FAR Subpart 11.105(a)(1)
1. CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Directorate of Contracting, Walla Walla District, Little Goose Lock and Dam project, 1001 Little Goose Dam Rd, Dayton, WA
99328.
2. DESCRIPTION OF THE ACTION: A brand name justification is being sought to procure one (1)
Grundfos KWM.40.265.10.T.60.M46.Z submersible axial mixed-flow pump and accessories required for installation as per the technical specifications.
3. DESCRIPTION OF THE SERVICES/SUPPLIES: The US Army Corps of Engineers, Little Goose
Lock and Dam, Walla Walla District, has a requirement to cool the exit water of the fish ladder at Little
Goose. Currently the fish ladder cooling system is inoperable with no functional critical spares. The intent of this action is to procure an additional pump to return this critical system to service. The estimated cost of this purchase is $355,485.00.
4. AUTHORITY CITED:
FAR 11.105(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.
FAR 13.501(a)(2)(i), Special documentation requirements. Sole Source (including brand name) acquisitions. Justifications and approvals are required under this subpart for sole-source (including brand name) acquisitions or portions of an acquisition requiring a brand name. If the justification is to cover only the portion of the acquisition which is brand name, then it should so sate; the approval level requirements will then only apply to that portion. For a proposed contract exceeding the simplified acquisition threshold, but not exceeding $750,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.
5. REASON FOR AUTHORITY CITED: It is essential that equipment procured through this action be installed without modification to submerged structures. Such modification would render existing
Government equipment, once repaired, unusable. Equipment procured through this action must be immediately swappable with existing spares to ensure continuous and adequate cooling of water entering the fish ladder. It must be designed for installation and operation with a 40” Grundfos KWM seat ring which is permanently installed as part of the submerged structure. The existing power and control system is designed for Grundfos IO113 and SM113 control modules meaning the new pump must be fully compatible with the Grundfos control methodology. No other manufacturer’s equipment meets these requirements.
6. EFFORTS TO OBTAIN COMPETITION: This procurement action is for an interchangeable spare of the same manufacture as existing Government equipment. Products of other manufacturers were reviewed for compatibility and replacement feasibility. While competitors offer similar products, none were found to provide increased value to the Government. Installing equipment of differing manufacture would require structural modification to the permanently submerged structure or design and installation of an entirely separate structure. The more basic of the noted modifications are estimated to cost
$145,900 in addition to equipment procurement costs. Equipment downtime, to the extent anticipated, may negatively affect fish passage and potentially expose the Government to related lawsuits. For comparison, replacement of like-in-kind equipment is estimated to take one-half day and cost $1,960.
7. DETERMINATION OF FAIR AND REASONABLE COSTS:
When compared with overall ownership costs and risks outlined in section six above, the direct replacement cost identified in section three above is determined to be fair and reasonable.
8. MARKET RESEARCH: Reviewed cost and feasibility of procuring and installing equipment from alternate manufacturers. Though similar products are available, procuring a pump of differing manufacture represents a significant increase in the total cost of ownership as well as recovery time in the event of equipment failure as outlined in section six above.
