Time is of the essence in the completion of the Work. Work shall be commenced within ten (10) Working Days of the date stated in the District’s Notice to Proceed and shall be completed by Contractor in 20 working days as specified in the Contract Documents. The District is under no obligation to consider early completion of the Project; and the Contract completion date shall not be amended by the District’s receipt or acceptance of the Contractor’s proposed earlier completion date. Furthermore, Contractor shall not, under any circumstances, receive additional compensation from the District (including but not limited to indirect, general, administrative or other forms of overhead costs) for the period between the time of earlier completion proposed by the Contractor and the Contract completion date. If the Work is not completed as stated in the Contract Documents, it is understood that the District will suffer damage. In accordance with Government Code section 53069.85, being impractical and infeasible to determine the amount of actual damage, it is agreed that Contractor shall pay to the District $500/day as fixed and liquidated damages, and not as a penalty, the sum stipulated in the Contract for each working day of delay until the Work is fully completed. Contractor and its surety shall be liable for any liquidated damages. Any money due or to become due the Contractor may be retained to cover liquidated damages.

2. Compensation for ceasing operations (demobilization) and resuming operations (mobilization) after inclement weather shall be considered as included in the prices paid for the various contract items of Work involved as specified in Section 8-3, “Work to be Done without Direct Payment,” of the Standard Construction Specifications and therefore no additional compensation shall be allowed.
3. Contractor shall abide by the Engineer’s determination of what constitutes inclement weather.
Time extensions for inclement weather shall only be granted when the work stopped during inclement weather is on the critical path of the Project schedule.
4. Extension of Time.
A. Contractor shall not be charged liquidated damages because of any delays in completion of the Work due to unforeseeable causes beyond their control.
