matrix (Attachment 1) with offers.
9. Complete and submit the attached Representations and Certifications (Attachment 6) or a copy of the on-line Representations and Certifications Application (ORCA) record.

10. Complete fill-ins at FAR clause 52.209-5 -Certification Regarding Responsibility Matters (Apr 2010) and return with Reps & Certs or ORCA record, as applicable.
B. Specific Instructions:
1. Proposal Submission: Submit one original paper copy plus three (3) virus-free CD copies of entire proposal volume(s). Ensure proprietary information is clearly identified and marked.
Information on the original and CD must be exactly same as the original versions. In the event of a discrepancy, the original version of each volume takes precedence over electronic copies.
2. Part II - Past Performance Information: Complete Part I of the Past Performance Information/Questionnaire (Attachment 4) for each contract reference provided with submission of Part II, Performance Information. Include an attachment, not-to-exceed one (1) page describing the services performed. Performance information is limited to three (3) pages per contract reference. The questionnaire page constitutes one page and the description page constitutes the second page. Offerors may submit additional performance information as long as it does not exceed the page limit.
3. Submission of offers: Offerors shall submit responses in English and in U.S. dollars.
Offerors are required to acknowledge receipt of any and all amendments issued under this solicitation that failure to do so may result in the determination of non-responsiveness.
Amendments should be acknowledged by signature on the applicable SF1449. Offers are to be submitted to the following address not later than the date and time specified in block 8 of the SF1449:

Hand carried proposals will be accepted and shall be addressed and delivered to the person identified above. The Offeror shall contact 202-693-4570 upon arrival at DOL. The package used to submit your proposal must show the time and date specified for receipt, the Solicitation Number, and the name and address of the offeror.
Offerors are cautioned that the U.S. Department of Labor, Francis Perkins Building has visitor control procedures requiring individuals not affiliated with the building to obtain a visitor pass prior to entrance. SOME DELAY SHOULD BE ANTICIPATED WHEN HANDCARRYING PROPOSALS. Offerors should allow sufficient time to obtain a visitor pass, if necessary, and arrive at the Department of Labor PRIOR to the time specified for receipt. Late proposals will be processed in accordance with FAR 52.212-1(f) “Late submission, modifications, revisions, and withdrawals of offers.”
4. Period for acceptance of Offers: The offeror agrees to hold the prices in its quote firm for 60 calendar days from the RFP response due date, unless another time period is specified in an addendum to the solicitation.
5. No contact shall be made to the Program Office regarding this solicitation. Submit all questions regarding this RFP not later 3:00 PM EST, 29 July 2011 to the following:

PART I - PRICE PROPOSAL (No page limit)
1. Complete SF1449 blocks 12, 17A, 17b (if applicable), 23 and 24 (see Section B.1 Price Schedule), and 30 through 30c. In doing so, the offeror accedes to the contract terms and conditions as written in the Solicitation. At time of award, solicitation provisions 52.212-1, Instructions, 52.212-2, Evaluations, and 52.212-3 will be physically removed.
2. Complete the Labor Rate Matrix (Attachment 1), inserting labor categories and fully-burdened labor rates for the basic and all option years.
3. Complete the necessary fill-ins and certifications in Attachment 6, Representations and Certifications or submit a copy of the Online Representations and Certifications Application (ORCA) record.
4. If applicable, provide a copy of the letter from the Small Business Administration (SBA) showing proof of Section 8(a) status.
PART II –TECHNICAL PROPOSAL
1. Limited to no more than twenty (20) pages. Page limits do not include table of content, resumes, Quality Control Plan, single title pages and/or executive summaries. No elaborate graphics are required or desired.
2. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the solicitation and whether the offeror’s methods and approach to meeting the solicitation requirements provide the Government with a high level of confidence of successful completion within the required schedule.
Subfactor 1 -–Experience - The Government will evaluate work experience submitted by the offeror of a similar nature, scope, complexity, and difficulty to that which will be performed under the prospective contract contemplated by this solicitation. In addressing this sub-factor, the proposal must:
1. Describe your experience with attestation engagements and audits of international Non- Governmental Organizations (NGOs) and international organizations.
2. Describe your experience conducing training related to attestation engagements and audits of NGOs and international organizations.
3. Describe your experience related to audit resolution of attestation engagements and audits.
4. Describe your experience with Government Performance and Results Act (GPRA) reporting.
Subfactor 2 -–Understanding the Requirement– The Government will evaluate the offeror’s understanding of the work to be performed in accordance with the Performance Work Statement (PWS). In addressing this sub-factor, the proposal must:
1. Submit a proposal that demonstrates its understanding of the work described in Section
1.2 of the PWS. The proposal shall be written in English.
2. Demonstrate thorough understanding of the following:
The attestation engagement process that meets U.S. Government Auditing Standards as established in the GAO Yellow Book;
The requirements needed in developing an accountability review program; and
The reporting requirements under the Government Performance and Results Act
(GPRA).
Subfactor 3 -–Key Personnel–The Government will evaluate the experience and qualifications of all contractor personnel.
The offeror’s proposal shall include curriculum vitae (CV)/Resumes for key personnel. CVs shall provide sufficient information for judging the quality and competence of proposed personnel, including experience and credentials.
Subfactor 4 –Quality Control Plan–The Government will evaluate the Quality Control Plan (QCP) that details how the Offeror intends to monitor, inspect, and correct deficiencies for the requirements of the PWS.
PART III - PAST PERFORMANCE INFORMATION
1. Limited to no more than three (3) pages per contract listed. Only references for same or similar type contract desired.
2. Quality and Satisfaction Rating for Contracts Completed in the Past Three Years (3):
Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.
3. Performance Surveys: The Government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this RFP. The Government will use information submitted by the offeror and other sources such as other Federal government offices and commercial sources, to assess performance. Provide a list of no more than three (3) of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years. Relevant contracts include performance of efforts that are similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. The Offeror is responsible for ensuring that all contract data and contact information furnished is accurate and up-to-date. Furnish the following information for each contract listed:

4. If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts.
5. Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consent to the release of their past performance information to the prime contractor.
C. Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
Requirements of the RFP (CLINs & PWS) and Government standards and regulations pertaining to the PWS.
Evaluation Factors for award in provision FAR 52.212-2.
Any limitation on the number of proposal pages. The Government reserves the right not to read, evaluate and/or to remove any pages exceeding the page limitations set forth above in this 52.212-1 Instruction.
D. Format for proposal Parts II and III shall be as follows:
The proposals will be 8 1/2” x 11” paper except for fold-outs used for charts, tables, or diagrams, which may not exceed 11” x 17”.
A page is defined as one face of a sheet of paper containing information.
Typing shall not be less than 11 pitch and no more than 12 pitch.
Elaborate formats, bindings or color presentations are not desired or required.
