18. Contractor Personnel Selection, Work Hours and Work Assignments
Contractor personnel are expected to be at the government site during normal business hours Monday through Friday. This requirement is a precondition for any labor-hour time to be billable to the government. Time spent at the government site outside of these hours shall not be considered billable. Time sheets shall clearly distinguish between time spent on-site and billable to the government and time not billable to the government.
The following applies to the contractor work assignments:
Contractor personnel failing to meet the skill and/or educational levels necessary for contract performance shall be removed by the contractor or upon notification by the Government.
Contractor personnel must maintain appropriate, professional behavior and suitable attire.
Contractor personnel shall be removed for any valid reason following written notification from the Government.
Individuals proposed by the contractor for employment on this contract must first pass a National Agency Check Investigation (NACI) that establishes their suitability to work in this position within DOL. Documentation of this background investigation must be provided to the DOL agency prior to commencement of employment of the individual. Any NACI done within the two (2) years proceeding employment for DOL will be considered valid.
The contractor shall fill all staff vacancies so as to preclude impact to contract work. If any vacancy exists for more than five (5) days, the contractor shall notify the Government with an assessment of what impact may occur due to the contractor’s failure to fill the staff vacancies.
Due to the potential subject matter, all individuals provided by the contractor shall be either U.S. citizens or legal U.S. residents.
19. Privacy Act Notice.
Work on this contract does not require that personnel have access to Privacy Information. Personnel shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations.
20. Section 508 Requirements (If, applicable)
If applicable, the contractor shall be required to operate under reasonable accommodations for special needs employees pursuant to recent legislation. The DOL agency shall be responsible for procuring any necessary equipment and software needed for special needs employees utilized by the contractor. http://www.section508.gov/
21. Government Responsibilities The Government shall provide on-site Contractor personnel with necessary facilities to perform all work. The Government shall furnish all expendable materials and supplies.
The Government shall furnish each individual assigned to this contract proper identification to facilitate ingress/egress to and from Government or Public Buildings.
22. Confidentiality Requirements
The Contractor agrees to keep in confidence the information contained in all media used in the performance of the work provided for in this contract. The Contractor agrees not to disclose such information orally, in writing, or in any other form, in whole or in part, to any person or organization other than those authorized employees for the Contractor or to another contractor working for DOL on the same project needing such information to perform required work.
23. Quality Assurance Surveillance Plan
The Quality Assurance Surveillance Plan is the means by which the Government will monitor the quality of contract performance, as well as providing for official inspection and acceptance for payment purposes. The intention of the plan is to rely upon the professional performance of duties by the contractor’s personnel to assure adequate performance, with only occasional need by the Government to conduct actual inspections of work performed. The extent to which this intention will be carried out as contract performance proceeds will depend upon the attention the contractor pays to quality contract performance.
The contractor’s duties are outlined in the performance-based work statement, and the performance requirements summary. The contractor shall select personnel capable of performance with only very minimal supervision needed by the contractor’s corporate staff and relatively little oversight required by the Government. Contract success will be achieved by selection of personnel who are capable of evaluating and following effective Government suggestions for improved performance, while at the same time being capable of independent decision making and performance with relatively little day-to-day oversight on the part of the Government. Contractor personnel shall have adequate professional education and prior training/work experience to meet the contract performance requirements.
Government random inspection, day-to-day contact, and review of formal reports shall be the principal means of direct inspection of performance. The emphasis in this project is on prevention of unsatisfactory performance rather than the corrective actions which would occur after unsatisfactory performance is found. Given that this is a labor intensive contract with relatively few, highly-skilled individuals, the principal means of corrective action will be removal of personnel who have not performed satisfactorily and their replacement with personnel who are anticipated to perform satisfactorily. If this happens, and if this type of replacement can be made without serious impact to performance schedules, no monthly payment penalties are anticipated. However, if performance is seriously impacted, a monthly payment penalty may, at the Government’s discretion, be applied in accordance with the Performance Requirements Summary standard.
24. Overtime
In the event it becomes necessary to utilize overtime, it shall be negotiated and approved in writing by the COTR and Contracting Officer prior to approval.
25. Government Holidays
The contractor must establish a standard holiday schedule that exactly coincides with the
Government's schedule. Holidays and other non-work days peculiar to or dynamically declared by the
Government shall be considered as holidays for contractor personnel and are not billable unless work is actually requested by the Government and performed on these days. The following is a list of
Government holidays:

There are certain types of irregularly occurring circumstances which may prompt the Government to close the offices where contractor personnel are working, either on a national or a local basis. Examples of such situations are: Presidential Inauguration Day (in Washington, DC); inclement weather emergencies; etc. When such situations occur and result in the involuntary loss of potential hours by contractor personnel, those hours shall be declared holidays for contractor personnel. The contractor may bill the Government for such specifically declared holiday hours that would have worked.
