About this file
This document is a wage theft prevention certification form established by the City of Boston for all prospective vendors bidding on city contracts. The form requires vendors to certify compliance with an Executive Order designed to prevent wage theft and ensure adherence to wage and hour laws. Vendors must complete and submit this form with their bid or proposal, and for multi-year contracts, must complete it annually on each contract anniversary. The certification obligates vendors to comply with Massachusetts General Laws Chapter 149, Chapter 151, and the Fair Labor Standards Act, and requires posting of the Massachusetts Wage and Hour Laws notice in conspicuous workplace locations.
Vendors must select one of two certification options: either certify that neither the firm nor any subcontractor has been subject to federal or state criminal or civil judgment, administrative citation, or debarment for wage and hour violations within three years prior to bid submission, or disclose such violations and include supporting documentation with the proposal. All vendors must additionally certify that any violations occurring during the contract term will be reported to the City Official within five days of receiving notice. Vendors with disclosed violations may be required to submit monthly certified payrolls for all contract employees and obtain a wage bond or suitable insurance equal to one year's aggregate gross wages. Vendors subject to state or federal debarment for wage law violations are prohibited from contracting with the City and face potential contract termination upon finding of debarment. Failure to provide the required certification results in bid rejection.
