Performance Work Statement

Title: LED Light Replacement NLGRP

1. Background:

The Agriculture Research Service (ARS) is the chief in-house agency of the United State Department of

Agriculture (USDA) located on Colorado State University (CSU) campus. The USDA ARS Facility department is responsible for providing an adequate and safe work environment supporting crops research and genetic resource preservation. The U.S. Department of Agriculture, Agriculture Research Service requires light spectrum of the plant tissue culture growth rooms. from hail damage and warranty work related to the National

Laboratory Genetic Research and Preservation (NLGRP) located at 1111 S. Mason St. Fort Collins, CO. 80525.

The organization is currently operating standard 4-foot fluorescent fixtures with 32W cool white bulbs. The requirement for the USDA is to have the flexibility/adjustability for light intensity and spectrum with the replacement of LED fixtures. Laboratory lights are to be multi-spectrum regarding light softness.

Environmental chambers will require to have Phillips type lighting or equivalent and must be compatible with

Phillip lighting modules and system program.

2. Objective:

The intent of this solicitation is to replace fluorescent lighting fixtures with LED units in the plant tissue culture growth rooms and first floor laboratories. Laboratory lighting on the first floor will be replaced with LED lighting with multiple spectrum (light coloring softness) range between 3500- 6500K. Lighting associated with

Laboratory must be compatible with Phillips Signify lighting modules and software program.

Contractor shall furnish a task order cost proposal for the Base and alternative bid option. The contractor shall provide a turn-key product including proper installation of all material and equipment per manufacturer’s recommendations. The contractor shall work with the site personnel to complete the project.

Currently there is no lighting program or software installed at the site. The contractor will be responsible for the installation, commissioning, and training of maintenance personnel.

Note: All vendors will be required to have a walkthrough of the areas where LED lighting is to be installed.

This is a mandatory requirement for Primary contractors of sub-contractors representing any contractors during the bidding on this project. The Contract Officer will coordinate the dates for visitation of the location.

3. Scope / Description of Work:

The contractor shall replace the old fluorescent lighting with new LED lights. Replacement of lights will consist of all Laboratory lights and plant tissue growth rooms located on the first floor. The U.S. Department of

Agriculture, Agriculture Research Service requires the Contractor to furnish all labor, supervision, equipment, tools, transportation, and rental equipment necessary (unless otherwise specified herein) to perform the services required in accordance with commercial standards, local, state, and federal laws, and the requirements of this project. Growth rooms will be required to use Phillip Horti LED C4 grow lights or equivalent. Spectrum range is 400-700+nm, which will be 2000-7500K. Intensity range from 0-177 Ulm/m2/s.

The contractor will be responsible for coordination efforts with the manufacturer.

3.1. Base Bid

3.2. Contractor shall assess the existing conditions of the site and develop a technical and cost proposal for installation of new LED lighting on first floor of. The Contractor shall perform onsite inspection of all supporting first floor laboratories and plant tissue growth rooms.

3.3. References & Standards:

All construction shall comply with ARS Facilities Design Standards (ARS Manual 242.1, 5-01-

12), ARS Policy & Procedures Bulletin governing Building Codes, and all applicable local, regional, State, and Federal regulations. Where one or more Codes or regulations conflict, the more stringent shall apply.

3.4. Permits:

Where governing regulations and imposed codes and standards require notices, permits, licenses, inspections, tests, and comparable items or actions to lawfully proceed with the required work, the Contractor shall obtain items and take those actions in accordance with the regulations of the governing authority. The costs of such permits, licenses, inspections, etc., are the obligation of the Contractor.

3.5. Existing Installations/Demolition:

3.5.1. The Contractor may modify existing installations as needed to accommodate the new installation. Where applicable, the contractor shall coordinate demolition or modification of existing light with the Contract Officer Representative. All disturbances of existing systems shall be coordinated with the COR to prevent disconnecting equipment that may potentially jeopardize in-progress research.

3.5.2. The owner reserves the right to retain any equipment or materials removed as part of this scope of work. The Contractor shall coordinate any equipment or materials to be retained with the Owner prior to starting demolition operations. The Contractor shall legally dispose all equipment or material removed or retained.

3.5.3. The contractor shall divert project waste to recycle where practical. The Contractor shall track and document the amount of waste diverted to recycle. The contractor shall submit diversion documentation as part of closeout. The contractor shall submit a letter stating so and why diversion was not practical.

3.6. Quality Control:

The work performed under this contract shall be subject to continuous audit by the Location

Monitor. Quality control is the exclusive responsibility of the Contractor.

3.7. Temporary Facilities:

Should the Contractor require any power or utility shutdowns during construction, the Contractor shall obtain approval for such shutdown from the COR three working days prior to the need.

3.8. Site Cleanup:

The construction site shall be kept clean and free of debris. Restore areas disturbed as possible to the original appearance and condition. Upon completion of the project, and prior to final inspection, the Contractor shall remove from the premises all unused material, trash, and debris resulting from the work to the satisfaction of the COR.

3.9. Submittals:

For all proposed material, the contractor shall provide light specifications, relevant illustrations, standard schedules, performance charts, instructions, brochures, diagrams, manufacturer descriptive literature, or catalog data.

3.9.1. The descriptive literature shall be annotated/highlighted to show its conformance with contract requirements.

3.9.2. Submittals required for all building materials and equipment shall be submitted to the CO and COR for review and approval.

3.9.3. Contractor is responsible for any costs incurred for equipment ordered without prior approval.

3.9.4. Final Inspection:

The Contractor shall notify the Contracting Officer and Owner in writing 10 days prior to the date that the project will be ready for final inspection. An inspection of the project will be conducted by the Contracting Officer, or Contract Officer, and Contractor at a mutually agreed upon time. COR and contractor shall compile a “punch list” prior to final acceptance of the installation and submit completed warranty documentation to manufacturer.

3.9.5. Warranty:

In addition to any other warranties set out elsewhere in this contract, the Contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect of equipment, material or design furnished, or workmanship performed by the Contractor or any of his subcontractors or suppliers at any tier. Such a warranty shall continue for a period of one year from the date of final acceptance of the project. Under this warranty, the Contractor shall remedy at his own expense any such failure to conform or any such defect. In addition, the

Contractor shall remedy at his own expense any damage to Government owned or controlled real or individual property, when that damage is the result of the Contractor's failure to conform to contract requirements or any such defect of equipment, material, workmanship, or design. The

Contractor shall also restore any work damaged in fulfilling the terms of this clause. The

Contractor's warranty with respect to work repaired or replaced hereunder will run for one year from the date of such repair or replacement.

3.9.6. Notification and Compliance:

The Government shall notify the Contractor in writing within a reasonable time after the discovery of any failure, defect, or damage. Should the Contractor fail to remedy any failure, defect, or damage within a reasonable time after receipt of notice thereof, the Government shall have the right to replace or repair and have the cost billed to the Contractor.

3.10. Latent Defects:

The Warranty specified herein shall not limit the Government’s rights with respect to latent defects, gross mistake, or fraud.

4. PERIOD OF PERFORMANCE: Performance period will be within 120 days after award of solicitation.

4.1. Recognized Holidays. Holidays observed are as follows. When scheduled services fall on an observed federal holiday contractor shall perform services on next business day.

4.2. HOURS OF OPERATION: The contractor is responsible for conducting business between the hours of 0730 to 1630 hours Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW. The Government facility may close for the following reasons:

4.3. Campus closures. When an unforeseen closure occurs on a regularly scheduled day of work, the

Government shall have the following options:

3.4.1. Reschedule work the following workday.

3.4.2. Reschedule the work on any day mutually satisfactory to both the contractor and Contracting

Officer or his designated representative.

5. PREMISES TO BE SERVICED:

5.1.1. Replacement of all LED lights in the plant growth rooms 139,140, and 144.Replace all lights on chamber shelves identified.

5.1.2. Due to scientific research equipment. The contractor shall work with the manufacturer recommended for the installation, programing of equipment, and commissioning of lighting programing. The Manufacturer will supply equipment or submit equivalent equipment and programming to meet the USDA requirements prior to installation of new LED lighting.

Current setup:

-Fluorescent fixtures with 32W bulbs

~90-100 umol/m2/s light intensity

-24" X 48" shelves, three light fixtures per shelf, four shelves per rack

Three separate rooms with an adjoining hallway

Room 139= 4 racks= 48 fixtures

Room 140= 6 racks= 72 fixtures

Room 141= 6 racks= 72 fixtures

A total of sixteen racks and 192 fixtures in the rooms mentioned above. A list of parts from the manufacturer is recommended and listed below for the environmental chambers associated with the growth rooms 139,140, and 144:

5.1.2. Laboratory rooms listed below will be either retrofitted or replaced. The rooms listed as follows but not required to meet automation requirements or strict spectrum requirements such as the environmental rooms. Light fixtures will be replaced with same light configuration and have minimal spectrum changes related to LED retrofit or same type of fixture installed in the current lab locations listed below. Contractor is required to submit lights or retrofit specification prior to purchasing equipment:

Note: See attached plans for reference to location of lights and laboratories on the first floor of

NLGRP. Laboratory rooms will have light spectrum lighting capability. The contractor will submit all materials for review prior to acceptance from the government.

5.1.3. The contractor will be responsible for coordination efforts for warranty material shipped to the site. If a long lead time for material is identified, the contractor will notify the CO or COR and may request additional time related to the project.

5.1.4. The contractor shall ensure new lighting is installed into existing electrical system of the facility.

5.1.5. Contractors shall work with the manufacturer, Philips Horti LED Solutions, Production

Module Dynamic requires Philips GrowWise Control Systems (GWCS), to ensure proper wired and commissioning of the new lighting system. Contact information for manufacture is available:

6. SCHEDULE: All work conducted in accordance with the below schedule:

6.1. Coordination and Assistance between the Contractor, Contractor's personnel and Sub-

Contractors, Contracting Officer, Contracting Officer's Representative, Location Monitor, and mailto:rcampos@ballhort.com

Research Personnel on the following items will keep all appropriate personnel involved to expedite this project for everyone’s benefit.

6.1.1. A Pre-construction Conference with the Contracting Officer’s Representative and government representatives are to attend the following meetings below:

Note: Vendors or their representatives are required to attend a walkthrough to bid on this project at the USDA NLGRP location.

6.1.2.1. Attendees shall include the Contracting Officer, Contracting Officer's Representative, the

Contractor, Contractor's superintendent, Location Monitor. Coordinate construction activities with the Contracting Officer's Representative to follow the Scheduling Requirements. Coordination meetings will be conducted once a week. The COR can change the time depending on the amount of activity by the Contractor. The agenda shall include milestones, challenges, and solutions identified from the previous meeting. The Contractor shall prepare and distribute minutes of progress meetings. No later than 3 days after each meeting, the Contractor shall provide a copy of the minutes to the CO and COR. Agenda shall include the following:

6.1.2.2. List of Attendees, by the Contracting Officer’s Representative and the Contractor.

6.1.2.3. Allowable Contractor’s use of Premises, Office, Work, and Storage areas with safety, housekeeping, and security procedures.

6.1.2.4. Contractor’s Progress Schedule and coordination items for any utility outages or hazardous material handling and storage.

6.1.2.5. Monitoring the Progress Schedule: The Contractor or the COR shall inform the CO if the Contractor is behind schedule and fix action planned to get back on schedule, so the CO can take appropriate action if needed.

6.1.2.6. Correspondence between the Contractor, Contracting Officer, and Contracting Officer’s

Representative shall have the date, logged entries, and copies kept at the originator’s office.

6.1.2.7. Due to the size of this project, material, product, installation procedures, testing procedures, etc. shall meet commercial standards and reviewed if requested by the Contractor or the Contracting Officer’s Representative requests a specific item, otherwise review will be at the final inspection.

6.1.2.8. Contractor’s Inspection Procedure, including field inspections and approvals with a remedial process for any deficiencies addressed at weekly meetings.

6.2. Government’s quality assurance program of random inspections and notifying the

Contractor of any noted deficiencies does not relieve the Contractor from requirements of the

Contract.

6. Safety:

6.1. The contractor’s Safety Competent Person designation identified at the Pre-Construction

Conference. The contractor shall submit a Safety plan prior to work on location.

6.1.2. Request a copy of any OSHA training course documentation for contractor and his/her employees.

6.1.3. All relevant PPE (personal protective equipment) as dictated by the hazards present must be worn by the contractor and all employees working on the job site.

6.1.4. Hazards of this Contract are:

6.1.4.1. Ladder Use.

6.1.4.2. Forklift, scaffolding and boom lift equipment.

6.1.4.3. Loading and hauling of material and debris.

6.2. Clean Up

6.2.1. Upon the end of the workday, the entire area of the contract work shall clear of all excess materials, dirt, rubbish, and debris.

6.2.2. Transportation of debris shall be in a manner as to prevent spillage on street or adjacent areas. The contractor is responsible for the removal of debris and materials on-site.

7. SUPPLIES AND MATERIALS FURNISHED BY THE GOVERNMENT: The Contractor shall maintain an adequate inventory of Government furnished supplies by giving the Contractor Officer’s

Representative advance notice for delivery orders received on a timely basis. The following list of supplied by the Government:

7.1. Water, gas, and electricity are available on the site. Protection of Existing Equipment, Utilities, and Improvements. Note: Contractor is responsible for protection and restoration if damage occurs.

See Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements (FAR

52.236-9) (APR 1984) in Section H - Special Contract Requirements. Contractor’s use of Premises for sanitation, work, and storage areas with safety, housekeeping, and security procedures.

7.2. Restrooms and break areas: The government will allow access to restrooms and break areas within the facility. Contractor may supply his or her toilet facilities, wash facilities, drinking water, and all necessary disposable materials. Coordination of services will be discussed upon at the pre-conference meeting and location (laydown areas) for material storage.

7.3. The government will supply either a laptop or CPU for installation of control system related to the LED light controls.

8. SUPPLIES AND MATERIALS FURNISHED BY THE CONTRACTOR:

The Contractor shall supply any additional PPE such as nitrite gloves, goggles, and face masks. All supplies and materials shall be of a type and quality that conforms to applicable Federal specifications and standards. All supplies and materials to use in the performance of the work described herein are subject to the approval of the Contracting Officer Representative (COR).

The Contractor shall utilize products and material made from biobased materials (e.g., biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conforms to applicable Federal specifications and standards. All supplies and materials for use in the performance of the work described herein are subject to the approval of the

Contracting Officer Representative (COR).

The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of

2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.

8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in

Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening

Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and

Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Bio-based and Sustainable Product Procurement,” dated February, 2012 to provide bio-based products. Biobased products designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov.

The Contractor should provide data for their biobased products such as biobased content. In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the

Contractor is encouraged to use other biobased products.

All equipment shall have bumpers and guards to prevent marking or scratching fixtures, furnishings, or building surfaces. Equipment deemed by the COR to be of an improper type or design, or inadequate for the purposes intended will be replaced with equivalent equipment or material.

The contractor shall store and preserve all cleaning solvents in accordance with commercial instructions.

All commercial markings shall remain on items for identification and medical instruction. If items should require transfer to another container, that container shall be clearly marked as to its content and its medical instructions.

9. Responsibilities:

9.1 SUPERVISION OF EMPLOYEES. Contractor shall provide for supervision of employees. Prior to commencement of services under this contract, the Contractor shall furnish to the COR a list of employees who will work on-site performing the services, and the name of the individual who will be responsible for supervision of such employees and who will function as the Project Manager. The Project Manager shall:

9.1.1. Have the Contractor’s full authority to act on matters pertaining to the performance of services.

9.1.2 Be on-site or on-call whenever work is performed.

9.1.3Report damage to Government property, loss of keys, personal injuries and/or hazardous conditions to the COR within twelve work hours after occurrence.

10. PROPERTY. Except for reasonable wear and tear, the Contractor assumes full responsibility for and shall indemnify the Government for any and all loss or damage of whatsoever kind and nature to any and all

Government property including any equipment, supplies, accessories, or parts furnished while in the

Contractor’s custody and care for storage, repairs or services to be performed under the terms of this Contract, resulting in whole or in part from the negligent acts or omissions of Contractor, and subcontractor, or any employee, agent or representative of Contractor or subcontractor.

11. PERSONS. The Contractor will be responsible for any negligent or wrongful acts or omissions of the

Contractor, his employees or agent’s incident to the performance of this contract. The Contractor will hold and save the Government harmless from all liability for any death or damage to all persons (other than the liability of the contract as provided under the Federal Employees Compensation Act) or to real or personal property, which results from the operation of, or incident to, equipment furnished by the Contractor. The

Contractor will not be responsible for any negligent or wrongful acts or omissions of the U.S. Department of

Agriculture; its employees, the U.S. Department of Agriculture’s Cooperators, or their employees.

12. LIABILITY INSURANCE. The Contractor shall maintain such insurance as will protect him/her from claims under Workmen’s Compensation, General Liability, Property Damage and from any other claims for damages for personal injury including death which may arise from operations under this Contract, whether such operation by himself or by any subcontractor or anyone directly or indirectly employed by either of them.

13. LOST AND FOUND PROPERTY. The Contractor shall ensure that all articles of possible personal or monetary value found by the Contractor’s employees on the premises of this installation are turned over to the

COR. At the time of their discovery, such items will be tagged and identify the location found.

14. SECURITY: Only authorized Agricultural Research Service, Agricultural Research Service Cooperator employees, the Contractor and Contractor’s employees shall be allowed in the building during performance of this contract. The Contractor will close any open windows, turn off lights (except those left on for security), and lock designated interior and all exterior doors. The building is considered closed for business from

4:30pm to 7:30am daily, all weekend hours, and Federal Holidays.

14.1. SECURITY CLEARANCES: Upon contract award, all contractor personnel who will be working in the building will be required to complete a background investigation. Upon clearance, contractor personnel will work with the designated USDA, Agricultural Research Services employees to obtain a

Linc Pass, which will serve as a permanent ID and authorize building access after normal business hours.

14.7 CONDUCTION OF CONTRACTOR AND EMPLOYEES: Contractor personnel shall not smoke or use vaporizing tobacco products in the building, as this is a non-smoking/non-vaporizing building.

Contractor personnel shall comply with the installation traffic laws and other regulations and instructions pertaining to the conduct of persons on Government facilities.

14.7.1 Contractor personnel shall not disturb plant material, equipment or tools located in greenhouses.

14.7.2 Contractor personnel shall in no event enter any area to which access is restricted, unless such an area is identified as an area in which services are to be rendered.

14.7.3 Contractor shall place his/her employees on notice that infraction of any of the above rules, regulations or prohibitions may be grounds for removal from Federal Property.

15. Inspections

15.1. Definition: “Services” includes services performed, workmanship and materials furnished or utilized in the performance of services.

15.2. All work shall be performed in a skillful manner. The COR may require the Contractor to remove from work any employee the COR deems incompetent, careless, or otherwise objectionable.

15.3. The COR will review the performance of services and receive complaints related to non-performance. The COR, or other designated representative, will make random inspections of parts of the building where services are to be performed. Inspections will not interfere with or delay the Contractor’s work.

15.4. Required Submittals will be noted in the Statement of Work or in the Specification section that is applicable. The contracting officer can request additional submittals on contract items when needed.

15.5. The Contractor shall complete and submit the daily reports to the COR weekly, on the first working day of the following week. The COR can waive the requirement for daily reports, at their discretion.

16. Deficiencies

16.1. Any deficiencies in performance found will be brought to the Contractor’s attention. The

Contractor is required to correct the deficiencies identified by the inspector. Should the same deficiencies be found during inspections, a meeting will be held with the Contracting Officer, COR, and

Contractor to determine a course of action.

16.2. If any service performed does not conform to the contract, the Government may require the

Contractor to perform the services again to conform to requirements, at no increase to the contract amount. When defects in performance cannot be corrected, ARS may (1) require the Contractor to take necessary action to ensure that future performance conforms to requirements, and (2) terminate the contract for default.

17. Payments

16.1. For payment, all invoices must be submitted to the Department of Treasury's Invoice Processing

Platform (IPP) via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the
