About this file

This document is a contract amendment from the Arizona Department of Transportation (ADOT) for a contract with Ennis-Flint, Inc., specifically covering Bulk Thermoplastic and Preformed Thermoplastic Pavement Markings. The contract number is CTR069747, and the amendment involves a contract extension and price adjustment approved on January 22, 2025.

The amendment extends the contract from January 29, 2025, through January 28, 2026, and increases pricing for three line items of bulk thermoplastic materials. Specifically, the price per 2000-pound pallet increases by $100 for Yellow Organic (no lead), White, and Black thermoplastic, bringing the rates to $1,475.00, $1,525.00, and $1,475.00 respectively. The price increase represents approximately a 3.3% contract value increase, which is below the 5% maximum increase allowed in the original bid. Ennis-Flint noted they were operating at a loss on these specific items and requested the price adjustment to remain viable. The procurement determination found the new rates fair and reasonable and below market pricing, thus approving the amendment.

3) Provide justification:

Ennis-Flint is requesting a price increase on 3 line items for contract no. CTR069747. After review, it was determined that this price increase would equate to an approximate 3.3% increase to the value of the contract. This is below the 5% max increase evaluated as part of their bid submission. Additionally, the new contract rates are below market pricing.

Therefore, adjusted price is determined to be fair and reasonable as it is supported by market price. It is in the best interest of the Department to grant the requested price increase.

RE: Bulk Thermoplastic and Preformed Thermoplastic Contract CTR069747

Hello Mr. Henry.

Ennis-Flint, Inc. is in a position to renew Contract CTR069747 Bulk Thermoplastic items 4 and 5, Preformed Thermoplastic items 1-64, as well as Tools & Primer Sealers items 1-5 at the same terms and conditions including pricing. We request that you remove items 1, 2 and 3 Bulk Thermoplastic Yellow, White and Black.

Please note that items 4 and 5 are multi-polymer pavement marking material. These two items are durable pavement markings that can be used in lieu of Bulk Thermoplastic.

If you wish to discuss the price adjustments to keep items 1, 2 and 3 Bulk Thermoplastic Yellow, White and Black in the contract, please give me a call.

RE: Bulk Thermoplastic and Preformed Thermoplastic Contract CTR069747

Mr. Henry, Please reference our letter previous sent regarding renewal of this contract, I’ve attached a copy for your convenience. And thank you for the opportunity to explain our position on CTR069747 Bulk Thermoplastic items 1, 2, and 3, Yellow, White and Black.

It appears that at the time of our bid submission in October of 2023 we made a mistake on the pricing of these items. We have been honoring our bid pricing for the duration of this contract, however since we have been under water on these three items and we cannot continue to lose money, we would need an extra $100 per ton to get us back to even. Even with this increase we will still be well below market pricing and well below any pricing we would offer on a new bid.

If you wish to renew this contract with the above proposed price adjustments on items 1, 2 and 3 Bulk Thermoplastic Yellow, White and Black we will be able to renew. Pricing on all other items will remain the same.

We thank you for your consideration and the opportunity to explain our position. We highly value the relationship we have with AZ DOT and desire to continue.
