SYNOPSIS:

PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE

THAT WILL BE ISSUED. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.

The U.S. Department of the Interior (DOI), Bureau of Safety and Environmental Enforcement (BSEE), on has a requirement for COVID-19 Screening Services in Camarillo, California at the locations identified in Section 2 of this requirement The estimated period of performance for this requirement is ninety (90) days from date of award with the potential of four (4) ninety (90) day option periods and two optional tasks associated with the base and option periods.

The purpose of this combined synopsis/solicitation is to solicit quotes as described in the attached solicitation. The Government anticipates awarding a Firm-Fixed-Price (FPP) Purchase Order. This procurement is being conducted in accordance with FAR Part 13, "Simplified Acquisition Procedures". The North American Industrial Classification Systems (NAICS) code is 624230, Emergency and Other Relief Services, with a small business size standard of $35.0 million.

All potential offerors must be registered in the System for Award Management (SAM) (www.sam.gov) in order to receive Government contracts.

SECTION 1

PRICING

1.1 GENERAL INFORMATION

This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13.5, "Simplified Procedures for Certain Commercial Items". The North American Industry Classification System (NAICS) code for this requirement 624230, Emergency and Other Relief Services, with a small business size standard of $35.0 million. The Bureau of Safety and Environmental Enforcement (BSEE) intends to award a Firm Fixed Price (FFP) Purchase Order, for the project titled, “COVID-19 Screening Services”, as specified under Section 2, Statement of Work.

1.2 CONTRACT LINE ITEM/PRICING

The descriptions of the Contract Line Item Numbers (CLINs) are described below. CLINs 00030, 00130, 00230, 00330, and 00430 for Optional Task 2: Level III Screening Services are Indefinite Quantity Fixed-Price per Unit not-to-exceed (NTE) CLINs. All other CLINs are Firm- Fixed-Price.

1.3 PARTIAL DELIVERY PAYMENT SCHEDULE

Payments will be made under this contract based on: 1) The delivery and rendering of service by the contractor to the Government and the acceptance of service by the Government; 2) Providing the monthly status report in accordance with Section 2.4.3; and 3) The submission of properly certified invoices by the contractor to the Government and the receipt, review and approval of properly certified invoices by the Government. The Contractor shall apply terms similar to this section to any payments to its subcontractors.

SECTION 2

STATEMENT OF WORK

2.1 BACKGROUND

The United States Department of the Interior (DOI), Bureau of Safety and Environmental Enforcement (BSEE), has a need for COVID-19 screening for the bureau inspectors and pilots flying out of the Pacific Region at the following locations:

• Camarillo Regional Office – 760 Paseo Camarillo, Suite 102; Camarillo, CA 93010

• OPTIONAL TASK 1 – Camarillo Airport- 305 Durley Ave., Camarillo, CA 93010

Inspectors located in the BSEE Camarillo Regional Office fly from the Camarillo Airport to multiple oil platform sites daily (7 days a week, Monday – Sunday) between the hours of 8:00 AM and 11: AM. The Government requires COVID-19 screening at the locations listed above in response to the Novel Coronavirus (COVID-19) pandemic to ensure inspectors are not ill prior to boarding flights in route to the oil platform sites. The Government has approximately 1-2 inspectors that fly from the Camarillo Airport to the oil platform sights daily. The Government has 1 pilot that flies from the Camarillo Airport to the oil platform sights daily.

2.2 OBJECTIVE

The Government has a requirement to acquire COVID-19 screening at the primary site listed in Section 1.1 with the potential of expanding to the optional site if necessary. The contractor shall provide testing for the estimated 2-3 BSEE Inspectors at one location. The order will consist of a base period of 90 days with the potential for four 90-day option periods. The breakdown of estimated personnel per location is as follows:

• Camarillo – 1 to 2 inspectors per day, 1 pilot per day

• OPTIONAL TASK 1 : Camarillo Airport - 1 to 2 inspectors per day, 1 pilot per day

2.3 SCOPE

The scope of this order is to have COVID-19 screening services for an estimated 2-3 people for one location listed in section 1.2 above. The Camarillo Office location has a parking lot, restrooms and offices that can be utilized for screening and isolation. The Camarillo Airport location has a parking lot, hangar and lounge that can be utilized for screening isolation. The contractor shall provide the following items/services at the screening site:

• High-Risk Evaluator

• Basic Life Support Package

• Influenza Test Strips

• Data Collection Device

2.3.1 Optional Task 1

The contractor shall perform COVID-19 pre-screening services as described in the Scope of Services above. If it is determined that COVID-19 pre-screening services are needed at this location, The Government may at its sole discretion exercise Optional Task 1.

2.3.2 Optional Task 2 - COVID-19 Level III Screening Services

The Contractor shall perform COVID-19 Level III Screening Services at Camarillo District Office, and the Camarillo Airport at locations described in section 1.1. BSEE personnel and the contractor will follow the guidelines at each site:

• BSEE Inspector(s) will be self-quarantined for 5 days before pre-screening.

• BSEE Inspector(s) will report to their designated location and submit to the COVID-19 screening questionnaire including a body temperature and be tested for COVID 19 (FDA approved PCR Nasal Swab) after being self-quarantined for 5 days by BSEE’S contracted medical professional. BSEE Inspector(s) will remain in their vehicle and BSEE’s contracted medical professional will come out and perform the test. BSEE Inspector(s) will return home to continue self-quarantine while awaiting results. The contracted medical professional will provide the results of the PCR results within 24 hours via phone call and email with lab results to each BSEE Inspector.

• After receiving a negative result of the PCR test, the BSEE Inspector(s) shall report to the heliport, submit to the COVID-19 screening questionnaire including body temperature and a COVID-19 Serology Test (FDA Approved Blood Test). BSEE Inspector(s) will remain in their vehicle and BSEE’s contracted medical professional will come out and perform the test. BSEE Inspector(s) will remain in their vehicle until receiving negative confirmation.

• Once the BSEE Inspector(s) has received negative results from all tests, the BSEE contracted medical professional will issue an official HIPPA compliant letter stating BSEE Inspector(s) are negative for COVID-19, and BSEE Inspector(s) may report to the helicopter for travel.

2.4 MEETINGS, REPORTS, AND OTHER DELIVERABLES

2.4.1 Daily Reports

The contractor shall complete the government furnished BSEE FORM A. The form shall be completed daily for each inspector that undergoes COVID-19 screening.

2.4.2 Weekly Status Reports

Number of personnel tested per day by location and status (not by name and status of cleared/not cleared). Immediate notification upon a presumptive positive with location, patient name and follow on actions taken (where was he/she transported and how).

2.4.3 Monthly Status Reports

The Contractor shall prepare and submit status reports every month. The reports shall be in sufficient detail to describe all work accomplished and results achieved during the month and shall include a brief discussion of the planned actions for the succeeding month. The information requested in the weekly status report should also be included in the monthly report.

2.4.4 Correspondence

All correspondence shall be clearly marked with the contract number on the first page. Emails pertaining to this contract shall be sent and shall include the contract number on the subject line.

2.4.5 Project Lead/Project Manager

The Contractor shall provide a Project Lead/Project Manager to facilitate BSEE-Contractor communications. The Project Lead shall be the primary technical and managerial interface between the Contractor and Contracting Officer (CO) and the Contracting Officer’s Representative (COR) located at the Camarillo Regional Office Building, 760 Paseo Camarillo, Suite 102, Camarillo CA.

2.4.6 Quality Assurance

The COR will review, for completeness, preliminary or draft documentation that the Contractor submits, and may return it to the Contractor for correction. Absence of any comments by the COR will not relieve the Contractor of the responsibility for complying with the requirements of this SOW. Final approval and acceptance of documentation required herein shall be by letter of approval and acceptance by COR. The Contractor shall not construe any letter of acknowledgment of receipt material as a waiver of review, or as an acknowledgment that the material is in conformance with this work statement. Any approval given during preparation of the documentation, or approval for shipment shall not guarantee the final acceptance of the completed documentation.

2.4.7 Administrative Considerations Correspondence

To promote timely and effective administration, correspondence including invoices (that which proposes or otherwise involves waivers, deviations or modifications to the requirements, terms or conditions of this SOW) shall be addressed to the Contracting Officer’s Technical Representative (COR) with an information copy to the Contracting Officer (CO).

SECTION 3

GENERAL PURCHASE ORDER TERMS AND CONDITIONS

3.1 TYPE OF ORDER

The Bureau of Safety and Environmental Enforcement (BSEE), anticipates a Firm-Fixed-Priced (FFP) Purchase Order which also includes Indefinite Quantity Fixed-Price Per Unit Optional CLINs with not-to-exceed (NTE) established ceilings.

3.2 PERIOD OF PERFORMANCE

The estimated period of performance is as follows:

The exercising of any of the option period(s) is contingent upon successful performance, availability of funds and the needs of the Government. All terms and conditions applicable to the base period shall extend to the option period(s) unless otherwise agreed upon.

3.3 PLACE OF PERFORMANCE

The contractor shall provide services for the base period and each option period at the following required locations with the potential of the Government exercising optional tasks for the Optional Locations.

3.5 CONTRACTOR PROJECT MANAGER

The Contractor shall be responsible for managing and overseeing the activities of all Contractor personnel, as well as subcontractor efforts used in performance of this contract. The Contractor’s management responsibilities shall include all the activities necessary to ensure the accomplishment of timely and effective support, performed in accordance with the requirements contained herein.

The Contractor shall provide a Project Manager (PM) to facilitate Government-Contractor communications. The PM shall be the primary technical and managerial interface between the Contractor and CO and COR. The Contractor’s Project Manager shall meet with the COR as necessary to maintain satisfactory performance and to resolve other issues pertaining to the contract. A mutual effort shall be made at these meetings to resolve any and all identified problems. Written minutes of the meetings shall be prepared by the Contractor and signed by the Contractor’s designated Project Manager.

3.6 NON-PERSONAL SERVICES

This contract is a “non-personal services contract” as defined in FAR 37.101 under which the personnel rendering the services are not subject, either by the order’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.

Personnel assigned to render services under this contract shall at all times be employees of the Contractor (or a subcontractor) and under the direction and control of the Contractor.

Notwithstanding any other provisions of this order, the contractor shall at all times be responsible for the supervision of its employees in the performance of the services required hereunder.

The Contractor and/or the Contractor’s employees: (1) shall perform the services specified herein as an independent contractor, not as employees of the government; (2) shall be responsible for management and administration of the work required and bear sole responsibility for complying

140E0120Q0085-COVID-19 Screening Services-Camarillo, CA Page 13 of 35 with any and all technical, schedule, or financial requirements or constraints attendant to the performance of this contract; (3) shall be free from supervision or control by any government employee with respect to the manner or method of performance of the services specified; but (4) shall, pursuant to the government’s right and obligation to inspect, accept or reject the work, comply with such general direction of the CO, or the duly authorized representative of the CO, as is necessary to ensure accomplishment of the contract objectives.

If the Contractor finds clarification necessary with respect to the scope of services to be performed or the manner in which the services are to be performed hereunder, the Contractor shall request clarification from the CO in writing.

Employees of the Contractor (or a subcontractor) must make clear, in dealings with the public, federal employees, or other contractors, that they are not federal employees. To minimize possible confusion, the Contractor’s (or subcontractor) employees are not permitted to wear clothing or other items, apart from the official identity credential, bearing the name, logo, or seal of the Government agency while performing work under this contract.

3.7 ADVERTISTING OF AWARD

The Contractor shall not refer to this award in commercial advertising, or similar promotions in such a manner as to state or to imply that the product or services provided is endorsed, preferred, or is considered superior to other products or services by the Department of the Interior (DOI), Bureau of Safety and Environmental Enforcement (BSEE). This includes advertising, or similar promotions in all forms or electronic, broadcast and print media.

In addition, the Contractor is restricted from reproducing the image(s) of the Department of the Interior/Bureau of Safety and Environmental Enforcement, in any form of commercial advertising, or similar promotion. This includes images of official seals and buildings. The reproduction of official seals and the images of buildings is a matter controlled by regulation and Executive order.

Any proposed usage of such symbols must be brought to the attention of the Contracting Officer.

3.8 DATA USE, DISCLOSURE OF INFORMATION, AND HANDLING OF

SENSITIVE INFORMATION

The Contractor shall maintain, transmit, retain in strictest confidence, and prevent the unauthorized duplication, use, and disclosure of information. The Contractor shall provide information only to employees, Contractors, and subcontractors having a need to know such information in the performance of their duties for this project.

Information made available to the Contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the CO.

If public information is provided to the Contractor for use in performance or administration of this effort, the Contractor except with the written permission of the CO may not use such information for any other purpose.

If the Contractor is uncertain about the availability or proposed use of information provided for the performance or administration, the Contractor will consult with the COR regarding use of that information for other purposes.

The Contractor agrees to assume responsibility for protecting the confidentiality of Government records which are not public information. Each employee of the Contractor to whom information may be made available or disclosed shall be notified in writing by the Contractor that such information may be disclosed only for a purpose and to the extent authorized herein. Each employee shall sign the non-disclosure agreement form as provided at Attachment 3, and the Contractor shall submit the signed form to the CO prior to the employee’s information access.

Performance of this effort may require the Contractor to access and use data and information proprietary to a Government agency or Government contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the Government and/or others.

Contractor and/or contractor personnel shall not divulge or release data or information developed or obtained in performance of this effort, until made public by the Government, except to authorized Government personnel or upon written approval of the CO. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the Contractor without such limitations or prohibit an agreement at no cost to the Government between the Contractor and the data owner that provides for greater rights to the Contractor. All data received, processed, evaluated, loaded, and/or created as a result of this task order shall remain the sole property of the Government unless specific exception is granted by the

CO.

3.9 INVOICING REQUIREMENT

The Contractor may invoice on a monthly basis for all work completed in the prior month in accordance with Section 1.3; however a Monthly Report must be submitted as a condition of payment in accordance with the requirements as detailed in Section 2.4.3 Monthly Report and via Section 3.9.1 below after the monthly report is accepted by the COR.

For Optional Task 2 under each period: Invoices shall be submitted for the Fixed Price per Unit line item for COVID-19 Level III testing NTE the amount for each period per CLIN (CLINS 00030, 00130, 00230, 00330 and 00430) after the testing has been purchased.

3.9.1 DOI-AAAP-00028, ELECTRONIC INVOICING AND PAYMENT

REQUIREMENTS – INVOICE PROCESSING PLATFORM (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

• Documentation required by FAR 32.905(b) for all Firm Fixed Price CLINS;

• For CLINS 00030, 00130, 00230, 00330 and 00430 details of which tests were purchased and a copy of the rate for the test kits purchased from the manufacturer.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 - 5 business days of the contract award date.

Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP tor submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

3.10 DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence.

Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the

COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

3.11 CONTRACTOR’S QUOTE

The Contractor’s quote may be incorporated by reference into the purchase order. Any inconsistencies or in event of a conflict between terms and conditions of the purchase order and the contractor’s quote shall be resolved by giving precedence to the terms and conditions of the purchase order.

3.12 CLAUSES INCORPORATED BY REFERENCE:

In accordance with FAR 52.252-2, this solicitation incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. 3.14 FAR 52.217-8 - OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

3.15 FAR 52.217-9 – OPTION TO EXTEND THE TERM OF THE CONTRACT

(MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor prior to the end of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 5 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed one year and six months.

3.16 FAR 52.252-6 - AUTHORIZED DEVIATIONS IN CLUASES (APR 1984)

(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the clause.

3.18 SECTION 508 OF THE REHABILITION ACT

Section 508 of the Rehabilitation Act of 1973 (found at 29 U.S.C. 794d) requires access to and use of information by individuals with disabilities. A deliverable such as electronic reports (ex:

PDF files) to be placed on the web (either on the agency’s web server or the company’s), video footage, or other electronic data such as CD-ROMs to be distributed, are subject to Section 508 guidelines. Simplified, this means that PDF files need to be formatted so that they are “readable” by assistive technology devices such as screen readers. Video footage must be closed captioned.

CD-ROMs which contain HTML, PDF, or word processor files must be accessible.
