Statement of Work
OJM 21A Vehicle Lease
16 July 2020
1. Description of Services: OJM is a unit assigned to Moron Air Base Spain that requires vehicles for their day‐to‐day operations. This Statement of Work (SOW) outlines the details of this requirement.
All vehicles provided must be in excellent mechanical condition and be no more than one year old when issued to the Government.
2. Types of Vehicles: There will be three types of vehicles under this requirement. Vans, Midsized, and
Economy.
Vans should be similar to a Ford Custom or equivalent
Midsized Cars should be similar to a Renault Megane or equivalent
Economy Cars should be similar to a Renault Clio or equivalent
Trucks should be similar to a Toyota Hilux or equivalent
3. Delivery: The contractor is responsible for delivery and pick‐up of all vehicles. The vehicle shall be delivered to/picked up from destination, MORON AIR BASE, Spain by the contractor and at his or her expense. For assignment and control purposes, the vehicles are to be delivered to unit Vehicle NCO
(VNCO). Coordination should take place at least 3 days before delivery to allow sufficient time for acceptance inspections. (See Inspections). The contractor shall provide vehicles that are properly serviced at the time of delivery with oil, fuel, anti‐freeze, etc. The vehicles must also have a full tank of fuel at the time of delivery and will be returned to the contractor with a full tank of fuel.
4. Inspection: At the time of delivery the contractor and the VNCO will inspect the vehicle prior to acceptance. Any faults found must be taken care of prior to final acceptance.
5. Taxes & Inspections: Contractor shall furnish proof that all Spanish Government required taxes have been paid and inspections have been accomplished at the time of delivery of the vehicle, at no additional cost to the United States Government.
6. Maintenance: The contractor is responsible for all repairs and maintenance of the vehicles to maintain them in a good operating condition in accordance with the manufacture’s specifications.
Routine maintenance and repair of the vehicle must be provided within the country of Spain.
When a vehicle must be turned in for repairs or maintenance a replacement vehicle will be required.
The contractor, at no additional cost, must provide the replacement vehicle similar to the one being repaired within 24 hours. The contractor representative will return the replacement vehicle once repairs have been accomplished on the vehicle in service.
7. Emergency Repair Service: The contractor is responsible for providing repair service for breakdowns that may occur while the vehicle is in use. Contractor must provide emergency telephone numbers and points of contact that the Government can call for emergency 24 hours a day, 7 days a week. Both the contractor and U.S. Government representative will do an inspection of the vehicle and vehicle repairs.
8. Wrecker Service: In the case of vehicle breakdown the contractor shall furnish wrecker service at no additional cost to the U.S. Government.
9. Seatbelts: Seat belts must be installed for each passenger.
10. Accidents: In the event of accidents the contractor will be required to provide a replacement vehicle after notification that the vehicle has been in an accident. The replacement vehicle must be similar to the rental vehicle. Submission of claim for damages: Notwithstanding the claims procedure for third persons set forth in FAR 52.228‐8 Liability and Insurance‐Leased Motor Vehicles (i.e. the Federal Tort
Claims Act), if property owned by the holder of this contract is damaged by personnel directly employed by the United States Government, whether they are military, U.S. civilian or Spanish Ministry of Defense employees, and it is determined the person was acting within his/her official line of duty, the claim will be considered to be covered under Article 8 of the NATO Status of Forces Agreement, and therefore must be filed with (the):

11. Claims & Insurance: Any claim made against the United States Government, its employees, agents or assigns, arising from/or out of the terms of the motor vehicle leasing contract, must first be offset by the amount of insurance received by the claiming party from whatever source.
All vehicles must be fully insured at the expense of the contractor. Insurance should include accidents, breakdowns, roadside assistance, comprehensive, and liability.
12. Vehicle NCO: A Vehicle NCO will be assigned as the primary point of contact for this requirement.
The contractor shall provide contact information to this individual for the purposes of maintenance, exchanges etc. This individual will also be responsible for tracking the vehicles and assigning them to the end users. The contractor should, within 48 hours, provide a copy of any traffic violations to ensure they are given to the individual who committed the infraction.
13. Personal Documentation: The contract associated with this SOW will be between the US
Government and the contractor. There should not be a requirement for any individual to provide personal documentation to the contractor in the normal performance of this contract.
It is the ultimate responsibility of the individual operating the vehicle to resolve all traffic violations.
Individuals, by their own choice, may decide to provide information to the contractor in order to resolve traffic violations more quickly and easily. However, this is to be agreed upon between the contractor and the individual. The contractor is only responsible for promptly providing the violation to the VNCO.
13. Obligation of the Government: The Vehicle NCO does not have the authority to change the scope of the contract associated with this SOW or otherwise commit the Government. Only a contracting officer can change the terms or scope of the contract. These changes will be accomplished with a modification provided on a US Standard Form 30.
14. Records. The contractor should maintain records of transactions with the US Government and, upon request, make such records available to properly designated contract representatives within a reasonable period of time.
