About this file
The document is a Request for Special Procurement (Amendment No. 1) from the Oregon Department of Human Services (ODHS) and the Oregon Health Authority (OHA) for a contract with Mass Ingenuity to provide a monthly subscription for Visual Analytics Development Services in connection with the existing RESULTS SaaS Solution for Key Performance Measures Reporting. The amendment will be a not-to-exceed value of $340,000 from the effective date through the end of the contract period on March 31, 2024. ODHS and OHA are seeking to enhance the reporting capabilities within the RESULTS SaaS software that they have used since 2012. The Visual Analytics subscription service includes 5 library reports per month, unlimited library reports through self-service, 1 custom report per month, 3 workspace users, and 12 hours of group training per year.
The justification for the special procurement is that Mass Ingenuity has exclusive ownership rights to the RESULTS software and no other third parties would be able to offer these enhanced services. ODHS and OHA divisions will have the option to independently engage with Mass Ingenuity for the Visual Analytics subscription service on a monthly basis, allowing them to customize reports and dashboards for improved internal and external reporting.

a. Amendment Request:
ODHS requests approval of this Amendment No. 1 to Special Procurement (SP) No. SP-1102-19 to amend Contract No. DHS-159956-20 (Contract) with Mass Ingenuity, to include an option for ODHS Programs and the Oregon Health Authority (OHA) Divisions to utilize a monthly subscription for Visual Analytics Development Services (subscription) in connection with the existing Mass Ingenuity Results SaaS Solution for Key Performance Measures Reporting for the remainder term of the contract. The amendment will be a not-to-exceed (NTE) value of $340,000 from effective date through end of contract period March 31, 2024.
b. Background:
As a result of approved SP-1102-19 (DHS-4750) issued February 15, 2019 and closed February 22, 2019 with no protests, ODHS and OHA entered into the Contract with Mass Ingenuity effective April 1, 2019 for a five (5) year subscription to the RESULTS SaaS Key Performance Measures Reporting tool, allowing for capability to track and report on key performance measures and strategic initiatives across ODHS and OHA Divisions and Programs.
Current Need:
While using the RESULTS SaaS solution, a stronger need arose for internal capacity for visual analytic reports within RESULTS software to better support both agency management systems of ODHS and OHA. This amendment will give individual OHA Divisions and ODHS Programs and related business areas the ability to opt-in to a monthly subscription with Mass Ingenuity at a cost of $5,000 per month per Division/Program to design custom reports. Each Visual Analytic subscription includes:

c. Proposed Contracting Procedure:
1. ODHS will issue a public notice on the Oregon Procurement Information Network (ORPIN), as required by Oregon Administrative Rule (OAR) 125-247-0287, for a period of seven (7) calendar days, regarding approval of the Special Procurement Amendment request.
2. Advertisement of the Special Procurement Amendment will include provisions that an Affected Offeror may protest the approval of the SP Amendment, provided the Affected Offeror submits the protest to the Department of Administrative Services, Procurement Services (DAS PS) and ODHS within the seven (7) calendar days of the posting of the approval of this SP Amendment request.
3. DAS PS, along with ODHS, will respond to and resolve protests, if any. If no protests to this SP Amendment are received or sustained, ODHS will proceed with an amendment to the Contract with Mass Ingenuity.
4. ODHS will obtain all necessary approvals, including Department of Justice (DOJ) legal sufficiency review and approval, and approval from Enterprise Information Services (EIS) as may be required.
11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.
● The RESULTS SaaS is the tool used by ODHS and OHA for tracking and reporting key performance measures and strategic initiatives across the enterprise. Mass Ingenuity is the only Provider that can offer this option for customized visual analytic reports within RESULTS software as they own Intellectual Property (IP) rights to the tool.
● The Visual Analytic subscription service as part of this Amendment No. 1 to SP-1102-19 is an offering, which was designed by Mass Ingenuity to enhance reporting capabilities within RESULTS SaaS.
SP-1102-19_AMD_1_Final.docx(DHS-5197) Page 3 of 11
RESULTS SaaS seamlessly integrates with, and supports, the RESULTS management methodology system which has been implemented and in use by OHA and ODHS since 2012.
● OHA Divisions and ODHS Programs would have the independent option to engage with Mass Ingenuity for this service and would be able to use as needed with a commitment of a month at a time and can cancel/discontinue anytime.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
_ X _ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
Mass Ingenuity has exclusive ownership rights to the RESULTS Software tool as they own the Intellectual Property (IP) and thus other third parties would have no access or ability to offer these same services, which enhance and interface with the RESULTS Software tool.
and
______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
or
_ X _ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
Allowing the ODHS Agency Programs and OHA Divisions the option of accessing this service will help them further enhance customized reports in Mass Ingenuity’s Results software that both agencies own. Their access will offer users additional capacity to customize visual analytics reports and dashboards for optimal presentation and analysis, resulting in enhanced internal and external reporting, including reports mandated by the State and Federal government and public use.
13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request submitted through ORPIN. Agency may elect to attach a signed Request as a pdf file through ORPIN or submit a signed hard copy Request.
Signature: e.g. Electronically in ORPIN _________________ Name/Title: Date:
