Schedule B - Scope of Work
Project Overview
Weld County is moving forward with design and construction of a new Justice Center to serve the growing needs of its community. Through this RFP, Weld County is seeking proposals from qualified Construction Manager / General Contractor (CM/GC) firms to provide Preconstruction and Construction services for the Weld County Justice Center Project, located in Greeley, Colorado.
While final scope will be refined during design and preconstruction, for purposes of proposal evaluation and comparison, the County has established the following program baselines to generally describe potential scale, organization, and functional components of the Justice Center project. These baselines are provided solely for evaluation purposes and are subject to modification and refinement based on design evolution, stakeholder input, funding strategy, and direction from the Board of County Commissioners.
Weld County Justice Center This project encompasses the complete construction of the Weld County Justice Center and associated parking structure.
Current Program Baseline:
• Located at West Block / Block 66 in Greeley, CO
• 6-story, 24-courtroom Justice Center (approximately 282,000 SF) and an adjacent 5-story ~600-stall Parking Structure (approximately 202,000 SF)
• Levels 1, 2, 4, 5, and 6 (approximately 42,000 SF each) fully built out and finished; Level 3 (approximately 42,000 SF) delivered as a conditioned, unfinished shell with core/circulation extended for future courtroom build-out
• Justice Center will be organized into 3-distinct circulation zones (secure, restricted, and public), and will include, but not limited to, the following spaces:
o Judges' Chambers o Courtrooms o Jury Assembly o Clerk of Court o District Attorney o Probation o Justice Services o Court Administration o Sheriff / Court Security and Holding o Public Lobby o Vehicular Sallyport o BOH Service Yard
Anticipated Construction Commencement:
• Parking Structure – November 2026
• Justice Center – June 2027
Method of Procurement Best Value: Best Value refers to a project procurement method where price and other key factors, such as quality and expertise, are considered in the evaluation and selection process. Best Value is typically achieved through a two-step process using a Request for Qualifications (RFQ) and Request for Proposal (RFP) to evaluate proposers.
Solicitation # B2600077 Page 7
Delivery Method
Construction Manager/General Contractor (CM/GC): A Construction Manager/General Contractor (CM/GC) is a construction project delivery method in which the county enters into separate contracts with the designer and the builder, often at or about the same time. During design, the CM/GC advises the owner and designer on constructability, value engineering, cost estimating, schedule, sequencing, selection of components and materials, and other matters.
When the design is completed, the CM/GC using defined or negotiated fees becomes the builder or general contractor for the work and may use subcontractors and/or self-perform the work. The CM/GC does not become a Construction Manager; instead the county supplies construction management through its own staff or a consultant.
Pricing Method
Guaranteed Maximum Price (GMP): Guaranteed Maximum Price (GMP) (also known as not-to-exceed price) is a variance of the Cost-Plus pricing method where the contractor guarantees the county will pay no more than the maximum price established for the completion of the work. GMP fees may include but are not limited to the costs of work, management fees, and a contingency fee to cover risk. GMP for vertical construction contracts are typically executed in two (2) parts. The first contract is for preconstruction services and is usually a lump sum or hourly fee. The second contract is for actual construction based on the design, which establishes the GMP. GMP fees may include but are not limited to Design, Pre-Construction Services, General Conditions, specifications, Construction Management, Bonds, Contingency, and Insurance and Cost of Work.
GMP contracts are cost-type contracts (also known as an open book-contract).
Specific Requirements and Responsibilities
Scope of Preconstruction Services All preconstruction services will be provided on a cost-reimbursement basis up to the stated preconstruction fixed fee as defined in Schedule E.
The CM/GC shall provide professional Preconstruction Services during the design phase to support Weld County and the Design Team. The CM/GC shall be engaged during the Design Development phase for the Justice Center and the Construction Documents for the Parking Structure.
In general, Preconstruction Services are expected to include but not be limited to the following:
• Serve as a partner to the design team and provide preconstruction guidance.
• Secure production capacity and schedule availability with early trade partners, managing long lead procurement timelines in coordination with the design team.
• Competitively select and hold under written commitment a precast concrete trade partner prior to Notice of Award, such that the selected precast firm is able to begin meaningful work immediately and hold production timelines upon Notice of Award with no delay to the project schedule.
• Develop and update schedules, estimates, and action plans as required.
• Guide decisions regarding phasing of the project to optimize quality, schedule, and budget.
Solicitation # B2600077 Page 8
• Strategically approach the sub-contractor market with a focus on providing quality, schedule, and budget value to the County.
• Provide information, estimates, and schemes regarding construction materials, methods, systems, phasing, sustainability, and costs and participate in decisions regarding same.
• Provide design team with collaborative input on design decisions that impact construction schedule.
• Provide guidance and strategy developing early work packages to support procurement and construction.
• Provide design team with collaborative input on design decisions that impact construction budget.
• Provide input on current market climate and economic conditions.
• Develop detailed and well-organized bid packages in coordination with the design team and County.
• Advertise, manage, and obtain bids per Weld County requirements.
Scope of Construction Services It is anticipated that the GMP will be established during the final stages of the Construction Documents phase and prior to buy-out of/bidding on most or all the bid packages. The GMP may be established after completion of the Construction Documents and subsequent to the bidding phase at the County’s sole discretion.
The established GMP will be the maximum amount paid for the construction of the respective facilities, unless scope changes are requested by the County. County’s acceptance (if accepted) of the GMP by contract amendment will constitute completion of the Preconstruction Services for the applicable Project, and that GMP Amendment will initiate the Construction period for the applicable Project where the CM/GC will take the role as Construction Manager and General Contractor.
At the time of execution of the GMP Amendment, the CM/GC will be required to submit a 100% Performance and 100% Labor & Materials bond for the completion of the specified Project. Failure of the CM/GC to obtain the applicable bonding will result in termination of the applicable GMP Amendment.
The County shall not be obligated to enter into a GMP Amendment with the CM/GC. The County retains the option to cancel the Construction Services; to start a new selection process for the Construction Services of the Project; to terminate the contract and negotiate a replacement contract with the next highest rated Proposer from this solicitation.
