About this file

This is an Invitation to Bid (ITB) issued by The University of Texas at Austin on behalf of Applied Research Laboratories (ARL) for the design, fabrication, testing, and delivery of a custom hydraulic power unit (HPU) with remote pendant control. The HPU will power a Pullmaster M25-7-86-4 hydraulic tugger equipped with automatic brake and external brake circulation cooling flow for use in a harsh offshore marine environment. One complete HPU assembly is required. The solicitation opened October 14, 2026, at 11:00 AM CDT, with questions due by October 21, 2026, at 5:00 PM CDT. Bids are due by October 29, 2026, at 2:30 PM CDT via the University's electronic procurement portal. The University's desired delivery date is on or before January 18, 2027. The resulting purchase order will be effective from the date of issuance through August 31, 2027. Award will be made on a best value basis considering purchase price, vendor reputation, quality, specification compliance, past relationships, support for historically underutilized businesses and persons with disabilities, total long-term cost, and other relevant factors.

Pricing must be firm, fixed, and all-inclusive of design, fabrication, testing, delivery, freight, insurance, and all other costs. Bidders must provide detailed pricing breakdowns and disclose any additional fees upfront. The University offers standard net 30-day payment terms per the Texas Prompt Payment Act and prefers payment through the JP Morgan Chase Single Use Account program. All bids must remain valid for a minimum of 120 days following the submittal deadline. Bidders must submit a signed Subcontracting Plan demonstrating commitment to utilizing Veteran Heroes United in Business (VetHUB) subcontractors, as subcontracting opportunities are probable. Each bidder must certify compliance with Texas Governor Executive Order GA-48 regarding foreign ownership and control restrictions. Bidders must also provide a complete technical documentation manual, Factory Acceptance Test results, and a minimum one-year warranty beginning at equipment acceptance. Electronic submission through the Bonfire portal is the sole acceptable submission method, with a maximum file upload size of 1000 MB.

4. General Information

4.1 Scope and Minimum Requirements

Minimum requirements and specifications for Goods/Services, as well as certain requests for information to be provided by Bidder as part of the bid, are set forth below. The successful Bidder is referred to as the “Contractor.”

4.2 Compliance with Terms and Conditions

Bidder agrees to comply with all conditions shown on this form and University Terms and Conditions.

4.3 Evaluation

University will award the ITB based on best value criteria. University reserves the right, at its sole discretion, to determine whether the bid meets specifications.

4.4 Contract Term

University intends to issue a purchase order ("PO") to Contractor to provide the Goods. The PO will be in effect as of the date of issuance, through August 31, 2027.

4.5 Termination Rights and No Minimum Work Guarantee

University may terminate this Contract, without cause, upon 30 days written notice to Contractor. University does not guarantee that Contractor will receive any specific amount of work under the Purchase Order.

4.6 Bidder Qualifications and Right of Rejection

University reserves the right to reject any bid if the Bidder fails to satisfactorily convince the University that the Bidder is properly qualified by experience and/or facilities to carry out the obligation of the agreement and to satisfactorily complete all the agreement requirements.

4.7 Group Purchasing Authority

Texas law authorizes institutions of higher education (defined by §61.003, Education Code) to use the group purchasing procurement method (ref. §§51.9335, 73.115, and 74.008, Education Code). Additional Texas institutions of higher education may therefore elect to enter into a contract with the successful Bidder under this ITB. In particular, Bidder should note that University is part of The University of Texas System (UT System), which is comprised of fourteen institutions described at http://www.utsystem.edu/institutions. UT System institutions routinely evaluate whether a contract resulting from a procurement conducted by one of the institutions might be suitable for use by another, and if so, this ITB could give rise to additional purchase volumes. As a result, in submitting its bid, Bidder should consider proposing a pricing model and other commercial terms that take into account the higher volumes and other expanded opportunities that could result from the eventual inclusion of other institutions in the purchase contemplated by this ITB. Any purchases made by other institutions based on this ITB will be the sole responsibility of those institutions.

4.9 Criminal Background Checks

Each individual assigned to perform Services under the Agreement will be an employee of the Contractor or an employee of a permitted subcontractor engaged by the Contractor. Contractor will be responsible for the performance of all individuals performing the Services. Prior to commencing performance of Services, Contractor will conduct an appropriate criminal background screening on all such individuals and will not knowingly assign any individual to provide Services who have history of criminal conduct unacceptable for a University campus including violent or sexual offenses.

https://policies.utexas.edu/policies/criminal-background-checks
