Contract Summary
This is Amendment No. 3 to DEP Contract No. LE681, executed between the Florida Department of Environmental Protection (FDEP) and American Compliance Technologies, Inc. (Contractor). The amendment was entered into on August 26, 2009, with subsequent amendments on January 12, 2010, and March 7, 2012. The amendment reflects a renegotiation of contract rates pursuant to Chapter No. 2010-151, Laws of Florida, which required state agencies to review existing contract renewals with private providers to reduce contract payments. The contract includes one five-year renewal option, with the completion date extended from August 25, 2014, to August 25, 2019.
The contract provides emergency response services and environmental remediation support, including labor, vehicles, heavy equipment, water response equipment, generators, pumps, sampling equipment, personal protective equipment, and expendable materials. Labor rates range from $14.55 to $176.10 per hour depending on position and whether work is performed during standard time or overtime. Vehicle rates include all maintenance, fuel, and mobilization costs, with hourly rates from $1.94 to $63.05 and daily rates up to $620.80. Equipment inventory is distributed across seven office locations (Borrow, Orlando, Gainesville, Tallahassee, Jacksonville, Naples, and Ft. Lauderdale). The revised fee schedule also includes charges for specialized equipment, sampling containers, materials, drums, and additional service fees not exceeding 15 percent for items not otherwise listed in the price schedule. Contract managers and contact persons were updated as part of this amendment.
