About this file

This is a Purchase Determination document from the Arizona Department of Public Safety (AZDPS) dated 11/28/2022, involving evidentiary tow contracts. The document was developed in coordination with the Arizona Attorney General's Office, State Procurement Office, AZDPS legal counsel, and the AZDPS legislative liaison. It pertains to a statewide towing agreement process that was initiated in FY18 to replace the previous competitive bidding method for citizen towing services.

The contract allows any tow firm to apply for a Tow Service Certification Agreement (TSA) to provide evidence towing services for AZDPS. District Commanders will determine the capacity and tow class needs for their specific districts. The agreements are designed to enable tow companies to continue to a scene and complete a tow if contraband or evidence is discovered, preventing resource waste and reducing road clearance times. Tow drop-off locations will be determined by AZDPS, typically at the department's evidence yard. Importantly, no public money is spent on these tows, as charges are paid by private individuals or their insurance companies. Any TSA holder can be decertified if they do not comply with the agreement terms.

Purchase Determination

To: File Date: 11/28/2022

Subject: Extending Evidentiary contracts

Contract: Tow Evidence contracts

Supplier: All agreement holders that are issued evidentiary contracts

In FY18, a decision was made to eliminate the competitive process for statewide citizen towing and move to agreements, which is interpreted as possible per towing statute ARS 41-1830.51.

Not only did the competitive process restrict providers and AZDPS from making timely changes but could also result is varied rates across the state, leaving citizen charges dependent on which tow company serviced the call. In addition, there is no public money spent on citizen tows as these charges are paid by the private person or their insurance company.

DPS procurement worked and gained agreement with the Attorney General’s Office (Rex

Noland), State Procurement Office (Terri Johnson), Arizona Department of Public Safety (DPS) legal counsel (Anny Foster), and DPS legislative liaison (Courtney Coolidge) to move forward with towing agreements with the tow firms through certification to tow for AZDPS. Any tow firm wishing to tow for AZDPS may apply and be granted certification. It is then up to the

District Commanders at AZDPS to determine capacity and tow class needs for their District.

Per Competition Impracticable 18-002, the business process in the field justifies issuing an evidentiary tow contract to each Tow Service Certification Agreement (TSA) holder. If a tow truck is called and in route to the scene, and the DPS trooper finds contraband or other items that would move the citizen tow to an evidence tow, the tow company must be able to continue to the scene and tow the vehicle to prevent the waste of resources and reduce road clearance times. For evidence tows, the DPS will determine the tow drop off location, generally the DPS evidence yard.

Any TSA holder that is decertified from the TSA or willfully disengages from the TSA will no longer have a valid evidentiary tow contract.
