About this file
This is a Contracting with Entities of Foreign Countries of Concern Prohibited Affidavit required by Florida Statutes Section 287.138 for Hillsborough County Public Schools (HCPS) in connection with their Substitute Teacher Services contract opportunity. The affidavit must be completed and executed by an authorized representative of any proposer or contractor submitting a bid, proposal, or other response to HCPS, and the bid will not be accepted without this completed form. The document establishes requirements for entities seeking to contract with HCPS by defining key terms including "controlling interest" (possession of power to direct management or policies, including ownership of 25 percent or more of voting interests or profits) and "foreign country of concern" (specifically identifying the People's Republic of China, Russian Federation, Islamic Republic of Iran, Democratic People's Republic of Korea, Republic of Cuba, the Venezuelan regime of Nicolas Maduro, and the Syrian Arab Republic, including their agencies and entities of significant control).
The affidavit prohibits governmental entities from knowingly entering into contracts with entities that are owned by, have government controlling interest in, or are organized under the laws of or principally located in a foreign country of concern, particularly when such entities would have access to personal identifying information. By executing this affidavit, the proposer's authorized representative attests under penalties of perjury that the legal company name does not meet any of the prohibited criteria. The affidavit requires the signature, printed name, title, and date from the authorized representative.
