SECTION 01 35 53

SECURITY PROCEDURES

PART 1 - GENERAL

1.01 SUMMARY

1. Requirements of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 and the Homeland Security Act of 2002 require that municipal water utilities be managed as secure locations.

2. These acts define security screening of all employee and contractor personnel, controlling access to facilities and controlling access to information as “basic security requirements.” The

City of Minneapolis has reviewed these requirements and will manage them in the following manner.

1.02 CRIMINAL BACKGROUND INVESTIGATIONS

A. All Contractor or Sub-Contractor personnel who will be on the project site for more than five (5) working days or have the need or opportunity to access water facility information must submit to the collection, review and approval of personal criminal background history information.

B. Personal criminal background information will be acquired through an independent third party investigator that is licensed, insured and under contract with the City to perform said investigations.

C. Persons submitting to a background investigation will do so via secure website. This requires disclosing the following information.

1. Full legal name.

2. Current address.

3. Social Security number.

4. All past addresses for previous seven years.

5. Any known aliases.

6. Date of birth

D. The background investigation will consist of searching and reporting information for all disclosed and discovered history information involving:

1. County criminal.

2. State criminal.

3. Federal criminal.

4. Global watch.

E. Personal credit history information will not be collected nor reviewed as part of this investigation.

F. All history gathered will be forwarded to the City for review and approval. The City reserves the right to deny access to its facilities and information as it deems appropriate.

G. Under Data Privacy Act Laws, specific details of the investigation will not be released to anyone other than the person (upon request) being investigated. The City will simply report findings as either "Pass or Fail".

01 35 53 - 2 PS6 Boiler Room Crane

H. Under the Fair Credit and Reporting Act (FCRA) Federal law, the City is required to notify individuals they will be denied site access based on information found in their background investigation. Individuals will be notified by email, along with a copy of the background check report and a copy of the summary of your rights under the FCRA before any action is taken.

1. If the individual believes there is false information in the report, they may submit additional information. The City will re-investigate and provide an updated report. A final determination will be made after the second report is reviewed.

1.03 SUBMITTAL PROCESS FOR CRIMINAL BACKGROUND CHECKS

A. The Contractor shall send the following information to the Project Manager on all individuals who require access to the work site:

1. First, Middle, and Last name

2. Personal email address (not corporate address, for privacy reasons)

3. Phone Number

4. Project name

5. Company name

B. The Project Manager will forward the individual’s information above to the City Security

Division who will enter the information into the database of the City’s Background Investigation

Service Provider (herein BGI Service Provider). The BGI Service provider may change through time, so the City Project Manager will inform the Contractor of the current provider.

C. The BGI Service Provider will contact each individual via their personal email and provide them with a secure link to enter their personal information. Once the individual completes this form and submits it, the background investigation process will begin.

1. The individual should check their spam and junk email folders as it might automatically go there. Each individual has 30 days to enter the information before the link expires.

2. To prevent any delays this information must be completed and returned to the Provider as soon as possible – the background investigation process cannot begin until this step is complete.

D. City Security Division will be alerted by the BGI Service Provider when individual background investigations have been completed. Security will review the reports and make a determination on pass / fail based on the contents of the report.

E. Once the BGI consent form has been forwarded by the individual to the BGI Service Provider, the Project Manager should allow about 10 business days for the City to review and make a determination on the individual’s pass/fail status.

F. If adverse information is discovered during the investigation process, Security Staff will forward a copy of the report along with written notice of the findings to the individual. He /she will have 3 business days from receipt to dispute the findings with the BGI Service Provider. Access to City property will be denied unless the original report is found to be erroneous.

PART 2 - PRODUCTS

2.01 NOT USED

01 35 53 - 3 PS6 Boiler Room Crane

PART 3 - EXECUTION

3.01 CONTROLLING ACCESS TO FACILITIES:

A. All Contractor personnel approved by the City will be issued work identification (ID) badges.

These badges must be worn at all times while on Minneapolis Water (MWW) property. ID badges allow access to the work site; identify the person, the activity and the area of the facility where personnel are allowed to enter.

B. Any persons not wearing their ID badges or frequenting unapproved areas will be escorted from the premises. If an individual is escorted from the premises more than twice, that person will be removed from the work eligible list and not allowed to return to MWW.

C. Gates onto Minneapolis property and providing plant site access, including the construction entrance, must be locked or attended at all times.

D. NO deliveries or pickups will be allowed unless the Contractor is available for escort.

E. Any Contractor or Subcontractor personnel whose work require them to be on site for less than five total days must be escorted on to the site and under the direct supervision by contractor personnel who have successfully passed the investigation and are in position of Minneapolis-issued ID badges.

F. Select contractor personnel who require access inside other controlled area(s) will be authorized for access as coordinated with Owner.

G. All Identification Badges and Access Cards must be returned to Owner prior to final application for payment. A fee of $100 will be deducted from final payment for each badge or card not returned.

3.02 SITE AND BUILDING ACCESS SCHEDULE
