DEP Contract GC691: Storage Tank System Compliance Verification Program
This is a state and local contract indefinite delivery vehicle executed between the Florida Department of Environmental Protection (DEP) and the Broward County Board of County Commissioners, Broward County Environmental Protection Department. The contract establishes an agreement for the Broward County Environmental Protection Department to serve as the local contractor administering the Storage Tank System Compliance Verification Program within Broward County. The contract became effective July 1, 2007, and remains in effect until June 30, 2017, with provisions for renewal contingent upon satisfactory performance and fund availability. The contract utilizes a Task Assignment Notification Form (Attachment B) process for issuing work assignments, with compensation provided on a fixed-price basis per executed Task Assignment.
The contractor is responsible for performing compliance inspections of storage tank systems regulated under Florida Chapters 62-761 and 62-762, F.A.C., including discharge inspections, closure inspections, installation inspections, routine compliance inspections, and Level 1 enforcement activities. The contractor must maintain qualified staff equivalent to Environmental Specialist I or higher positions, ensure all inspectors receive required training and certification, and enter inspection data into the Florida Inspection Reporting for Storage Tanks (FIRST) database prior to invoice submission. Payment is structured as monthly invoices based on the fixed price identified in each Task Assignment, with the DEP responsible for invoice approval within five working days. The contract includes performance standards requiring 33 percent completion of routine inspections after four months, 66 percent after eight months, and 100 percent after twelve months of each Task Assignment period. Failure to meet performance levels or successfully implement corrective action plans may result in cost recovery by the DEP or contract termination, with any penalties assessed at 8.3 percent of the current Task Assignment amount.
