About this file

This is a Memorandum to the Contract File documenting an approved deviation from the Buy Indian Act for the Indian Health Service (IHS). The deviation authorization references 48 CFR Part 326, Subpart 326.603-3 and IHM 5.5-6, which require IHS to provide preference to Indian Economic Enterprises (IEEs) whenever authorized and practicable.

The specific deviation pertains to procurement request PR # IHS1528870 and involves the acquisition of a new virtual server to manage Omnicell Cabinets at White Earth Health Center. The supporting facts indicate that the facility's current virtual server will reach end-of-life on December 31, 2026, necessitating replacement to securely store controlled substances for pharmacy operations. The deviation was approved because Omnicell is the sole proprietary provider capable of supplying a server that manages Omnicell Cabinets, making competition from IEEs impracticable. The deviation was authorized prior to solicitation issuance for a simplified or commercial item based on the contracting officer's market research determination that no reasonable expectation existed for obtaining competitive offers from two or more qualified IEEs. The document is signed by requestor Winona K. Kitto-S and concurred by Contracting Officer Jennifer L. Richardson-S and Head of Contracting Activity Karen T. Mcdonald-S, with supporting documentation attached for authorization review.

Deviations may be issued prior to or after issuing the solicitation. Please check the appropriate box.

Deviation is authorized prior to issuing the solicitation for simplified or commercial items.

Basis: The Contracting Officer determines, after a thorough market survey/research, that there is no reasonable expectation of obtaining offers that will be competitive in terms of market price, quality, and delivery from two or more reasonable IEEs or at least one such enterprise that does not exceed the dollar threshold in FAR 13.003. The Contracting Officer shall not rely solely on the program for this determination.

Deviation is authorized prior to issuing the solicitation for other than simplified or commercial items.

Basis: The Contracting Officer determines, after a thorough research, that there is no reasonable expectation that offers will be received from two or more responsible IEEs at a reasonable and fair market price. The Contracting Officer shall not rely solely on the program for this determination.

Deviation is authorized after issuing the solicitation for simplified or commercial items.

Basis: Only one offer has been received from a responsible IEE and the price is unreasonable, or no offers have been received from a responsible IEE.
