ADDENDUM TO FAR CLAUSE 52.212-1, INSTRUCTIONS TO OFFERORS --

COMMERCIAL ITEMS

The terms and conditions for the following provisions are hereby incorporated into this solicitation as an addendum to FAR provisions 52.212-1

Provisions by Full Text:

Tailoring

In accordance with FAR 12.302(a), the provision at 52.212-1 is hereby tailored to modify the following elements of the provision.

At paragraph (e) “Multiple Offers,” this paragraph is deleted in its entirety as it has been determined to be not applicable to this solicitation.

At paragraph (h) “Multiple Awards,” this paragraph is deleted in its entirety as it has been determined to be not applicable to this solicitation.

At paragraph (i) “Availability of requirements documents cited in the solicitation,” this paragraph is deleted in its entirety as it has been determined to be not applicable to this solicitation.

The Government contemplates award of a Firm Fixed Price type contract issued as a 100% small business set-aside and is restrictive to small businesses. The expected award shall consist of one base period of performance, October 1, 2013 through 31 December 2013.

To receive consideration for award, offerors shall submit their offers along with adequate documentation that supports the factors listed below, Documentation shall demonstrate a clear understanding of and the ability to accomplish the requirements stated in the Statement of Work (SOW). The following information is provided to potential offerors as part of the solicitation.

Proposals are due 19 September 2013 at 2:00 pm (CST). Failure to provide timely responses will exclude your proposal from consideration. Offerors shall adhere to page limitation stipulated for each factor. Pages in excess of the stated limitations will not be forwarded to the evaluation team for review and could possibly impact overall ratings received.

Volumes: The offeror’s proposal shall consist of three volumes. The volumes are:

1. Technical Capabilities

2. Past Performance

3. Price

Offers should contain all information the offeror deems necessary to (1) support an accurate evaluation of its proposal under the evaluation factors identified in this solicitation; (2) demonstrate the offeror’s compliance with all requirements contained in the solicitation; and (3) establish the reasonableness of the offeror’s proposed pricing.

No information or questions concerning this Request for Quotel (RFQ) or requests for clarifications will be provided in response to telephone calls from prospective offerors.

Formal communications such as requests for clarification and/or information questions concerning this RFQ should be in writing and emailed to the following:

Written inquires will be answered in writing via amendment, however, because of the response time, no such inquires will be considered if received after September 12, 2013 at 2:00 pm (CST).

Factor 1: Technical Capabilities, Volume I This volume shall not exceed 10 pages. The offeror’s proposed approach shall include adequate documentation to clearly demonstrate a thorough understanding of the SOW requirements.

Offerors shall describe in sufficient detail their proposed resources and technical capability to meet the requirements outlined in the SOW. Offeror shall describe its proposed quality control measures in sufficient detail to demonstrate that established procedures would, at a minimum, adequately recognize substandard performance, document corrective actions, etc.

Factor 2: Past Performance, Volume II The Past Performance data shall not exceed 2 pages for each contract referenced. Each offeror is requested to submit information on all contracts (either Government or commercial) within the past

(3) three years from the issuance of the RFQ to substantiate its past performance. The Offeror shall provide demonstrated experience in work effort similar in size, scope, magnitude, complexity to the requirements outlined in the SOW. The past performance data shall include information on contracts on which the offeror, or any proposed subcontractor has performed as a prime contractor or subcontractor. The Offeror shall include the following on each contract referenced in its proposal:

1. Contract statistical information:

a) Names and address of Contracting Activity

b) Contract Number

c) Contract Type

d) Place of Performance

e) Date of contract and period of performance

f) Total Contract Value; include initial cost, actual invoiced cost, rationale for difference in initial and actual cost (contract modified total amount), available and actual amount of fee awarded

g) Contracting Officer’s name, telephone number and email address

h) Contracting Officer’s Representative (COR) Name and telephone number, and email address

i) Administrative Contracting Officer, if different from (h), Name, telephone number and email address of Contracting Officer

j) List of Major Subcontractors

2. The Offeror shall include a description of the projects cited to demonstrate relevance to the requirements outlined in the SOW. The offeror shall also identify and state the reasons for any terminations, cure notices or failure to exercise an option period.

3. The offeror may describe any quality awards or certifications that indicate the offeror possesses a high-quality process for developing and producing the product or service required.

Offerors shall provide a copy of the Past Performance Questionnaire to their references and ensure the references return the questionnaire directly to the Government before the RFP closing date on 19 September 2013 at 2:00 pm (CST). Questionnaires shall be emailed to Victor.J.Stamps@usdoj.gov or fax to 816-467-1986. Questionnaires shall be returned to the point of contact identified on the form within the time frame allotted.

Factor 3: Price, Volume III The Offeror will submit a proposal with a total amount for all services. Total amounts shall be entered in the proposed CLIN structure provided. Offerors may propose an alternate CLIN structure, but must include total contract price. For the purposes of submitting proposals, Offerors shall mark all pages containing costing data as “Proprietary.”

Submission of Quotes

Sealed Quotes shall be submitted on or before the Quote deadline specified in Block 8 of the Standard Form 1449, page 1 of the solicitation. Quotes shall be submitted to the following address:

Quotes received after the quote deadline will be processed pursuant to FAR 52.212-1(f).

Each quoter shall complete and submit the following forms, clauses and statements with his/her quote. Failure to do so could result in the elimination of your offer from further consideration:

1. Standard Form 1449

2. Schedule of Items/Contract Pricing

3. Offeror’s Representations and Certifications

All potential Offerors are advised that this solicitation includes the clause FAR 52.212-4 (June 2013) for Commercial Items, paragraph (t) Central Contractor Registration (CCR). The clause requires all contractors doing business with the Federal Government, after September 30, 2003, to be registered in the CCR database. Quoters should include their Data Universal Number System (DUNS) number in their offers. The Contracting Officer will verify registration in the CCR database prior to award by entering the potential awardee’s DUNS number into the CCR database. Failure to complete the registration procedures outlined in this clause may result in elimination from consideration for award.

Award Methodology

The government intends to make a single award to the responsive/responsible quoter, having acceptable past performance, submitting the lowest price technically acceptable quote.

Freedom of Information Act Notice

The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contract proposals submitted to Federal agencies. If an offeror’s proposal contains information that he/she believes should be withheld from such requestors, under FOIA, on grounds that it is “trade secrets and commercial or financial information obtained from a person and privileged or confidential” [(b)(4) of the FOIA], the quoter should identify all such information so that if the proposal is ever the subject of a FOIA request, the decision to disclose or withhold can be made promptly by the responsible Federal Official. If the quoter considers parts of the proposal withholdable under FOIA, the following notice should be place on the title page:

“Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets of commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act. Material considered privileged or Confidential on such grounds is contained on pages _______.”

The quoter should mark each individual item considered privileged or confidential under the FOIA with the following notice:

“The data or information is considered confidential or privileged, And not subject to mandatory disclosure under the FOIA”

All information in the offeror’s proposal which is not designed may be subject to automatic public disclosure, if it is requested under FOIA. It must be emphasized that under FOIA no information is automatically exempt from public disclosure. However, no disclosure under FOIA will be made without a careful and exacting evaluation, giving due regard to the need for safeguarding material considered by the submitter to be privileged or confidential.

The Department of Justice’s policy is to withhold, whenever possible, material that is genuinely privileged or confidential.

Type of Contract

The Government contemplates award of an indefinite delivery/requirements type contract with firm fixed unit prices resulting from this solicitation. A single award will result from this solicitation with an effective date of award of October 01, 2013.
