About this file
This is a Conflict of Interest Affidavit and Disclosure form referenced under COMAR 21.05.08.08, required to be submitted with bid or proposal submissions. The document establishes the legal framework for disclosure obligations applicable to bidders, offerors, contractors, consultants, subcontractors, and their employees or agents who may exercise control or supervisory authority over contract work.
The affidavit requires the bidder or offeror to warrant that no facts or circumstances exist that create an actual or potential conflict of interest, unless specifically disclosed in writing to the procurement officer. "Conflict of interest" is defined as circumstances where a person is unable or potentially unable to render impartial assistance to the state due to other activities or relationships that could impair the person's objectivity or create an unfair competitive advantage. The affiant must solemnly declare under penalty of perjury that the contents are true and correct, and must agree to immediately disclose in writing any actual or potential conflicts that arise after the affidavit date. If a conflict emerges after contract award, the contractor shall continue performance until notified by the procurement officer of any contrary action to be taken.
