52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [] will, [] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

(a) Definitions. As used in this clause--

Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered foreign country means The People's Republic of China.

Covered telecommunications equipment or services means--

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means--

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:

(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from ______________________. PERFORMANCE WORK STATEMENT

75th Ranger Regiment, Military Intelligence Battalion, Cyber Electromagnetic Activities Company

Part 1

GENERAL INFORMATION

1. OVERVIEW: The 75th Ranger Regiment’s Task Force Training events serve as BN-level evaluations of its subordinate organizations’ mission readiness. The 75th Ranger Regiment – Military Intelligence Battalion (RMIB) participates in the 75th Ranger Regiment – Special Troops Battalion’s (RSTB) Task Force Training event every other fiscal year. In each Task Force Training event, multiple military intelligence and reconnaissance disciplines are tested in a single, over-arching scenario. Due to the size and scope of these events, the Regiment requires outside support for scenario development and creation of “OPFOR” materials. This Performance Work Statement (PWS) covers this outside support. This external support will occur prior to the events at various planning milestones, and during the events overseeing the integration of the materials prepared for them. The core scenario and OPFOR structure for RSTB’s Task Force Training Event is being developed independently by G27 Contracting; further inputs to RSTB’s Task Force Training event scenario will need to be overlaid onto their existing materials during RSTB’s FY21 Task Force Training event. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide SIGINT training-related services in order to support RSTB’s FY21 Task Force Training event. Services for RSTB’s Task Force Training event shall include a pre-event site survey of select signals, providing basic communications equipment for the OPFOR, scripting of SIGINT-related documents and communications to match G27’s OPFOR scenario, and in-person training support for script adjustment and exercise oversight. The Contractor shall perform in accordance with (IAW) the terms and conditions of the contract and consistently with the established standards in this PWS and contract.

1.2 Background: RSTB’s FY21 Task Force Training event prepares Rangers of the Cyber Electromagnetic Activities Company (CEMA) to accomplish their deployed missions and determine suitability for attendance to other advanced training exercises. Training will take place across Fort Pendleton, VA, JEB Little Creek – Fort Story, VA, and Norfolk, VA between 25 January and 12 February 2021. Six Cyber and SIGINT Rangers will participate in the training. Training objectives will include the prosecution of Mode 0, Mode 3, and Mode 6 technologies.

1.3 Objectives: The core of this exercise revolves around the use of role players and their associated infrastructure which is being independently developed by G27 Contracting. The objective of this PWS is to build on this scenario with pre-event site surveys of select signals, resourcing of basic communications equipment for role players, detailed scripting of SIGINT-related documents and communications between role players on a day by day, hour by hour basis in accordance with the G27 developed scenario, and in-person training support for script adjustment and exercise oversight. The Contractor shall:

1. Provide the required training support in accordance with the specific mission requirements identified in this document

2. Provide two SIGINT SMEs for the duration of the exercise. One SIGINT SME will remain collocated with the exercise control group for general exercise oversight and liaison activities with exercise backside support. The second SIGINT SME will remain on-site and available to support script adjustment, infrastructure tear down and setup, and general support and injects to exercise participants as needed.

3. Be prepared to integrate with other vendors supporting the exercise to include Scriptwriting SME’s.

Coordination will be made prior to the exercise occurring. All parties conduct an on-site final conditions check prior to the start of the training exercise.

1.4 Scope of Work: The contractor shall provide all services and equipment in order to support CEMA training objectives for RSTB’s FY21 Task Force Training event, specifically in-depth scripting documents and exercise related transmissions no later than 10 days out from the exercise start date. These scripting documents and exercise related transmissions will be available and digital and hard copy format, individualized to G27’s role players, and verbatim transmissions noting the exact time and place in which the scripting or transmission will occur across the full period of performance. The contractor shall provide select communications equipment, as noted separately in this PWS. The contractor shall provide two SIGINT SMEs to remain on site during the exercise for live exercise support. As previously noted, one SIGINT SME will remain collocated with the exercise control group and the second will remain on-site and available for scripting adjustments and support to exercise participants.

1.4.1. G27 Contracting will resource role players for the exercise and has established specific patterns of life for the duration of the exercise. The requirements outlined in this PWS will cover the scripting of role player communications and communications device use.

1.4.2. The Contractor shall facilitate exercise execution in order to support established training objectives for the RMIB as directed by the Government.

1.4.3. The contractor shall provide two SIGINT SMEs for the duration of the exercise. One SIGINT SME will remain collocated with the exercise control group for general exercise oversight and liaison activities with exercise backside support. The second SIGINT SME will remain on-site and available to support script adjustment, infrastructure tear down and setup, and general support and injects to exercise participants as needed. SIGINT SMEs must have prior experience developing training material for SOF within the last six months and prior experience in

SOF.

1.4.4. The Contractor shall maintain constant contact with scenario role players to ensure their compliance with scripting materials. The contractor must be available to meet directly with role players to assist in device troubleshooting and scripting adjustments. The contractor must ensure that role player devices are functioning and transmitting as planned via pre-execution checks. The status of these devices must be communicated back to the exercise control group.

1.4.5. The Contractor will not be responsible for lodging or exercise participant or role player transportation.

1.4.6. Role player scripting documents and transmissions will be specific to Mode 0, Mode 3, and Mode 6 technologies. These scripting resources and transmissions should include voice/text communications, emails, and online personas pertaining to the aforementioned technologies. The script must extend from one week prior to the start of the exercise to the end of the exercise. The contractor must also provide detailed call data records that must extend from one week prior to the start of the exercise to the end of the exercise. Call data records must be based on devices used by role players in accordance with the role players’ pattern of life. There will be four role players in total, each will two devices which will require call data records for specific dates which will be given to the contractor upon award.

1.4.7. The Contractor will conduct a daily synchronization meeting with the RMIB SIGINT OIC Controller at the start and end of each training day. During these synchronization meetings the contractor shall provide daily summaries of all major intel collection events that were or were not caught by the collection team. Additionally, the contractor will provide an Executive Summary to capture role player and vendor sustains or improvements for follow-on VALEXs.

1.4.8. The contractor shall be solely responsible for providing their own tools and/or equipment for the loading, transportation, delivery, and unloading of training materials at the training site.

1.4.9. The contractor shall identify a point of contact that can be reached at all times by the government technical point of contact. He or she will facilitate the coordination of services provided by the contract and be available to address any concerns regarding the support rendered by the contractor.

1.4.10. Contractor shall be able to obtain access to government training installations.

1.4.11. The contractor’s site survey will encompass the full spectrum and will occur over the course of dates chosen by the contractor. The survey must cover all training areas outlined in this statement of work and specified by the government upon award of the contract. The surveys must directly tie into detailed call data records in accordance with role player patterns of life independently resourced via G27 contracting. The surveys must be completed 10 days prior to the exercise start date.

1.5. Period of Performance: The period of performance will be between 25 January and 12 February 2021 across Fort Pendleton, VA, JEB Little Creek – Fort Story, VA, and Norfolk, VA. The Government POC will coordinate with the vendor following award of the contract to finalize details for key dates listed throughout this PWS, to include receipt of scripting materials 10 days prior to the exercise start date.

1.6 General Information

1.6.1 Quality Control The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The QCP will be submitted to the KO no later than 5 days out from the exercise start date. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Place of Performance: The work to be performed under this contract will be performed only at CONUS locations where training is approved to be conducted, IAW Realistic Military Training Policy, USSOCOM Directive 350-27, 31 July 2018, and relevant subordinate directives.

1.6.4 Type of Contract: The government will award a non-personnel services contract covering the aforementioned period of performance.

1.6.5 Security Requirements: The overall classification required for this requirement is TS/SCI.

1. Access and general protection policy and procedures. All contractor employees, including subcontractor employees, requiring access to an Army or USSOCOM controlled installation, facility, or area shall comply with applicable security policies and procedures (provided by the government representative). This includes policies pertaining to the use or prohibition of electronic recorders, devices, cameras, etc. If the Contractor is required to take photographs or videos on a Government Installation, the Contractor must obtain written permission from the Senior Commander. The contractor shall also provide all information required for background checks to meet installation and facility access requirements to be completed by the installation Provost Marshal Office, Director of Emergency Services, or Security Office. The contractor workforce must comply with all personal identity verification requirements as directed by DoD, HQDA, USSOCOM, USASOC and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should Force Protection Condition (FPCON) at any individual facility or installation change, the government may require changes in contractor security matters or processes.

2. Requirement for OPSEC training. Per AR 530-1, Operations Security, new contract employees must complete OPSEC Level I training within 30 calendar days of reporting for duty. All contract employees must complete annual OPSEC Awareness Training.

3. Handling / access to classified information. The Vendor shall comply with FAR 52.204-2, Security Requirements for access to information classified "Confidential", "Secret", or "Top Secret". The Vendor must execute a Security agreement (DD Form 441), IAW the National Industrial Security Program Operating Manual (DoD 5220.22-M) and any revisions to DoD 5220.22-M (Note: A DD Form 254 will be required for any contract that requires access to classified information and/or a security clearance.)

4. Vendor to obtain a Facility Clearance and individual clearances at the appropriate level. The Vendor must obtain a Facility Clearance at the appropriate level (IAW the NISPOM DoD 5220.22-M) prior to the start of the contract awarded period of performance. Contractor personnel performing work under this contract must have the required security clearance at the appropriate level at the start of the period of performance.

Security clearances and Facility Clearance (FCL) requirements are required to be maintained for the life of the contract in accordance with the DD254 attached to the contract.

5. Pre-screen applicants using E-Verify Program. The Vendor must pre-screen applicants using the E-verify Program (http://www.dhs.gov/E-Verify) website to meet the established employment eligibility requirements. The vendor must ensure that the applicant has two valid forms of government issued identification.

6. This contract does not require the contractor to have access to Communication Security Information.

7. This contract does not require use of COMSEC Key.

8. This contract does not require a COMSEC Account.

9. This contract does require the contractor access to Sensitive Compartmented Information (SCI).

10. This contract does require the contractor access to Top Secret Information (TS) and Secret Information (S).

11. This contract does require the contractor access to For Official Use Only Information (FOUO) or Controlled Unclassified Information (CUI).

12. This contract does not require the contractor access to Special Access Program (SAP) material.

13. This contract does require the contractor access to ALTERNATIVE Compensatory Control Measures

(ACCM).

14. This contract does require the contractor access to government networks.

15. This contract does not require the contractor the use of a contractor-owned computer at exercise locations.

16. The contactor will not be processing ACCM, SAP, or SCI information at their facility.

1.6.5.1 PHYSICAL Security: The contractor shall be responsible for securing all equipment used to perform the requirements outlined in the PWS. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.8 Special Qualifications: SIGINT SMEs must have prior experience developing training material for SOF within the last six months and prior experience working in SOF for at least three years in a SIGINT work role.

1.6.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.

Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.10 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract:

perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.11 Key Personnel: The follow personnel are considered key personnel by the government: The Contract Manager/ Exercise Controller. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 0900-1700 Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. The contract manager or alternate shall be available during the entirety of the agreed upon exercise dates.

1.6.12 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contracted personnel will be required to obtain and maintain identification badges IAW 75th Ranger Regiment Security Procedures and Policy.

1.6.13 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

1.6.14 Contractor Travel: The Contractor is responsible for all travel related expenses incurred by contractor employees and representatives throughout the duration of this contract. The Contractor shall have the required support on site throughout the duration of the exercise.

PART 2

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

2. GOVERNMENT FURNISHED ITEMS AND SERVICES:

2.1. Services: As previously outlined in this PWS, the core of his exercise is being developed by the government and separate, contracted entities. These government and contracting entities will be responsible for exercise lodging, transportation, and sustenance for Department of Defense participants. They will resource personnel to serve as role players and will script these role players physical pattern of life and backstory.

2.2 Facilities: The Government will provide access to required facilities for the contractor to perform work during the period of performance. Coordination will be made between the government POC and the contractor upon award.

2.3 Equipment: The Government will not provide any equipment to the contractor to perform the services required without direct coordination between the contractor and the government.

PART 3

CONTRACTOR FURNISHED ITEMS AND SERVICES

3. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

3.1 General: The Contractor shall furnish all supplies, communications equipment, and services required to perform work under this contract. All materials will be delivered to various sites identified as the designated training area prior to the training exercise. Coordination’s for delivery dates, exact locations and additional POC’s will be made between the government point of contact and the contractor upon contract award. The Contractor should be prepared to support training locations noted in this PWS and surrounding areas throughout. This will be continuous throughout the contract on all identified training locations.

3.2. The contractor will provide the following equipment to serve as personal communications equipment focused on Modes 0, 3, and 6 technologies.

3.2.1. The contractor shall provide 9 Samsung Galaxy S10 phones capable of band locking for the exercise’s full period of performance.

3.2.2. The contractor shall provide 5 HP Elitebook laptops with 8th Generation Intel Core i5 processors, 3 running a Linux Operating Systems and 2 running Windows call for the exercise’s full period of performance.

3.2.3. The contractor shall provide 1 Amazon Alexa for the exercise’s full period of performance.

3.2.4. The contractor shall provide 3 IP cameras each of different makes and models for the exercise’s full period of performance.

3.2.5. The contractor shall provide 7 Verizon Inseego 5G MiFi M1000 Hotspots with unlimited high speed data for the exercise’s full period of performance.

3.2.6. The contractor shall provide 20 sim cards compatible with all smartphones provided by the seller for the exercise’s full period of performance.

3.2.7. The contractor shall provide 8 wireless routers for the exercise’s full period of performance. The wireless routers must be compatible with all devices provided by the seller.

3.2.8. The contractor will be responsible for all travel and lodging for contracted personnel. The contracting company will ensure that all rates are IAW the JTR in all designated cities for lodging, per diem, flight reservations, travel to and from the training sites, and any other associated costs. Travel arrangements will be included in the overall bid and provided at the contractor’s expense and effort.

PART 4

SPECIFIC TASKS

4. Specific Tasks:

4.1. Basic Services. The contractor shall provide substantive services in support of CEMA Company’s training SIGINT and Cyber training objectives at the 75th Ranger Regiment Special Troops Battalion FY 21 Task Force Training event.

4.2. Backside Support / Logistical Support

Required Tasks:

4.2.1. The contractor will conduct a joint, thorough pre-exercise overview of the designated geographic locations area with key RMIB, RSTB, and external contracted personnel in order to identify meeting places, residences, and any other planning considerations.

4.2.2. The contractor will be prepared to brief the findings of the aforementioned SIGINT survey of all training areas during a follow on planning conference through Video or Tele-Conference. The final date for this conference will be relayed to the contractor the week prior to execution.

4.2.3. Contactor will supply one (1) SIGINT SME to be collocated with the exercise control group. This individual can be dual hatted to support other required roles during the exercise. This individual must have supported a full spectrum SOF SIGINT validation exercise in the past. Resume required. Additional qualifications must include:

a. At least two years’ experience in a SIGINT role at a designated Special Operations unit.

b. Previously developed and instructed SIGINT training material for special operations forces in the past six months.

4.2.4. The contractor shall provide (1) SIGINT SME to remain on-site and available to support script adjustment, infrastructure tear down and setup, and general support and injects to exercise participants as needed. The contractor will remain in constant communication with exercise role players, as outlined in this PWS. This individual must have supported a full spectrum SOF SIGINT validation exercise in the past.

Resume required. Additional qualification must include:

a. At least two years’ experience in a SIGINT role at a designated Special Operations unit.

b. Previously developed and instructed SIGINT training material for special operations forces in the past six months.

c. Instructor and operational experience in Mode 0, Mode 3, and Mode 6 within the past year.

d. Experience working and instructing with Mastodon Design’s most recently fielded systems.

4.3. Intelligence Requirements:

4.3.1. Intelligence Execution Training Requirements:

4.3.1.1. The Contractor shall be familiar with the scenario, general situation and exercise intelligence summaries as directed by the Government from Government exercise control in accordance with the Concept of the Operation

(CONOP).

4.3.1.2. The Contractor shall support the implementation of exercise storylines as directed by the Government CONOP and in accordance with external contractor resources and products.

4.3.1.3. The Contractor shall assist the Government in providing flexible role playing feedback to drive the exercise to ensure that all training goals and objectives are achieved or enhanced.

4.3.1.4. The Contractor shall enable a training environment where the tactical platform drives collection requirements for the strategic collection team.

4.3.1.5. The Contractor shall utilize the scripted scenario so it incorporates interaction with other intelligence disciplines (CI/HUMINT, GEOINT, and All Source).

4.3.1.6. The Contractor shall be familiar with the Government’s intelligence training vignettes in scenario scripting to adhere to a CONOP that is approved by the Government.
