DMEA# 23-27

6/8/2018

Defense Microelectronics Activity 4234 54th Street, McClellan, CA 95652

SOW # 23-3E5

Brand Name Justification and Approval

1. Agency and Contracting Activity:

Office of Secretary of Defense, Defense Microelectronics Activity (DMEA).

2. Nature/Description of Action:

New firm fixed price contract for Two-Way Radio with Encryption.

3. Description of Supplies/Services:

Procurement of twenty (20) Motorola radios and other supporting equipment. The requirement will be for a base year plus four option years.

4. Authority Cited:

FAR 13.501(a)(1)(ii) Simplified Procedures for Certain Commercial Items; 41 U.S.C. 1901.

5. Reason for Authority Cited:

DMEA requires 20 multi-band portable radios that meet the Federal Information Processing Standards (FIPS) 140-2 Level 3 certificate to increase security measures by providing tamper detection and response mechanisms, secured key fill, Physical Port Separation and encryption.

Without procurement of this product, there is no communication ability for the emergency response team tasked with responding to life-threatening situations on the DMEA Campus.

Motorola radios are required as DMEA/MSC currently has Motorola radios, therefore by acquiring Motorola radios this will enable interoperability between all DMEA buildings/campus.

Radios from other manufacturers will not suffice as connections, ports, peripherals, encryption equipment and frequency differences will not allow for the interoperability between all of DMEA buildings/campus.

6. Efforts to Obtain Competition:

Multiple sources are available to provide this capability, as this brand name item is readily available by secondary sellers. The combined synopsis/solicitation, including this brand name justification, will be posted on SAM.gov as a small business set-aside.

7. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based on the Independent Government Estimate (IGE) and previous purchases.

8. Market Research:

Motorola radios, while attributable via manufacture to the Large Business Motorola Solutions, are readily available on the reseller market. The wired telecommunications arena consists of many options for manufacturers and resellers. Utilizing SAM.gov and NAICS databases to explore recent acquisitions and registered entities, the Contract Specialist found several small and large businesses with the capability to meet this requirement. Moreover, with several small businesses having the capability to meet this need, a small business set-aside is viable.

9. Other Facts:

None.

10. Listing of Sources:

None.

11. Actions to Increase Competition:

No actions have been taken to increase competition, as ample competition exists in the wired telecommunications arena.

12. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
