ADDENDUM TO 52.212-1: INSTRUCTIONS TO OFFERORS
The Government intends to award a Firm Fixed Price (FFP) contract as a result of this solicitation in accordance with FAR Part 12 and 13. Award will be made to the quoter whose quote is most advantageous to the Government under the selection criteria set forth in this solicitation. The Government intends to evaluate quotes and award a contract based on initial quotes. Therefore, the quoter’s initial quote should contain the quoter's best terms from a Non-Price and Price standpoint.
INSTRUCTIONS FOR SUBMISSIONS OF QUOTES:
(1) At the time of solicitation closing date, the quoter shall submit their quote via email to Michael Owen II at Michael.a.owen.civ@us.navy.mil.
(2) Price quotes will be due on the closing date of subject RFQ and must be held firm for forty-five (45) days.
(3) Quoter shall comply with all instructions for submitting quotes and attachments:
Factor I – Technical Quoter shall provide a technical submission that demonstrates the quote meet the minimum specifications detailed in the attached statement of work (SOW). Quoters shall provide a development and delivery timeline of the Safety Management System within their proposal.
Factor II – Past performance The quoter shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts within the past five years prior to the solicitation closing date that is the same as or similar to, the scope and magnitude of the work described by this solicitation.
To demonstrate its past performance, the quoter shall identify up to three (3) of its most relevant contracts within the past three (3) years of the closing date of the solicitation. Quoters shall provide a detailed explanation demonstrating the relevance of the contracts to the requirements of the solicitation. For purposes of this solicitation, a contract is defined as a single contract or a single task order placed under an IDIQ contract, a Blanket Purchase Agreement (BPA), or a Federal Supply Schedule.
If the quoter includes delivery orders/task orders as past performance, the quoter shall state specifically what work was performed by the quoter under the delivery order/task order and the dates during which work was performed.
The offeror should complete a Past Performance Information Form (Attachment II) for each reference submitted. The form is an attachment to the solicitation. For additional information regarding a particular reference beyond that which will fit on the form, the offeror may continue onto another sheet of paper. The forms and any such continuation sheet(s) for submitted references will count toward the Volume II page limit described at the end of this section.
In addition to the information requested above, offerors shall contact their past performance references and request that each reference complete (Attachment III) – Past Performance Report Form and e-mail the completed survey form directly to Michael Owen II at Michael.a.owen.civ@us.navy.mil by the DUE DATE OF THIS SOLICITATION. The Government reserves the right to consider past performance report forms received after the due date of the solicitation and to contact references for verification or additional information.
Factor III – Price This volume shall include completed solicitation documents and additional supporting documentation described below:
· Completed price list that provides individual pricing for each CLIN as detailed in the combined synopsis/solicitation.
· All supplemental information to support the proposed price, to include but not limited to copies of previously paid invoices, sales history for the same or similar items, price list with effective date and / or copies of catalog pages along with any applicable discounts.
· Unless completed in SAM, RFP, Representations, Certifications and Other Statements of Offerors completed by the quoter.
ADDENDUM TO FAR PROVISION 52.212-2, EVALUATION – COMMERCIAL ITEMS:
The Government intends to award firm-fixed-price contract resulting from this solicitation to the responsible quoter whose quote represents the best value after the evaluation in accordance with the factor in the solicitation. The evaluation will consist of Factor I: Technical, Factor II: Past Performance and Factor III: Price. The trade-off evaluation of quotes will consider the non-price factors of technical and past performance to be more important than the price factor. Within the non-price factors, technical and past performance are approximately equal in importance.
1. Non-Price Proposal Evaluation Criteria
Factor I – Technical Factor I - Technical will be evaluated on an Acceptable/Unacceptable basis utilizing the Technical Ratings in Table 1 below. Quoters receiving a rating of “Unacceptable” for Factor I – Technical will not be considered for an award and will not be further evaluated.
Factor II – Past Performance For the Past Performance factor, the rating tables identified in the table below, entitled “Past Performance Relevancy Ratings Table” and “Past Performance Confidence Assessment Ratings Table” will be utilized for the assignment of ratings for relevancy and confidence assessment. Past performance will be evaluated for confidence based on the recency, relevancy, and quality of the submitted contracts. Past Performance will be assessed as follows:
Past Performance Recency:
The Government will evaluate each past performance reference to determine the recency. Recency is the first aspect of the past performance evaluation and is the time period during which past performance references are considered relevant. Recency is critical to establishing the relevancy of past performance information. Evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last three years, will not be considered.
Past Performance Relevancy Past Performance Relevancy Ratings – Regarding relevancy, each past performance reference under each offeror’s Past Performance submission will be evaluated to determine its individual scope and magnitude relative to the instant requirement. The following definitions will apply to this evaluation.
Scope: Experience in the areas defined in the Performance Work Statement
Magnitude: The measure of the similarity of the dollar value of actually performed work that exists between the PWS and the offeror’s contracts, individually, during the stated five-year period established by the solicitation.
Past Performance Quality The third aspect of the past performance evaluation is to establish the overall quality of the offeror’s past performance. The Government will review all past performance information collected and determine the quality of the offeror’s performance, including general trends and usefulness of the information, and will incorporate this into the past performance confidence assessment.
Offeror’s lacking past performance history will not be evaluated favorably or unfavorably on past performance. However, the past performance submittal of an offeror with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous offeror to the Government. In this instance, the offeror will receive a rating of “Not Relevant” in the relevancy rating factor.
Past Performance Confidence Assessment Ratings – The overall assigned rating for Past Performance will be the Past Performance Confidence Assessment ratings in Table 4. The assignment of this rating will be based on the quality of the relevant past performance and will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance. The quality of performance under a past performance reference that has no relevance to the instant requirement will not be considered in the overall assessment of Past Performance Confidence. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance rather the offeror will receive an “Unknown Confidence” rating.
In order to determine the quality of performance, the Government may utilize existing data sources, including the Contractor Performance Assessment Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), the Electronic Subcontract Reporting System (eSRS), or other databases; communication with points of contact in the offeror’s customer’s organization, which could include private sector requirements and contracts personnel, Administrative Contracting Officers, Defense Contract Management Agency (DCMA) personnel, Procuring Contracting Officers, Contracting Officer’s Representatives, and other Government activity requirements personnel. The Government may verify past performance information. The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews, and existing data sources. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources, including sources outside of the Government. This information will be used for the evaluation of past performance.
This evaluation and rating is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used as a means of evaluating the relative capability of the offeror and other competitors to successfully meet the requirements of the RFP. In determining the rating for the past performance evaluation sub-factor, the Government will give greater consideration to the contracts which the Government assess as most relevant to the RFP.
NOTE: A rating of “Limited Confidence” for the past performance factor means that the offeror’s proposal is not awardable without a change or changes to the offeror’s proposal. A proposal that includes a “Limited Confidence” rating is considered to be susceptible to correction if the contracting officer determines that an exchange (pursuant to FAR 15.306) is appropriate and said exchange is conducted. A rating of “No Confidence” for the past performance factor means that the offeror’s proposal is not awardable, is not susceptible to correction, and will not be further evaluated.
2. Price Quote Evaluation:
Factor III – Price A quoter’s quoted price will be determined by adding all extended amounts for all CLIN(s) which are comprised of all items listed within the quote. Although price is not the most important evaluation factor, it has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of the quotes in relation to the other factors on which selection is to be based. The importance of price will also increase when a quoter’s price is so significantly high as to diminish the value to the Government that might be gained under the other aspects of the quote. If, at any stage of the evaluation, all quoters are determined to have submitted equal, or virtually equal, quotes, price could become the factor in determining which quoter shall receive the award.
Price will be evaluated in accordance with FAR Part 13. The Government may evaluate any and all information submitted by the quoter to support the reasonableness of prices quoted. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer. Additionally, the government may request quoters to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items or uncertified cost and pricing data. Failure to submit the requested information may result in disqualification of the submitted quote.
