SECTION 1. INTRODUCTION AND INSTRUCTIONS TO RESPONDENTS

1.1 INTRODUCTION

The County of Orange (County), consisting of 22 agencies and departments, delivers a broad range of services to the residents of Orange County. Services provided include public protection, public health, infrastructure maintenance, and community and social services. It is the primary responsibility of the County of Orange to enrich the community through the efficient delivery and maintenance of public works infrastructure, planning, capital improvement, and development services.

The County of Orange, County Procurement Office intends to pre-qualify firms to provide

Architect-Engineer (A-E) and A-E related services Countywide for various maintenance and capital improvement projects. Through this Request for Qualifications (RFQ), the County will evaluate responding firms based on the qualifications and requirements established in this solicitation and will establish a Qualified Vendor List (QVL) consisting of firms determined to be qualified to perform the applicable A-E disciplines and services.

From the firms determined to be qualified and placed on the QVL, the County intends to select certain firms for initial contract awards, subject to approval by the Orange County Board of

Supervisors, as applicable. Firms that are determined to be qualified but are not selected for an initial contract award will remain on the QVL and may be considered for future contracting opportunities during the effective period of the QVL, subject to County needs, available contracting capacity, applicable procurement requirements, and required approvals.

Placement on the QVL does not guarantee the award of a contract, task order, minimum dollar amount, or any specific volume of work. Likewise, the award of a contract does not guarantee that any particular amount of work will be assigned. The County reserves the right, at its sole discretion and in accordance with applicable County policies and procedures, to make multiple contract awards and to utilize qualified firms from the QVL as future needs arise.

Contracts awarded as a result of this RFQ process shall have a maximum term of three (3) years.

At the conclusion of the applicable contract and/or QVL period, the County may issue a new solicitation to establish a new QVL and provide firms an opportunity to compete for future A-E services.

1.5 EVALUATION PROCESS AND CRITERIA

An evaluation panel will conduct evaluations of the SOQs submitted through the RFQ process.

The committee will consider the information supplied by Respondents. If it finds a failure or deficiency in the SOQ or any information provided in connection thereto, the evaluation panel may reject said SOQ or information or reflect the failure or deficiency in the evaluation.

http://www.usfcr.com/ https://procurement.opengov.com/portal/ocgov

The County may request clarifications, or otherwise verify the contents of the SOQ, including information about the Respondent, consultants, and sub-consultants. County reserves the right to seek publicly available information about the Respondents.

The evaluation panel will score the responding Consultant SOQs and develop a shortlist of firms to be placed on the Qualified Vendor List (QVL). At the discretion of the evaluation panel and based on evaluation results and County needs, highest-scored consultants from that QVL may be issued contracts, which may require County Board of Supervisors approval.

Note that once the QVL is established, at the time Consultants are chosen for specific projects, different scoring criteria may be applied to determine the successful consultant for the specific project under consideration. These criteria may include, but are not limited to, project specific considerations, in-person interviews, evaluation of references, negotiations, and past projects.

Proposals deemed to meet all minimum RFQ requirements will be scored based on the established criteria, and will be assigned points that measure the responsiveness to each identified criterion. The total number of points earned will be tallied for each Proposal, based upon the Respondent(s) submitted written materials.

Proposals shall be evaluated by an Evaluation Panel of subject matter experts on the basis of the responsiveness to the requirements in this RFQ. The County may request clarifications, or otherwise verify the contents of the Proposal, including information about the Respondent, Contractors and sub-contractors. The County reserves the right to seek publicly available information about the Respondents.

The scoring is based on evaluation of the Proposal as measured against the Scoring Criteria.

Proposals will be evaluated from the most advantageous to the least advantageous to the County.

*Please note: These minimum qualifications must be verified for the Proposal to be deemed responsive. Any Proposal may be construed as non-responsive and ineligible for consideration if it does not comply with the requirements of the RFQ.

Respondent must possess the following credentials and certifications listed below:

The total number of points earned will be tallied for each SOQ, and the SOQs will be scored in order, based upon the Respondent(s) submitted written materials.

Any inquiry to determine the responsibility of a Respondent to this RFQ may be conducted.

Respondent agrees that the submission of a SOQ is permission by Respondent for County to verify all information contained therein. If County believes it necessary, additional information may be requested from Respondent. Failure to comply with any such request may disqualify a

Respondent from further consideration.

1.6 SELECTION/AWARD PROCEDURES

Upon the completion of the evaluation process, the evaluation panel will make a recommendation for a shortlist of qualified consultants (“QVL”) to the County DPA. At the time services are required, a contract may be issued to a QVL consultant. Upon recommendation for placement on the QVL, consultants will be required to submit a fee schedule, which shall remain for the full term of the QVL. The County reserves the right to negotiate this fee schedule. Final award determination or placement on the QVL shall be subject to successful negotiations, reference checks, and past performance.

At the time A-E services are required, a contract up to Board threshold may be issued to a QVL consultant by negotiating project cost and scope of work independently upon each contract approval. Also based on evaluations and County needs, contracts over the Board threshold may also be awarded to a QVL consultant but will require Board of Supervisors approval.

Upon the completion of the evaluation process, the Evaluation Committee will make a recommendation for an award to DPA. Final award determination shall be subject to reference checks and past performance and may be subject to approval(s) by the County Board of

Supervisors. In addition, County reserves the right to verify and validate any information prior to the Contract Award and during the entire term of the Contract.

The Model Contract contained in Section III of this solicitation is a sample of a contract which may be proposed for execution. It may be modified to incorporate negotiated items and other pertinent terms and conditions set forth in this solicitation, including special conditions and requirements and those added by addendum and necessary attachments and/or exhibits and to reflect the Respondent’s SOQ and qualifications.

Each selected Respondent may enter into a multi-year contract with the County. After award of contract as each project is identified, the awarded firm within the required discipline(s) will be requested to submit cost/fee schedule.

No guarantee is expressed or implied as to the total services to be purchased under this RFQ.

Award of a consultant does not guarantee any future work to be awarded.

In the event a firm is selected for a specific project, the selected firm will be required to negotiate and execute an agreement with the County, which agreement may require County Board of

Supervisor approval.

Inquiries may or may not be conducted with the finalists; therefore, the SOQs submitted should contain Respondent's most favorable terms and conditions, since the selection and award may be made without further discussion. Exceptions to the terms and conditions of the proposed

Contract or the statements regarding Respondent’s inability to comply with any of the provisions thereof are to be declared in the response to the RFQ in Section II, Part 1, H.
