About this file
This document is Amendment No. 16 to Agency Term Contract No. GC848, a rate increase amendment executed between the Florida Department of Environmental Protection (DEP) and Earth Systems, LLC. The original contract was executed on February 21, 2014, to provide petroleum contamination site response action services in the South Region. The amendment was executed on May 13, 2024, by Scott Moore, Operations Manager for Earth Systems, LLC, and Jessica Kramer, Deputy Secretary for the Florida Department of Environmental Protection.
Amendment No. 16 implements rate increases to the contractor's rate schedule (Attachment D, Version 3.5) for all new work assignments offered on or after the effective Rate Change Date of June 10, 2024. The rate increases range from approximately 2.95% to 3.09%, all remaining within the maximum 5% increase allowed under contract provision 11.B. The amendment modifies pricing for 32 pay items covering services including mobilization costs for various equipment types, boring and well installation activities, soil sampling, transportation and disposal of petroleum-impacted soil, and reporting services. For example, off-site property access agreements increased from $361.00 to $372.00, light duty vehicle mobilization under 100 miles increased from $500.00 to $515.00, and direct push technology rig equipment increased from $3,620.00 to $3,730.00. All pre-amendment work assignments continue to apply the previous rate schedule, and all other contract terms and conditions remain in effect.
