4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.
3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.
5. Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited.
It is mission critical that CBP procure modern and capable tactical communication trailers and tactical communications vehicle antenna with Nomad Total Command to provide accurate, real-time intelligence for CBP to effectively manage an emerging crisis and execute action plans to address the emergency at present, be it a natural disaster, national emergency, or national security efforts. Deployment of tactical communications fleet is fundamentally https://www.bing.com/ck/a?!&&p=4d564d3d93094af5fe1ed1770c5e96e6ef7539ebffeae759788fd9c4aea5a783JmltdHM9MTc1ODQ5OTIwMA&ptn=3&ver=2&hsh=4&fclid=0ddc4268-9f9d-6a3a-33fe-57929e196b52&u=a1L21hcHM_Jm1lcGk9MH5-RW1iZWRkZWR-QWRkcmVzc19MaW5rJnR5PTE4JnE9Tm9tYWQlMjBHbG9iYWwlMjBDb21tdW5pY2F0aW9uJTIwU29sdXRpb25zJTIwJTI4Tm9tYWQlMjBHQ1MlMjkmc3M9eXBpZC5ZTjUxNXgyMjA2MzQ2OTEmcHBvaXM9NDguMzQ2NzEwMjA1MDc4MTI1Xy0xMTQuMjQyMzg1ODY0MjU3ODFfTm9tYWQlMjBHbG9iYWwlMjBDb21tdW5pY2F0aW9uJTIwU29sdXRpb25zJTIwJTI4Tm9tYWQlMjBHQ1MlMjlfWU41MTV4MjIwNjM0NjkxfiZjcD00OC4zNDY3MX4tMTE0LjI0MjM4NiZ2PTImc1Y9MSZGT1JNPU1QU1JQTA&ntb=1 comprised without the reliable information provided by Nomad Total Command system, jeopardizing mission readiness during a crisis
The tactical communications trailers and tactical communications vehicle antenna must be purchased and installed by the manufacturer Nomad Global Communication Sol Inc. due to production of highly specialized equipment. Nomad builds and integrates custom-engineered, fully integrated IT centric mobile operations centers for government and critical infrastructure sectors equipped with advanced technology. The highly specialized equipment and features include integrated communications suites, mobile operations centers, Nomad Total Command, network and power reliability, and tactical integration. Nomad Total Command is proprietary to Nomad Global Communication Sol Inc. No other company has this system technology. Nomad Total Command is a powerful, automated management system for monitoring and controlling all onboard technology from a single interface. It provides an all-in-one, integrated command and control software solution for mobile operations, offering intelligent routing, robust security, automated safety protocols, and custom user roles to simplify command post operations. This allows Customs and Border Protection to optimize connectivity, enable safe and fast deployment of assets, and provides admins with control over user roles and system visibility to improve decision-making during an emerging crisis.
Additionally, the existing CBP tactical communication fleet is integrated into Nomad Total Command which is fully interoperable with the existing CBP communications and video systems that CBP already uses to effectively manage an emerging crisis. Nomad Total Command is the system built by Nomad to command all aspects of the fleet vehicle start up and shut down as well as maintenance activities. Nomad Total Command Analytics & Reporting System tracks and reports asset and system usage. Utilizing other contractors or systems is a large and high-risk undertaking, leading to major disruptions, increased costs, and challenges in maintaining operational stability. In addition, utilizing less specialized software would have an operational impact in providing less reliable and slower deployments, lack of real-time visibility, increased downtime and maintenance cost, inefficient resource allocation, higher staffing cost, and safety and security risk.
In addition, the installation for the antenna can only be performed by the manufacturer, Nomad GCS, to ensure the modifications are compatible with Nomad Total Command. The antenna provides reliable, secure, signal transmission and reception for Customs and Border Protection operations in demanding environments, ensuring effective command and control, intelligence gathering, and mission-critical data exchange. No other manufacturer can certify that their installation of the required equipment will be compatible with Nomad Total Command because Nomad Total Command is proprietary to Nomad Global Communication Sol Inc. Therefore, the customized build with the requested equipment needs to be performed by the manufacturer (NOMAD) to ensure the trailer is compatible with Nomad Total Command.
