About this file
This document is a Sole Source Justification Memorandum for the Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center Panama City Division. The procurement is for SDV MK11 Tad Pole Assemblies from Teledyne Brown Engineering, Inc., involving 6 top assemblies, 6 side assemblies, and 10 bottom assemblies, along with associated packing and shipping costs. The total acquisition will be conducted using simplified acquisition procedures with a total dollar value above micropurchase levels but not exceeding the simplified acquisition threshold.
The justification for sole source is based on the unique manufacturing history of these assemblies, which were custom-produced by Teledyne Brown Engineering specifically for the SDV. The document notes that no other manufacturers have been vetted or approved for substitution, and the costs and time required to identify, evaluate, and field-test alternative systems would be prohibitively expensive. The items are to be delivered within 6 months after order award, and the purchase will be synopsized on the sam.gov Contract Opportunities website. The Contracting Officer has determined this represents the best value considering price, special features, and administrative costs.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
The Naval Surface Warfare Center Panama City Division (NSWC PCD) has a requirement to procure SDV MK11 Tad Pole Assemblies. This requirement is not suitable for full and open competition for the following reason(s): The MK11 Tad Pole Assemblies referenced in the subject purchase request were custom manufactured by Teledyne Brown Engineering Inc. for the SDV.
Other manufacturers of similar assemblies have not been vetted or approved for substitution. The additional costs and time delays for the Government to identify and evaluate another system;
perform the field-testing of the equipment; and produce the required documentation and drawings would be prohibitive. As such, Teledyne Brown Engineering Inc. is the only source capable of meeting this requirement.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The purchase will be synopsized on the Contract Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Teledyne Brown Engineering, Inc. to provide the products.
7. Any other facts supporting the justification. None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Teledyne Brown Engineering, Inc. is the only source that can meet the requirement.
