Infrastructure, Development, and Engineering (IDE) Contract Additional Industry Questions A. Organizational Conflict of Interest:
Q1: Draft RFP pages 30-32; 5352.209-9002 Organizational Conflict of Interest (AFMC) clauses as tailored for this acquisition contain the following statement. “To avoid the prospect of the Contractor's judgment or recommendations being influenced by its own products or capabilities, it is agreed that the Contractor is precluded for the life of the system from award of a DoD contract to supply the system or any of its major components, and from acting as a subcontractor or consultant to a DoD supplier for the system or any of its major components.” Does this mean that the successful offeror on the DMOC IDE contract is precluded from the award of a DoD contract to supply equipment items, simulators, simulations, models, databases or other elements that are integrated into the DMOC infrastructure as a major component? If so, does this restriction extend to equipment items, simulators, simulations, models, databases or other elements that may be included in a Virtual Flag, Warfighter Focused Event or as a topic of a Studies and Analysis task? Is it possible for this exclusion to be successfully mitigated through an OCI Mitigation Plan?
A1: Refer to OCI AFFARS Clause 5352.209-9000 and its alternates, AFFARS Clause 5352.209-9001 and Clause H102 when addressing possible OCI concerns and considerations. The intent of these clauses is to protect against a contractor developing, performing and evaluating the same requirement within the DMOC facility. The provider of the item(s) will not be able to perform technical direction, evaluation or systems engineering on these same item(s). Whether or not this can be mitigated must be addressed by the offeror in its proposal, in conjunction with providing a complete Mitigation Plan, which will be evaluated as a component of the offeror's proposal. In addition, we suggest you check the contracts that are currently awarded to your company for any potential restrictions or further OCI issues that would require addressing in a Mitigation Plan.
B: Small Business Q2: Based on this table the Small Business goal for FY11 is 31.7%, is 31.7% the minimum percentage requirement for a proposal to be considered acceptable?
A2: Yes, 31.7% is the minimum requirement.
Q3: As the OSD Small Business goals for FY12 and beyond are published, will the prime be required to submit an updated small business plan reflecting those goals?
A3: Offerors will be required to submit plans that reflect those OSD goals established the year in which proposals are due. Updates are not required.
Q4: What is the Contracting Office plan or policy for enforcement of the small business participation?
A4: The ability of the contractor to meet small business goals will be documented within the annual CPARs assessment performed by the program office. The contract will also include FAR Clause 52.219-16 Liquidated Damages -- Subcontracting Plan
Q5: DCMA has been giving verbal direction to all primes that any procurement issued to a Historically Black College or University and minority institutions as of 10-1-10 must be considered Large. Section M, sub factor 1.2.6 includes HBCU as a small business category which is in conflict with DCMA direction to all primes. Please clarify.
A5: There has been no change in policy. Please refer to http://www.acq.osd.mil/osbp/statistics/goals.htm website. There is a possibility that HBCU/MI might be included when developing the subcontracting goals for Small Disadvantaged Business as this item is currently under Government review. If a legal ruling, that changes this guidance, is published prior to 15 Apr 11, our RFP may be updated to accommodate such change in policy.
C. Other:
Q6: As there are numerous references to the 705th CTS specific processes and procedures in Section 3 of the SOW, how will this information be made available to all offerors? If the Government is not planning to make these available, how will the incumbent’s advantage be neutralized?
A6: The 705 CTS is planning to set aside a technical library within their facility for all interested offerors. The information cannot be published externally. The Section L within the formal RFP shall provide instructions regarding location and access to the technical library.
