SPECIAL INSTRUCTIONS,

GROUP NO. 5, HAWAIʻI

Providing for the Survey of Certain Lots of the Villages of Laʻiʻopua, Phase 1, Kealakehe, District of North Kona, Island of Hawaiʻi, State of Hawaiʻi

In the execution of the surveys included under Group No. 5, Hawaiʻi, the Land Surveyor is authorized and directed to make the described examinations, retracements, reestablishment of points of control, surveys, and resurveys set out in these instructions. The Manual of Surveying Instructions 2009, the policies of the California and Hawaiʻi Branch of Cadastral Survey, and the provisions of these Special Instructions will guide the Land Surveyor. The Land Surveyor will also be guided by such supplemental special instructions as may be issued pursuant to the report of complications developed during the progress of the work or due to additional authorization.

AUTHORITY

Approval of these instructions provides the necessary authority to proceed with the described fieldwork.

See the Request for Cadastral Survey from Kaiini “Kimo” Kaloi, ESQ, Director, Office of Native Hawaiian Relations, dated November 15, 2023.

APPROPRIATION

The cost of the work incurred in the execution of the surveys herein, within approved official regulations, is payable from funds provided by the Office of Native Hawaiian Relations.

LIMIT AND CHARACTER OF WORK

The fieldwork embraced in this authorization is limited to the survey of Lots A, B and C-1, and Lot 1 within the boundaries of Lot A, being a portion of the Villages of Laʻiʻopua, Phase 1, File Plan 2128.

This survey project is to survey the exterior boundaries of the Trust lands per the report entitled “Survey Needs for the Hawaiian Home Lands”, issued by the Bureau of Land Management of the Department of the Interior, and dated January 1991, as stated in “The Hawaiian Home Lands Recovery Act,” 109 Stat.

357, signed on November 2, 1995.

A Land Surveyor Report (LSR), “Land Surveyor Report for Kealakehe Site 2” dated December 23, 2019 was completed and certified April 18, 2024, with a determination that a boundary survey is required. This survey would aid in the preservation and protection of the physical location of the exterior boundaries, determine the existence and extent of potential encroachments along the exterior boundaries, and provide

USDI/BLM Special Instructions - Group No. 5, Hawaiʻi California and Hawaiʻi Island of Hawaiʻi, State of Hawaiʻi updated measurements, areas, and survey records for future management and protection of the Hawaiian Home Lands.

The law prescribes the chain as the unit of linear measure for the survey of public lands. (Manual, 2-42) In the Inter-Agency Agreement/Inter-Departmental Agreement Statement of Work, amended May 17, 2023, (item 6. (six) minimum requirements) in part states the following: “All survey records and deeds for the state of Hawaii since territorial time have been in feet. This negates and overrides the need to introduce a different unit of measure (chain) into the survey records for Hawaii.”

Retracement or resurvey of adjacent survey lines needed in the development of control or verification is authorized.

HISTORY OF SURVEYS

There are no public land surveys of the area.

Local data pertinent to the survey, including recorded and unrecorded private surveys, and local government surveys, will be obtained and analyzed before starting the fieldwork.

METHOD AND ORDER OF PROCEDURE

A dependent resurvey of the exterior boundaries of Lots A, B and C-1, and Lot 1 within the boundaries of Lot A, being a portion of the Villages of Laʻiʻopua, Phase 1 will be performed to recover and document all physical evidence relating to the location of the boundaries for portions of Hawaiian Home Lands in Kealakehe.

A certain easement in Lot A will be located and depicted on the plat.

The true boundary when determined will be physically monumented. Monuments will be placed at each angle break on the exterior boundary, except along watercourses and seashores.

The distance between monuments on exterior boundaries will not exceed one mile and an intermediate monument, a witness point, will be set.

A closure will be formed on all lines of this survey. The project lines may be surveyed with GPS equipment, conventional survey equipment, or a combination of the two. The maximum acceptable error-of-closure ratio using conventional survey methods for surveyed lines will be one part in five thousand (1:5,000). All GPS measurements will conform to the procedures set forth in the Permanent Instructional Memorandum (PIM) No. 2020-004, “Guidelines for the Use of Global Navigation Satellite Systems (GNSS) in Cadastral Surveys” and “Standards for Positional Accuracy for Cadastral Surveys Conducted Using GNSS,” dated April 1, 2020.

FIELD NOTES, PLATS, AND REPORTS

The survey record will conform to the Manual of Surveying Instructions 2009 and contain a summarized account of the technical details of the entire procedure. It will provide the accurate course and length of each line surveyed, and a comprehensive record of how each corner position was determined.

USDI/BLM Special Instructions - Group No. 5, Hawaiʻi California and Hawaiʻi Island of Hawaiʻi, State of Hawaiʻi

All aspects of the surveys, including field notes and sketch plats, will be done according to policies of the California and Hawaiʻi Branch of Cadastral Survey. Bearings will be returned in azimuths orientated to due South. The sketch plats (Manual, 3-225), form the basis of the official plat, which is a complete graphic representation of the Trust lands surveyed. Upon completion of the fieldwork, the field notes and sketch plats will be submitted to this office for approval. The finalized record will be transmitted to the Chief Cadastral Surveyor for approval and acceptance.

The assigned Contracting Officer’s Representative (COR)/Project Inspector (PI) will perform an on the ground inspection of the project prior to the Chief Cadastral Surveyor’s final signatures.

California and Hawaii Branch of Cadastral Survey reserves the right to send a survey crew to the project if there are any questions the contractor cannot answer to the satisfaction of the Branch of Cadastral Survey.

MODIFICATION OF INSTRUCTIONS

Should an occasion develop which demands additional instruction, requires an interpretation of these instructions, or which makes these instructions inapplicable as prepared, the Land Surveyor will submit a report of the situation, with a recommendation, for state office consideration and action.
