About this file
This document is an Amendment (Amendment Number 4) to a Standard Professional Services Agreement between the State of Florida Department of Transportation (FDOT) and Atkins North America, Inc. The original agreement was executed on September 27, 2016, with this specific amendment dated August 20, 2018. The amendment involves the Transportation Systems Planning Consultant contract, identified by the original Agreement No. C9Q02 and FM Number 42253811202.
The purpose of this amendment is to incorporate financial consequences into the existing agreement, specifically outlining performance standards and payment conditions. The key provisions include requirements for service acceptance through the Department's Consultant Invoice Transmittal System, with potential financial penalties for unsatisfactory performance. If the FDOT determines the consultant's performance is unsatisfactory, Atkins must provide a corrective action plan within five days. Failure to adequately address performance issues could result in a 10% retainage on invoice amounts, which will be withheld until deficiencies are resolved or forfeited at the end of the agreement period.
