About this file
This is an Annual Affidavit document for the Commonwealth of Kentucky that establishes compliance requirements for bidders, offerors, and contractors seeking to do business with Kentucky state and local government entities. The affidavit serves as a mandatory attestation mechanism with a maximum effective period of one year and must be notarized. The document applies to all bids and contracts in general and includes additional provisions specific to non-bid contracts (sole-source, non-practical to bid, or emergency contracts) and bidders claiming resident bidder or qualified bidder status.
The affidavit requires bidders and contractors to swear under penalty of perjury to multiple compliance certifications, including adherence to Kentucky campaign finance laws (KRS 45A.110 and KRS 45A.115), proper disclosure of information per KRS 45A.485, current registration with the Kentucky Department of Revenue for sales and use tax collection, absence of state tax delinquency, non-participation in boycotts of jurisdictions with which Kentucky maintains open trade, and compliance with ethics prohibitions outlined in KRS 11A.236 for the preceding ten years. Non-bid contracts require additional affirmations regarding gubernatorial campaign contribution limits (KRS 121.056 and KRS 121.150), restrictions on contributions to elected officials with contract award jurisdiction (KRS 121.330), and prohibitions on direct solicitation of campaign contributions. Resident bidder claims require documentation of Kentucky business authorization, one year of prior corporate income tax filings, unemployment insurance fund payments, and active workers' compensation coverage. Qualified bidder status claims must comply with 200 KAR 5:410(3), including nonprofit corporation designations and requirements for organizations serving individuals with severe disabilities. The Commonwealth retains the right to request updated affidavits and supporting documentation at any time, with failure to comply resulting in potential disqualification or contract termination.
