1. Statement of Need

1.1. Pursuant to the Arizona Procurement Code, Arizona Revised Statutes (A.R.S.) § 41‐2501 et seq., the State of Arizona Department of Transportation (Department) requires external legal advisory services for alternative project delivery methods, including Public Private Partnerships (P3s).

Title 28, Chapter 22. These statutes grant the Department the authority to use P3s as a method to deliver transportation and ancillary projects related to the Department’s mission. The Contractor shall review A.R.S. Title 28, Chapter 22 and become familiar with this authority. P3 projects on eligible facilities, as defined in A.R.S. § 28‐7701, can be initiated from a variety of sources, including nongovernmental entities, through the filing of an unsolicited proposal.

2.3. Potential alternative delivery projects are evaluated based on a number of criteria, which are described below. These criteria serve as general guidelines, all of which may or may not be applicable to certain projects. As the Department continues to develop its Major Projects / P3 program and evaluates further projects, the alternative delivery project evaluation criteria will likely continue to evolve.
