NON-EXCLUSION AFFIDAVIT - SYSTEM FOR AWARD MANAGEMENT (SAM)
Federal, state, and local government agencies, non-profits, and other organizations that use federal money to fund all or part of any program or project are required to follow specific requirements regarding the use of such federal funds. One of these requirements is that no contract, subcontract, grant, financial assistance, or other forms of assistance provided using federal funds may be awarded to individuals or entities that have been suspended, debarred, or otherwise excluded from participation in federally funded programs.
The U.S. federal government maintains a website known as the “System for Award Management” (SAM) at www.sam.gov. One of the purposes of the SAM website is to provide a comprehensive list of all individuals, firms, and other entities that have been suspended, debarred, or otherwise excluded from participation in federally funded contracts, subcontracts, grants, etc. SAM provides a simple means of helping government, non-profit agencies, and other organizations ensure that they do not award federally-funded grants, contracts, subcontracts, or other financial or non-financial benefits to any individual, firm, or other entity that has been excluded by any agency from participation in such federally funded activities.
I, (Contractor Representative), hereby certify that neither I nor
(Name of the company or organization I represent), nor any subcontractors that I or said company may employ to work on any federally funded activity have been suspended, debarred, or otherwise excluded by any federal agency from participation in any federally funded activity. I further acknowledge my understanding that, before entering into a contract with me or with the company or organization I represent, City of Sachse staff will perform a search on www.sam.gov to verify whether I, the organization
I represent, or any subcontractors I may employ to work on any federally funded activity, have been excluded from participation in any federally funded activity.

BIDDER’S QUALIFICATION INFORMATION
1. Per Texas Government Code Chapter 2269, this project will be bid through Competitive
Sealed Proposals. Any references in the contract documents to “bid(s)” “bid bond”, “bidders”, etc. shall be interpreted as referring to these documents and the required documentations related to this Competitive Sealed Proposal. The evaluation process and criteria for ranking order of negotiations shall follow the guidelines below.
2. The City shall convene a Proposal Evaluations Committee (the “Committee”) for this project using Competitive Sealed Proposal method of procurement. The Committee shall evaluate all submitted bids and rank the bids in order for negotiations.
3. The Committee shall consist of the City Director of Public Works, the City Inspector, and the
City’s design consultant, or other designated representatives
4. The Committee shall use the following procedures to evaluate bids:
4.1. As soon a reasonably possible following the public opening of bids, the City will conduct a preliminary examination of each bid for compliance with the published requirements.
4.2. The Committee shall meet to conduct thorough discussions and evaluations of all bids
4.3. The Committee shall produce a ranking of bidders in the order of best value to the City.
4.4. The Committee shall base its recommended ranking on the information provided in the bids, reference checks, and from personal knowledge. Unless modified by addendum prior to the opening of bids, the Committee will utilize the following criteria to rank bids
4.4.1. Proposed contract amount (50%). Costs that are under the estimated budget for the project by a significant amount may indicate a lack of full understanding of the scope of work; poor estimating practices, or use of less experienced labor to accomplish the work. Costs that are significantly over the estimate may result in the City investing more than necessary for the work. An engineer’s opinion of probable construction cost (“OPCC”) is included in the bid materials.
4.4.2. Qualifications of Key Project Personnel (10%). The bid should include a list of key company personnel and their relevant experience in the industry as well as a five-year employment history. Five years’ experience in the field should be considered an absolute minimum to qualify for the job. While employment stability with a single firm is very important, the overall experience in the industry is equally important. Both will be considered in the evaluation
4.4.3. Similar Project Experience Both Past and In Progress (10%). The bid should include a list of at least five (5) similar projects over the last five years as well as a list of work currently in progress. A bidder who has not completed at least one project per year may not possess the experience and resources to complete the specified work at a competitive cost. A bidder with no work currently underway or planned to begin this year may raise a concern. Similar project experience shall include.
Page 27 of 123 Williford Road Reconstruction, BP-21-B03
4.4.3.1. Complex Project Construction Phasing and Milestones
4.4.3.2. Roadway Construction of an arterial road or higher classification of at least one (1) mile in continuous length including water, sanitary, and storm installation.
4.4.3.3. Water and Sanitary Sewer Installations within an existing ROW including avoidance of utility conflicts. Experience with twenty foot (20’) deep sanitary sewer systems is preferred.
4.4.3.4. Crossing Culvert, Headwall, Storm Drain and Inlet Construction
4.4.4. Quality of the Bidder’s Goods and Services (10%). This includes an evaluation of previous projects and references that can have a number of issues that ultimately can become critical to a successful project. The following items should be considered in evaluating this point.
4.4.4.1. The bidder’s ability to maintain a project schedule and meet specified milestones
4.4.4.2. The bidder’s suggestion to improve upon the TCP methodology that would reduce construction time and cost.
4.4.4.3. The bidder’s suggestions of proposed methods for installing the storm drainage and water/sanitary sewer utilities with minimal service interruption.
4.4.5. Project Delivery Schedule, to include shop drawings and material procurement, a work breakdown of the proposed phases of work, and sufficient detail to evaluate the bidders work plan to demonstrate final completion of the work within the allowable contract time. This includes a phasing plan and evaluation of any construction duration time savings (10%)
4.4.6. Reputation of the bidder, including familiarity of the City and Design Engineer with the Bidder (5%)
4.4.7. Inclusion of Historically Underutilized Businesses (5%)
