About this file

This addendum and questions-and-answers document pertains to Project No. 1007091, the Embarcadero West Rail Safety Project - Phase 1 (OVR/Market and Oak), issued by the City of Oakland Department of Transportation on August 25, 2026. The project involves comprehensive roadway reconstruction, utility relocation, storm drain installation, landscape improvements, traffic signal modifications, and streetlight installation along Embarcadero West and Oak Street corridors. The bid schedule comprises 197 base bid items including excavation (10,340 cubic yards of roadway excavation and 4,060 cubic yards of hazardous materials excavation), hot mix asphalt placement (13,590 tons), concrete work (sidewalks, curbs, gutters, and curb ramps totaling approximately 20,220 square feet), storm drain pipe installation (1,784 linear feet), bioretention (7,960 square feet), landscaping with 2,610 one-gallon plants and 20 twenty-four-inch box trees, irrigation system installation, traffic signals, bicycle counters, streetlighting (68 poles with LED luminaires), and associated pavement markings and signage. Bids were due by 2:00 PM on September 3, 2026, to the Office of the City Clerk. The addendum clarifies specification sections by removing crack seal work, lined reinforced concrete pipe requirements, and parking kiosk pay station provisions; revises utility work timelines to allow three working days per location for utility owner adjustment and relocation work separate from the five-day concrete demolition-to-pour-back limitation; and revises Port of Oakland property work requirements to mandate 30-day advance notice, single-stage construction sequencing, and 15-day demobilization periods upon completion.

The document addresses critical pricing and coordination issues through 45 questions and answers. Two allowance items are identified: dewatering (Item 25) at approximately 0.35 percent of project cost and expedite landscape soil testing service (Item 194) at approximately 0.031 percent of project cost. Water meter relocations are performed by EBMUD with charges paid directly by the contractor and included in the unit price for reconstruct water connection work. All water meter boxes and covers are supplied and installed by EBMUD at no cost to the contractor. Contractors must coordinate with the City's construction management team regarding testing and concrete strength requirements, with the City intending to hire a third-party construction management services consultant (firm not yet selected at the time of document issuance). Contractor permits from the City of Oakland are issued at no cost, but permits from other agencies and entities are the contractor's responsibility and should be included in mobilization costs. The project involves work on Union Pacific Railroad (UPRR) property with active rail operations; railroad flagging costs must be bid as a lump sum based on contractor schedule and means and methods, with progress payments approved monthly based on invoicing up to the lump sum amount. Hazardous material may be present within DTSC contaminated site limits on Port of Oakland property, and contractors must refer to hazardous materials and pavement design documents for details and disposal requirements.

Subject: Project No. 1007091 Embarcadero West Rail Safety Project – Phase 1 (OVR/Market and Oak)

To: All Prospective Bidders

The clarifications, additions and/or deletions contained in this ADDENDUM shall be made a part of the bid or proposal solicitation documents (plans, specifications, RFP, RFQ, etc.) for the above-referenced project, and shall be subject to all applicable requirements there-under, as if originally shown and/or specified. The documents are revised as follows:

IMPORTANT: You must acknowledge this Addendum in the Contractor’s Bid form or your bid may be deemed non-responsive.

1. Special Provisions

a. Reason for change: Clarification on Specifications based on contractor questions.

b. Description of Change: The following revisions are proposed:

i. Remove SUBSECTION 203-3.1.1 CRACK SEAL.

ii. Remove SUBSECTION 207-3 LINED REINFORCED CONCRETE PIPE.

iii. Remove SUBSECTION 303-5.1.1.6m Parking Kiosk Pay Station.

iv. Revise SUBSECTION 5-14 WATER METER CHARGES to include the EBMUD water meter charge table and to identify the quantity of meters to be relocated.

Locations are shown on the utility plan sheets. Full compensation for the

EBMUD relocation charges is included in the contract unit price paid for

Reconstruct Water Connection (Service). No separate payment will be made.

v. Revise SUBSECTION 5.61 Utility Work to identify the on-site duration shall allow for utility owner adjustment and relocation work at each affected location.

Language was added:

i. The Contractor shall allow [3] working days per location for utility owner adjustment and relocation work, exclusive of the notice periods specified in Sections 5-6.5 through 5-6.11. This duration is in addition to, and is not counted against, the [5] day limitation between concrete demolition and pour back, and that limitation shall not apply

Project No. 1007091 Page 2 at locations where utility owner adjustment or relocation work is required. The Contractor shall reflect these durations in the baseline schedule. No additional compensation or working days will be allowed for utility owner work completed within the durations stated above.

2. Special Provisions

a. Reason for Change: Clarification of Section 6-1 CONSTRUCTION SCHEDULE AND

COMMENCEMENT OF WORK for work within Port of Oakland (Port) property needed.

b. Description of Change: The following revision is proposed:

i. Revise SUBSECTION 6-1.2 COMMENCEMENT OF WORK: For work within Port of

Oakland (Port) property, Contractor is required to notify the Engineer 30 days prior to the start of work for each stage of construction. Contractor shall not perform work on multiple stages of construction unless approved otherwise by the Engineer. Upon completion of each stage, Contractor is required to demobilize the stage construction area within 15 days upon acceptance of construction and return operational status back to the Port.

Existing tenants within Port property must have ingress/egress access maintained at all times. Nightwork and weekend work requests will be considered on a case-by-case basis and require City and Port approval. All night work or weekend work operations should be identified in the contractor schedule.

The Contractor shall only work, store equipment, store material and conduct construction operations within the area designated as the current stage construction area. Contractor traffic handling plans must delineate anticipated access routes for approval prior to commencement of construction.

No area outside the designated construction area shall be used or occupied by the contractor without explicit written consent from the Engineer. Requests for additional areas can be submitted for use and subject to Port approval.

3. Plan Revision

a. Reason for change: Existing contours are shown as dashed lines but printed very light.

b. Description of change: Addendum plans darkened the contours and provided existing contour labels on Grading Plan sheets GD101-104 and GD201-213.

4. Bid Schedule Revision

a. Reason for change: Due to clarification of bid items needing to be added to the bid schedule.

b. Description of Change: Bid schedule (Pages 5-12) has been revised as highlighted in

Question 17: Pursuant to Resolution No. 90814 C.M.S., adopted by the Oakland City Council on

July15, 2025, the Local/Small Local Business Enterprise Program (L/SLBE) requirements donot apply to pedestrian right-of-way construction, including construction of curb ramps, sidewalks, curbs and gutters, and other ancillary work necessary for pedestrian right-of-way construction. Please clarify which bid items on the bid schedule apply to Resolution No. 90814, No. 90996, and No. 90996 C.M.S? On past projects, the City has marked the bid form with "x" for bid items related to ROW construction.

Answer 17: City will not mark items as exempt on the bid schedule as the overall L/SLBE requirement for this project was determined through an analysis factoring in the exemptions.

Question 18: Is it acceptable for contractors to list certified SLBE vendors or subcontractors for a scope of work unrelated to the NAICS code under which they are certified and still obtain L/SLBE participation credit? For example, a contractor lists a (Construction Supply Vendor) to purchase electrical materials through, to meet SLBE project requirements. The Construction Supply Vendor is a "Building materials dealer (NAICS code 444190)" and "Other construction material merchant wholesaler (NAICS code 423390)", not an electrical distributor, apparatus, equipment, wiring supplies and related equipment merchant wholesaler (NAICS code 423610). Since the Construction Supply Vendor is not a certified SLBE listed electrical distributor per NAICS code, is it acceptable for contractors to use them or any other non-electrical supplier as a "pass-through" solely to purchase electrical materials to meet L/SLBE project requirements?

Answer 18: L/SLBE credit only applies when the certified firm performs a commercially useful function in the NAICS code it’s certified in. Using a firm as a pass through wouldn’t qualify for L/SLBE credit.

Question 19: Please confirm that the City will provide and pay for all required compaction testing and concrete cylinders? The contractor will only need to coordinate with the owner supplied consultant.

Answer 19: Contractor will coordinate with Construction Management team. Testing and concrete strength requirements are outlined in the contract documents.

Does this need to be completed, and if so, will a bid item be added to compensate contractor for this work?

Answer 21: Specification Section removed. Storm and Sewer manhole survey is not a contract bid item.

Question 22: Section 5-11 explicitly states that water valve boxes and covers are to be supplied by

EBMUD at no cost. Section 5-10 states that water meter boxes are also to be supplied by EBMUD, but it is unclear if those are at no cost as well. Please clarify.

Answer 22: For Section 5-10: All water meter work on this project, whether new or relocated, will be performed by EBMUD, including furnishing and installing meter boxes and covers.

This work is at no cost to the Contractor. The Contractor shall provide access and keep meter locations clear in advance of EBMUD's work.

Question 23: Bid Item 20 is to Relocate an Unidentified Utility. Spec section 5-15 provides very minimal information except that is to have 12” vertical separation from the storm drain. Not knowing what this utility is and what materials and work are going to be needed (shoring, bypass systems, dewatering, etc), should this item be an allowance with a value determined by the City for bid purposes?

Answer 23: Bid Item 20 refers to an existing telecommunications security line owned by the Port of Oakland and shall be bid as a telecommunications facility. The contractor will be required to execute an NDA with the Port of Oakland prior to performing work on this facility. Costs for obtaining the NDA and complying with any Port coordination shall be included in the price paid for Bid Item 20.

Question 24: Will City of Oakland permits be issued to contractor at no cost? If not what are the anticipated costs for City of Oakland Permits?

Answer 24: Contractor will need to pull no-fee permits from City of Oakland Department of

Transportation permit counter for the work. However, permits issued by agencies and entities other than the City of Oakland will be the responsibility of the contractor.

Permit fees should be included in mobilization costs.

Question 25: Will Port of Oakland permits be issued to contractor at no cost? If not, what are the anticipated costs or will the City reimburse contractor for cost of permits via change order?

Answer 25: Permit fees should be included in mobilization costs.

Answer 28: Existing track material will be removed by UPRR as indicated in the plans.

Question 29: Spec Section 301-2 – Untreated Base has two measure and payment sections. The first stating that compensation shall be paid for “other bid items of work involved, and no other compensation will be allowed thereof.” The second states that, “The price paid per cubic yard of crushed aggregate base shall included…” Assume this means base under concrete improvements is to be paid in associated items and by the cubic yard for base under the asphalt roadway. Please clarify.

Answer 29: Untreated base under concrete work shall be paid for by that bid item and no further compensation will be allowed. Untreated base under roadway sections of hot mix asphalt will be paid by CY.

Question 30: Spec Section 303-5.1.1.6m regarding Parking Kiosk Pay Stations state, “Contractor shall purchase and deliver to the City Maintenance Service Yard the kiosk pay stations as shown on the plans.” Please confirm that this is not to a part of the Project.

Answer 30: Specification Section removed. City to provide Parking Kiosk and installation.

Question 31: Spec Section 303-5.9e states, “Unclassified Excavation for Concrete Work shall occur only at locations shown on the plans or where the Engineer determines the sub-base material to be unstable. Unclassified Excavation shall be measured for payment by the cubic yard.” There is no Unclassified Excavation bid item. Will this work be paid as Roadway Excavation, or will the City be adding a unclassified excavation item?

Answer 31: No unclassified excavation is identified on the plans. All excavation associated with construction will be paid by roadway excavation and roadway excavation (hazardous materials).

Question 32: Will the City consider postponing the bid date and extending the pre-bid question period?

Answer 32: The City does not intend to postpone the bid date or extend the pre-bid question period due to funding deadlines.

Question 33: Section 5-6.3 states that the contractor is to pay the charges for water meter relocation. What are the charges, how many are to be relocated, and which bid item is this work paid under?

Answer 33: Water meter relocations are performed by EBMUD. Per Sections 5-6.3 and 5-14, the Contractor makes arrangements with EBMUD and pays EBMUD's relocation charges directly. Section 5-14 has been revised by addendum to include the EBMUD water meter charge table and to identify the quantity of meters to be relocated. Locations are shown on the utility plan sheets. Full compensation for the EBMUD relocation charges is included in the contract unit price paid for Reconstruct Water Connection (Service). No separate payment will be made.

Question 34: Sections 5-6.5,5-6.6,5-6.7,5-6.9,5-6.10,5-6.11 all outline required days of notice to be provided to the corresponding utility owners to schedule their adjustment work.

Specs state that the contractor is only allowed 5 days from start of concrete demo to

Project No. 1007091 Page 18 pour back per location. How many days (of these 5 days) will be required for the utility owners to perform their adjustment work?

Answer 34: The notice periods identified in Sections 5-6.5, 5-6.6, 5-6.7, 5-6.9, 5-6.10, and 5-6.11 are advance scheduling notification requirements to the respective utility owner. They are not durations of on-site work and are not counted against the 5 day limitation between concrete demolition and pour back. Addendum No. 1 revises Section 5-6.1 to identify the on-site duration the Contractor shall allow for utility owner adjustment and relocation work at each affected location, and to clarify that the 5 day pour back limitation does not apply at locations where utility owner work is required.

Question 35: Section 6-1.12 references no base repair or paving work during school days within two blocks of the following schools. No schools are listed. Please confirm that there are no schools within the project limits that will require this weekend or holiday work.
