2. Description of Supplies or Services:

The estimated value of the proposed action, including all options, is $737,082.

The requested contract action will provide IT support and maintenance for the Contractor Administrative-

Budget and Financial Management (CAFM) system, Contractor Administrative-Budget and Financial Management II (CAFMII) system, and Contractor Reporting of Operational and Workload Data (CROWD) system.

CAFM, CAFMII, and CROWD are custom-built computer programs developed on a software platform called M204. M204 was first deployed to the public in 1972 by IBM. However, M204 has been surpassed by many other software packages and programming languages, and is antiquated. M204 resources are few and far between.

The IT support and maintenance being procured is primarily for unique skills and ability needed to support the custom programs on the old M204 platform. CAFM is no longer actively being used. CAFMII’s use is very limited and declining. CROWD is being descoped and the remaining functions are being migrated to the CMS Enterprise Portal.

3. Authority:

X :ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.); Title 40 U.S.C. 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception and for each discuss how the cited authority applies in accordance with FAR 8.405-6(c)(2)(iv).

____: An urgent and compelling need exists, and following the procedures would result in unacceptable delays (FAR 8.405-6(a)(1)(i)(A));

X : Only one source is capable of providing the supplies or services required at the level or quality required because the supplies or services are unique or highly specialized (FAR 8.405-6(a)(i)(B)); or

True Point Inc. is the only responsible source who can provide the required service.

CAFM / CAFMII / CROWD is a suite of custom-built computer programs dedicated to managing Medicare Fee-For-Service contractors. Other than the original system developer, no other contractors have ever supported CAFM / CAFMII / CROWD. True Point Inc. has maintained CAFM / CAFMII / CROWD for at least the past fifteen years.

In addition to being the long-term maintainer, True Point Inc. has in depth experience successfully working on the increasingly rare M204 software platform. The last time the CAFM / CAFMII / CROWD contract was recompeted, only True Point Inc. submitted a proposal.

For these reasons, True Point Inc. is uniquely qualified to fulfill the requirements of the Government’s need.

____: In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited sources procedures (FAR 8.405-6(a)(1)(i)(C)); or https://www.acquisition.gov/sites/default/files/current/far/html/Subpart%208_4.html

____: An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer. (FAR 8.405-6(b);

4. Market Research:

Market research is composed of two elements. First and most importantly, the last time the CAFM / CAFMII / CROWD contract was solicited via full and open competition, only True Point Inc. submitted a proposal.

Second, a previous search of the GSA eLibrary Schedule 70 Category 54151S returned zero results for M204.

There are no alternatives to M204 skills and experience for this requirement. M204 is a combined programming language that encompasses input, computing, reporting, and database management capabilities in one package. Modern software platforms, and the resources that support them, do not include all these capabilities under one umbrella and, therefore, work very differently from the unique M204 platform. Modern platforms operate in a much more siloed format – one platform handles input and computing (such as Java, JavaScript, or C++), a different platform handles reporting (such as Tableau or SAS), and a third platform handles the data (usually Oracle). Contractor resources with experience dating back almost 40 years are almost impossible to find due to the passage of time and advances in technology.

5. Actions to Increase Competition:

CMS has initiated projects to move off the CAFM / CAFMII / CROWD systems. The CROWD application is undergoing a migration from the current outdated M204 platform to the CMS Enterprise Portal and will no longer be needed. This will also allow CMS to completely move off M204. Ongoing dependence on M204 based systems is unwise and risky for the reasons noted previously. CMS has chosen to take action to ultimately eliminate these risks and, therefore, has taken no actions to increase competition. Competition will not be necessary.

Best Value Determination. By my signature below, after review of the relevant documents, I have determined that the order subject to this Limited-Sources Justification represents the best value for the Government as set forth in FAR 8.404(d), and constitutes a fair and reasonable price. The basis for my determination is as follows:

The contractor proposed pricing will be compared to an Independent Government Cost Estimate, market research, and historical data to include a comparison with the rates established on their current Federal Supply Schedule contract and the previous task orders. Based on this analysis, the Contracting Officer will negotiate a fair and reasonable price. A further determination will be made by the Contracting Officer that the action represents a fair and reasonable cost to the Government by conducting both a technical and price evaluation as part of a fair and reasonable price determination.

2. Contracting Officer Certification: This is to certify that the justification for the proposed acquisition has been reviewed and that to the best of my knowledge and belief, the information and/or data provided to support the rationale and recommendation for approval, is accurate and complete.
