IV. Statutory authority permitting other than full and open competition.
AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
This is a brand name only (BNO) requirement for three Yaskawa 300 HP480v variable frequency drives with a part number of CIMR-PU4A0362AAA. There are multiple vendors that carry the required drives.
Procuring the BNO drives would be in the best interest of the Government. 804 TSS/TSSS currently has Yaskawa drives.
The new drives can work the existing drives. Purchasing Yaskawa drives would reduce the costs for installation and commissioning by copying the software from the existing Yaskawa drives to the new ones. This copying capability is only available for the same manufacturer and model. Additionally, commissioning requires an outside vendor to setup the driver, which requires planning with the testing schedule. Learning the new operating procedures of any non-name brand would require a significant amount of time to assess and calibrate the specific driver parameters to support the mission. Commissioning is more strenuous on the location for electricity consumption as well. In 2021, one drive was commissioned for $23,572.00, which does not include in-house expenses.
Furthermore, the Government will have several benefits by using the same brand. One benefit is there will be increased commonality between the drives for troubleshooting issues. When a drive needs maintenance the parts are interchangeable to allow for continued mission support. The drives have an anticipated life usage of 20 years before they need to be replaced. Thus, it does not make sense for the Government to store spare parts or drives with the minimal space available.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The requirement cannot be fulfilled by required sources IAW FAR Part 8 or existing contracts. Market research indicates there are multiple small business vendors that can meet the BNO requirement. The Government will solicit this commercial off the shelf (COTS) requirement as a 100% small business set-aside on sam.gov to promote competition, to the maximum extent practicable.
The Buy American statue is applicable to this supply buy. In accordance with (IAW) DFARS 252.225-7000(b)(2), qualifying country end products are considered domestic products. The Yaskawa drives are manufactured in a qualifying country, Japan.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer anticipates price fair and reasonable for this acquisition as there is a reasonable expectation that there will be competition. Price fair and reasonable will be determined using other than certified cost or pricing data by utilizing FAR 13.106-3 procedures prior to awarding the contract. The Government will evaluate technical acceptability on a pass/fail basis. This will ensure the final contract price will be fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted IAW FAR Part 10. Market research shows this BNO requirement is commercial specifically COTS. Alternative drives would cause duplicative costs, thus the Government did not look into alternative drives. For copying existing commissioning data the drive must be the same product be manufactured by the same company.
The requirement cannot be fulfilled by AbilityOne, enterprise vehicles, or Federal Prison Industries, Inc. Market research indicates there are multiple small business vendors that can meet the BNO requirement. The Government will solicit this commercial off the shelf (COTS) requirement as a small business set-aside on sam.gov.
The Buy American statue is applicable to this buy and Yaskawa drives are manufactured in Japan, a qualifying country.
One drive was procured by NAS in 2021, which required required the removal of the old drive and installation of the new drive. The commissioning cost $23,572, however the price of the drive itself from 2021 is unknown.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
Not applicable.
X. List of any sources that expressed, in writing, an interest in the acquisition.
Tennessee Electric Motor Co., Southern Controls, Inc., Precision Electric, Inc., Mechanical Resource Group LLC DBA Fruetel Associates expressed interest in the requirement.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
It is unlikely that industry practices will change for cross-commissioning due to the unique parameters established by each manufacturer. When new Yaskawa drives are needed, the Government will conduct market research to determine the most appropriate path to meet the mission.
