About this file
This document is a justification for other than full and open competition for a federal construction project. The project involves renovating electrical and telecom closets at the Ralph H. Johnson VA Medical Center in Charleston, South Carolina. The value of the project is estimated between $5-10 million.
The justification requests approval to procure six brand name items as part of the project due to standardization across the medical center. This includes smoke detectors, HVAC controls, security systems, fire sprinklers, door locks, and laminate finishes from specific manufacturers. Procuring other products could result in compatibility issues, additional costs, and safety or regulatory compliance risks. The overall contract will be competed as a service-disabled veteran-owned small business set-aside. The contracting officer certified the justification and market research supporting the brand name determinations.

5. Demonstration that the Contract nique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
These items have been standardized throughout the Ralph H. Johnson VAMC. Installing a different manufacturer system will create significant duplication in cost for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:
a. Smoke Detectors / Heat Detectors
i. Gamewell FCI E3 Series
ii. Impact: The impact if the of not installing the equipment could result in the existing fire alarm system not functioning properly in these areas to warn occupants and first responders of a fire; this would result in damage to costly IT equipment and harm to patients/staff at the facility due to the byproducts of smoke production.
b. Building Environmental
i. Siemens Desigo Digital Control (DDC)
ii. Impact: This hardware and software programming must be compatible to control the heating/cooling environment within the scope of work. Utilization of incompatible devices would require a secondary DDC system, backbone, server, workstation, graphical user interface, and other stand-alone items that are costly and result in additional maintenance, service contracts, and life cycle costs.
c. Building Security: (Includes: Proximity Card Reader [CR], Intrusion Detection Keypad [KP] Electric Strike [ES], Request to Exit Sensor [REX], Intrusion Detention Siren [S], Intrusion Detention Motion Sensor [MS], Door Contact [DC], CCTV Cameras, Access Controls Intelligent Controller w/Power Supplies, and Access Controls Interface Reader Panels.
i. Johnson Controls
ii. Impact: These items must be procured from Johnson Controls to ensure that the new equipment interfaces with the existing building security systems. Not providing this equipment would result in a duplicate system that must be installed, programmed, maintained, and managed, resulting in additional costs, efforts, time to install and test, and programming as a part of typical maintenance of the system. Updates to a new system would also result in additional costs.
d. Fire Sprinklers/Fire Dampers
i. Tyco Sprinklers / Ruskin Fire-Smoke Dampers
ii. Impact: These items are essential to ensure the compatibility with the existing fire protection and fire alarm systems that are in place. These systems must be uniform as that is how they are tested by the manufacturer and certified by national testing bodies (Factory Mutual and Underwriter Laboratories). In order to maintain certifications that these systems meet code and VA design manual requirements, particular equipment must be installed to maintain certifications that the system will function properly and save life and property when activated.
e. Door Hardware/Locksets-Cores
i. BEST Locksets
ii. Impact: This project includes installing entry doorways to newly renovated information technology room that houses upgraded communication racks which are critical to the new patient information system. Access to these new communication room will be required to be physically locked in effort of ensuring no compromises to our staff and patient privacy information. The locksets used throughout the hospital, by Facility Management are BEST locksets and cores.
f. Laminate cover over hollow-metal door
i. Inpro American Walnut 0555
ii. Impact: The use of this product, which is unique to one manufacturer, respectively, is Inpro finishes have unique visual grain patterns and colors that cannot be matched with existing installed laminate doors, requiring sourcing this unique pattern/color from Inpro.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) Set-Aside. This Justification for Other Than Full and Open Competition will be posted to Federal Business Opportunities with the solicitation.
7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the Government will be Fair and Reasonable:
Government estimate was prepared and provided by the Contracting (COR). The anticipated price to the Government for the items requested to be brand name is approximately
The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make the determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
The market research for the equipment was conducted and prepared by the COR and shared with the CO for further review. The CO was in concurrence with information provided in the estimate that supported the brand name items. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the Ralph H. Johnson VAMC facility as a whole.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
New components must be able to tie into an existing and operational system including the use of software. At this time, there are no competing vendors whose products are fully compatible with the existing system being used at the Ralph H. Johnson VAMC.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
