About this file
This is an Anti-Sweatshop Certification Form (BOP-1302) required by the Commonwealth of Pennsylvania under Executive Order 2004-4 for the PSP Shoulder Patches contract opportunity. The form mandates that contractors certify compliance with labor standards for any apparel manufacturing or laundering activities associated with their bid submission. Contractors must declare that employees will be paid at least the Poverty Threshold wage (defined as the federal poverty threshold for a family of three plus 20 percent if health benefits are not provided, adjusted for non-U.S. facilities using purchasing power parity) and provided working conditions meeting International Labor Organization standards for forced labor, child labor, wage payment, hours of work, occupational health and safety, and nondiscrimination. Alternatively, contractors may certify that a collective bargaining agreement is in effect with union representation at the manufacturing facility. The certification requires submission of a detailed list of all proposed manufacturing and laundering facilities, including subcontractors, subsidiary, and affiliated corporations, with business names, addresses, and contact information. Questions regarding the bid must be submitted by August 6, 2026 at 11:00 a.m., and all bids must be submitted electronically through the PA Supplier Portal at www.pasupplierportal.state.pa.us.
Contractors must allow Commonwealth representatives reasonable access to facilities during normal business hours to verify the representations made in the certification and provide all requested documentation. Any changes to listed facilities must be reported to the Contracting Officer in writing within seven business days and cannot be implemented without approval. The Commonwealth reserves the right to share all certification information provided by contractors with the public. Misstatements in the certification are treated as fraudulent concealment under Section 4904 of the Pennsylvania Crimes Code and may result in legal or equitable proceedings, with contractors liable for associated Commonwealth costs and expenses. The form applies to apparel defined as products manufactured, woven, cut, sewn, or similarly processed from fabrics, leather, or cloth for use as clothing, shoes, or other attire.
