About this file

This document is a justification for a sole source procurement from the Department of Justice for membership in the International Justice and Public Safety Network (NLETS). The Department of Justice seeks to acquire a 5-year membership in NLETS for $454,799.17 to provide single-point-of-entry access to international criminal justice data resources including driver license, driver history and criminal history information from all 50 states and other federal law enforcement agencies. As the sole owner and operator of a unified law enforcement database containing sensitive security information, NLETS is uniquely qualified to meet this requirement. Membership will allow for the real-time exchange of critical law enforcement and public safety information across jurisdictions. A price evaluation found the cost to be fair and reasonable based on previous membership rates and other relevant factors. Technical and budget personnel have certified that NLETS is the only responsible source able to meet the requirement due to the inherent governmental functions it performs.

Justification for other than full and open competition, Sole Source Justification

Description of Action:

This justification is prepared in accordance with the requirements of FAR 6.303 and/or 13.106 to support the recommendation that the Department of Justice (DOJ) use other than full and open competition for the acquisition of the following item:

International Justice and Public Safety Network (NLETS) Membership

Period of Performance: 5 years

Total Estimated Value $454,799.17

Negotiations will be conducted with NLETS on a noncompetitive basis under the statutory authority of 41 U.S.C. 253(c)(1), only one responsible source, as implemented in FAR 6.302-1 and/or 13.106.

Description of Requirement:

The proposed acquisition will provide, on a firm, fixed price basis, single-point-of-entry access to international criminal justice data resources for providing direct, real-time access to various driver license, driver history and criminal history information.

Technical Justification:

This FY23 procurement request is for NLETS membership for the purposes of exchanging of law enforcement, criminal justice, and public safety information with the 50 states and other federal law enforcement agencies.

Unique Qualifications of the Acquisition:

NLETS is a 501(c)(3) not-for-profit organization owned and governed by the states for the purpose of exchanging law enforcement critical information across a single unified database. The database, by its nature, is unique to the law enforcement community throughout the country’s various law enforcement type entities to share real-time updates and information to its users. Because of the inherently governmental nature of the security information possessed by

NLETS, no commercial providers of equivalent data exist.

Price Determination:

A price evaluation will be conducted based on previously purchased membership access along with other relevant information to determine that the price is fair and reasonable.

Certifications and Approvals:

Technical/Requirements Personnel Certification:

I certify that the technical justification is accurate and contains complete data necessary to support the recommendation for other than full and open competition.
